Please see the email below from Jack regarding the 7 on street parking spaces being requested along Kirtley Lane. I
regret not asking Jack this question weeks ago when the issue first arose and I'm not trying to further muddy the waters
but am asking for us (collectively)to take one more look at the code and its interpretation regarding this request. Based
on discussions with Tom, Bill and Bryan they are very reluctant to proceed to the BOS for a waiver on a county
sponsored project where CDD and PC both denied it which puts us in a bad spot with UVA and our lease agreement. I'm
not asking for us to ignore our standards but just want to be certain beyond a doubt that we haven't unintentionally
applied a standard for a parking lot that really should be on street parking requirements. Please call me as soon as you
can so we can discuss. I need to report out to Bill today on the status and notify UVA.

Trevor and Ron,
The location of the Ivy Fire Station is served by Kirtley Drive which is an existing"private" road as indicated by the
County Street Index(see attached). On-street parking, in a perpendicular alignment is provided along this private
street. The improvement plans for the fire station included expanding the on-street parking to provide some additional
spaces. At Tuesday's Commission meeting a requested a waiver of the maximum 5% parking grade was denied.
However,there was no need to request such a waiver for this grade requirement does not apply to on-street parking.
Please refer to the attached Code section 18-4.12.15 which is the minimum design requirements for parking areas. The
maximum grade requirement is stated in provision 18-4.12.15(c). However,the very first sentence of this section states
that these requirements are for"all offstreet parking areas".

Street parking is allowed by the Codt8-4.12.8) as an alternative means to mete number of parking spaces
required by the Code. Street parking is also allowed along both public and private streets, and the design standards for
streets allow grades in excess of 5%. So there will be cases (such as this)where the grade across street parking spaces
(being used for required parking) will exceed the standard for offstreet parking spaces. This is not a mistake or oversight
in the Code. When the Code amendment(including this provision)was being reviewed by zoning, planning, engineering
(during my tenure), and attorney office staff,this issue was raised, discussed and accepted as necessary to support the
initiative to achieve higher density in our growth areas and the Neighborhood Model vision.
