Currently the building is classified as Group F-2 (manufacturing), and the proposed use is classified as Group A-3 (indoor sports activity, with limited or no spectator accommodations). The Construction Type is II-B. This evaluation was performed in accordance with Chapter 10 of the 2012 Virginia Rehabilitation Code. A Chapter 10 evaluation scores a building's safety attributes in three categories: Fire Safety, Means of Egress and General Safety. A score of less than zero, in any category, indicates that the building, as is, is unacceptable for the proposed use. The results of the evaluation are: Fire Safety -12 Means of Egress -9 General Safety -7 The building, as is, is not approved for use as an indoor soccer practice facility. With one alteration to the building, the resulting scores will all fall within acceptable limits. The alteration, as we discussed on the site, is to construct a firewall to divide the large (45,000 sq. ft.) 6 %lose N6111116' space in half. This will require the construction of a 2-hour fire-resistance rated firewall for the length and height of the manufacturing building. Although the following alteration requirement does not have an impact on the scores, it is required for accessibility purposes. As we also discussed in the field, it will be necessary to rearrange the men's and women's bathrooms so that they each include at least one wheelchair accessible water closet. The determination stated herein reflects the Virginia Uniform Statewide Building Code only. Please maintain contact with the zoning administrator's office regarding zoning compliance. There was also discussion regarding wall and ceiling netting material and floor covering material. I have contacted the Fire Marshal's office for their input concerning the ceiling netting's potential impact on the sprinkler system. I have not yet heard back from them, but will forward more information to you as it becomes available. As for the floor finish material, that material must comply with ASTM D 2859. Please be sure to verify such compliance as you shop for the floor finish material. He has requested to go straight to the PC public hearing without a re- submittal. He received his first comment letter on October 3rd. In the comment letter,staff had a few questions regarding items that needed clarification;the main question related to parking.When the applicant came in on Friday he brought in a written response to the staff comment letter. He said he is not re-submitting, but needs his application to go to the PC as soon as possible because he needs to start his business during the winter months if his business is to succeed. I have the following two questions: 1. Should I treat his response as a re-submittal with no comments,which pushes him to a December PC public hearing? 2. He really wants to go to the PC in November. Is this possible? He wants to get to the earliest possible PC meeting. I told him I needed to talk with both of you about this and I would get back to him. Davis,County Attorney Greg Kamptner,Deputy County Attorney DATE: November 20, 2014 RE: SP 2014-00013 Broadway Street Soccer(Indoor) The conditions recommended by the Planning Commission included a Condition 2 which stated: All improvements needed per the letter from Jay Schlothauer,Building Official, dated September 22,2014 shall be completed prior to the release of the Certificate of Occupancy (C/O)for 1740 Broadway Street; and After reading Mr. Schlothauer's September 22,2014 letter to the tenant who would operate the indoor soccer facility,the improvements referenced in the letter are requirements of the Uniform Statewide Building Code. These improvements would have to be made regardless of the special use permit condition in order for the Building Official to issue the certificate of occupancy for the proposed indoor athletic facility use. As a practice for the past several years, staff has recommended that special use permit conditions not include conditions pertaining to matters that are otherwise required by the laws of other agencies, such as the Virginia Department of Health or the Virginia Department of Transportation,or that are required by the County in its own regulations such as the Subdivision, Site Plan,and Water Protection Ordinances. Complying with the Building Code falls into the latter category as well. This approach allows special use permit conditions to focus primarily on addressing impacts,rather than also servicing as a tool to provide notice to the applicant of other possible requirements.These other possible requirements are now identified in correspondence to applicants. Mr. Schlothauer's September 22,2014 letter was addressed to the tenant who would operate the indoor soccer facility, so he is aware of what he must do to satisfy the Building Code. Therefore, we advise that Condition 2 recommended by the Planning Commission not be included as a condition of approval. Please consider the following 2 favorable factors for the request: 1) At any given time, between 50 and 100 student athletes,after graduation from Albemarle County Public Schools, are competing at the highest levels of NCAA College sports. Current ACPS student athletes are regularly competing on the national and even international level of individual and team competition. When your Board approved funding in 2008 for three synthetic turf fields,training opportunities were substantially increased for these student athletes. Since your Board approved funding in 2012 for the Crozet Park Recreation Center,the Western Albemarle HS Swim Team has successfully defended three state championships and numerous swimmers have gone on to compete in Division I college programs. Dr.Weber would like to provide an indoor turf training facility that does not exist in Albemarle County. What a great opportunity for our student athletes to hone their skills without having to commit to late night commutes to Richmond (where similar facilities exist). 2) Indoor turf training facilities are not referenced in the Comprehensive Plan and are not referenced in the zoning ordinance. They certainly don't qualify as a typical "commercial" use where a similar structure would require over 250 parking spaces and would include a high intensity traffic volume (50,000 sf is a typical size for a grocery store). In reality,the requested use is probably a cross between a soccer field (which you would expect to see in a typical residential/civic application) and a warehouse use (which you would see in an industrial application), both requiring approximately one tenth of the parking and intensity as a commercial use. Dr. Weber has found a vacant warehouse space that has the correct amount of parking to provide this use and the neighbors don't object. Please approve SP 2014-00013.
