I do hope you're back to normal soon. In your absence, I discussed the best way to address your comments and answer Craig's questions (below)with Ellie, and am summarizing our intended response here. The references to any conditions or proffers associated with ZMA-72-239 and SP-72-196 should not apply, as those were withdrawn (see attached). That was when an ice skating rink was being proposed for the site, interestingly enough. With respect to the schedule of parking, the shared parking agreement (UVA and Korean Church) should be finalized soon. I will double-check with Zoning (Amelia had provided tentative approval of the basic arrangement), but I believe the only parties to the Agreement will be UVA and the Korean Church and that it wouldn't need our County Attorney's approval. I will include in that Agreement for Amelia's approval a request for one loading space to satisfy the anticipated loading space needs for the whole building. I will ask Craig to refer to the shared parking agreement in the Schedule of Parking, but also reflect the numbers that the plan and Agreement provide. With respect to the Landscape Plan, you indicated when you sent your comments to me (7/25/12) that you were unsure whether it was truly required and would get back to me, but I haven't heard further. I'm attaching Margaret's e-mail to me about indicating the "treeline to remain". I believe this revision, along with Craig's plan of clarifying the existing trees and canopy, will satisfy the Landscape Plan concern. With respect to the easement associated with the stairs off-site, we don't intend to construct or have approved for construction any improvements off-site, so I will have the plan adjusted to show the walkway/steps as ending at the property line. I believe the documents showing intent for all easements being granted will be completed fairly soon(awaiting on UVA BoV action on stormwater easement for KCC, expected 9/13). The plats and deeds for any easements will be completed thereafter, but I believe our site plan amendment can be approved prior to all of that being finalized/recorded. I don't believe the Volvo dealership will be providing any easements. Other than that,there are a couple of fairly straightforward questions from Craig that need answers (setbacks and lighting comments). By copy of this, I'll ask Megan or Ellie to advise if you will not be able to follow this up fairly quickly. Our fire station project schedule is getting stressed, so I need to do all I can to get our site plan amendment approved without delay. I hope to have the shared parking agreement (UVA-Korean Church)to you within a couple of weeks. We're hoping for approval of our site plan amendment for the fire station on the Kirtley site immediately after UVA and Korean Church action on necessary easements, expected by mid-September. In looking at Joanne's comments on our site plan what you'll need a little more closely, I have a couple of relatively easy questions, and one that's probably hard: Regarding the schedule of parking, I'll provide the requested breakdown of uses and required and provided spaces. The site plan comment for Schedule of Parking says,per the site plan ordinance (32.5.6b) "provide a count of the maximum amount required and amount provided" but I believe the ZO should say "minimum amount required" (and possibly maximum allowed), correct ? Related to that is the potential need for loading space provisions. Though not specifically addressed in site plan comments we've received, I believe the normal standards would require 2 for the size and type of uses on this site. I believe 1 would be all that's really needed for the uses envisioned, so I'd like to cover that with the documents that support our plan, which may amount to a ZA modification. Can that be provided with the parking agreement? Also there is a comment that says "it appears that the permanent shared parking agreement has to be agreed to and signed by the Korean Community Church, the Volvo dealership, and the UVA Health Services Foundation..."but I don't think there's any need for Volvo dealership involvement, is there? The agreement would be between UVA (or possibly UVA-HSF) and the Korean Community Church. Lastly, what I think might be the hard one: The shared parking agreement is supposed to be permanent, but I believe UVA is arranging for a 40-year lease for most of the adjacent Korean church spaces (see Charlie Hurt's e-mail below). I had thought that was probably seen before and considered suitable here and that recordation was not required, but now I am not confident of that. In the event that the 40-year lease is not considered sufficient if the parking requirement is being met, in part, on the leased site, let me pose a couple of questions, keeping in mind that there is some "murkiness" (at least in my mind) about the extent to which the Zoning Ordinance is applied to UVA in light of the 3-Party Agreement (I believe that's what controls): 1 I think UVA provided a separate wing study related to their Northridge celopment. I think the parking to be provided (shown on site plans, etc) is not driven by the normal Zoning Ordinance standards, but by what they provide as "expected needs." Given that, might a 40-year lease arrangement for some of the parking needed be acceptable? In case it's a factor, our Lease for the Fire Station portion of the building (and the 12 on- site parking spaces) is for 20 years (possibly shortened to 15 years if UVA gives notice). This site is not expected to provide the long-term solution for a County Fire-Rescue Station, and if the use changes, I would expect the site plan and parking arrangements would change. In the alternative, since the exact arrangements for the use of the bulk of the building (the unleased portion) have not been established by the University yet (they've indicated intention of creating offices there, but the numbers involved, and therefore the parking needs, have not been determined), can a site plan that provides for at least 37 spaces for that portion of the building be accepted if UVA demonstrates that it meets their need? In this scenario, I think that would make any shared parking agreement essentially a private agreement and not a site plan requirement. I hope all of the above is understandable enough and that we can find a good way to get the site plan amendment approved fairly soon. Construction will need to get going soon in order to meet the schedule for bring the Station online. Thanks in advance for your consideration of this. We don't have any concerns or issues generally, just need to follow a procedure to document numbers and the parking agreement. We basically need two things: 1) A breakdown of uses with sizes and estimated parking uses for all uses served by the parking area in question. Your plan notes the existing number of spaces and the new number, but there's no breakdown showing how much is needed versus provided. Since more than one use is involved,the uses need to be listed. If it's easier to do by separate letter, that's fine or you can put it on the site plan; 2) A permanent agreement for the provision of shared parking (Section 4.12.8 e and see below) Instrument assuring continuation of off-site parking. I know the site plan amendment can't be approved until the shared parking agreement is finalized, but I wanted to do all I can to make sure the process progresses while UVA gets their agreement with the Korean Church completed. I've copied your e-mail related to this below just for handy reference, and am forwarding a string of e-mails with UVA that speaks to the status of the agreement. In essence,their agreement is quite similar to the outline I provided in my memo to you on this. There's a slightly different configuration and possibly minor differences in parking space counts, but it's basically the same. As soon as UVA can get their agreement with the Korean Church finalized and their site plan amendment approved (which I understand is imminent), they want to proceed with the sitework, and have agreed to have the Kirtley sitework done at the same time (money and time savings for us), assuming our site plan approval is timely. I believe, given the "preliminary" OK on the shared parking plan from December, that our site plan amendment review can move along without the formal agreement document, but we won't be able to get the amendment approved without it. I have been trying to make sure our site plan approval does not delay your work on the Korean Church site and combining the Kirtley sitework with that effort. I assume you won't start that before having your lease with them finalized. I don't know if that lease affects the approval of the Korean Church site plan amendment, which I assume is still pending. As I think you know, I did pass along our good-enough-for-starting-sitework-cost-estimate plans to Gary to advance the effort towards combining Kirtley and Korean sitework. So, we're progressing, but not yet ready to predict the date of our site plan amendment approval. As we've discussed, we've got to get BOS approval for the critical slopes disturbance waiver included with our site plan(I see this as a formality which should go on their consent agenda). I was pushing to get this on their 4/11 agenda, but was told it would go to 5/2 agenda unless directed from above. I'd push for quicker action if it looks like 5/2 would pose difficulty for your timing with the Korean Church site, but I'd be on thinner ice if I don't have all of our parts together(ie, shared parking agreement). The bottom line is that, if at the time the office use would be proposed there is sufficient parking in place, including the KCC leased parking, then it would be a simple "zoning clearance" and not a site plan amendment process for such a change. Based on that, and the timing for our building permit approval that is needed to maintain our schedule (and also the land disturbing permit that will be needed for the sitework on the Kirtley site), I'd like to pursue the option of keeping "warehouse" as the use for the non-fire-station portion of the building on our site plan amendment, which will then forego the need for KCC Lease for site plan approval. I can commit that, if any site plan issues arise in the expected course of making that change to "offices" in the current warehouse, we (the County) will continue with support to get such site plan adjustments approved. But again, it appears that it wouldn't be an issue if the KCC Lease is in place. Are you in a position to authorize this, or get authorization for this approach? Please keep in mind that our site plan approval will also need some documentation as to intent for the necessary easements on the KCC property. I know the formal easements won't be in place until after the lease is consummated, but all that is needed for our site plan approval is documentation as to intent. If you want to forego having the plan"make ready" for the office use, then our plan can be approved without the KCC agreement because there would be enough parking on site for fire station and warehouse uses. In fact, if our site plan were approved based on warehouse for most of the building, I'm not too sure the change to offices would trigger a site plan amendment requirement, but I've been pursuing the site plan approval based on office use since our Agreement says we're responsible for plan approvals to support the intended use(s). The attached"sketch plat" ("1348_001.pdf') was provided by Mike Myers at Dominion Engineering to help clarify the minor adjustments that Yong Kim refers to. The attached"kcc easement plat.pdf' is what has been submitted to date, which shows the locations referred to in detail. Please advise if this does not suit the need for a confirmation of the intent by the Owner for the easements to be dedicated.
