I regret that I am a day late with this, but yesterday I was tied up with my business and could not get to this application as I had wanted to. The PC's attorney, Greg Kamptner, who will be present this evening, has informed me that: a) since the structure at 1740 Broadway existed before 4/3/2013 when a new ordinance applied, my understanding is that a commercial use such as the one you are proposing is permitted in the LI district via SP. Such a SP commercial use does not supplant the existing LI status of the property, but merely supplements it, running concurrently with the LI status unless its timing is durational. b)the BOS has this year already granted a SP with a durational time limit and also did so in 2013 in another case. Your request of a specific period of time to apply for your SP for 1740 Broadway to cover the time period of your intended use may best guarantee your interests while preserving the county's desire to not see prime LI space removed from future potential LI use as provided for in the Comprehensive Plan. For this evening I am assuming you will be prepared to share the following: 1) Time frame of when you plan to initiate your use and the end date of your use. For the latter I suggest you be certain to not box yourself in so that you do not need to subsequently request an extension of your use. If you think you can be in and out of there in three years, say so, but give yourself a bit of a cushion (hence, requesting 44 months). 2)Parking study: as precisely as possible I suggest you indicate the location of the 20 parking spaces you have indicated your business will require, identifying the exact location of these spaces for reasons of safety for the youth and adults attending your program and for the potential movement of the back-of-building user's probable trucks and vehicles. 3) List of probable full-time and part-time employees by job assignments (office manager, soccer instructor, etc.)to demonstrate the link between your use and new employment for the county. Your staff report comments: Use of Surrounding Properties: The area is surrounded by industrial uses with the Buckingham railroad line serving as the northern boundary. CHARACTER OF THE AREA: This site is developed with a warehouse building and associated parking and loading areas. In general, the immediate surrounding area is tailored to industrial uses. Clear Communications and Champion Brewing Company are located to the west of the subject property. Wimberly, Inc. is located to the east of the subject site; to the north is the Buckingham Branch railroad line with the City/County boundary just beyond the railroad. The Yves Delorme corporate office and warehouse and the Festive Fare party rentals are located across Broadway Street, and to the south. We wish to point out that the one-mile north-western boundary of"urban neighborhood four" is adjacent to residential uses in the City of Charlottesville. The property under discussion tonight is adjacent to the Woolen Mills Neighborhood. 1 Thanks for your work.
