Dear Mr. McKenchnie:
On August 5,2015 the Board of Supervisors took action on your Special Use Permit application to allow Use of
more than 400 gallons of groundwater per site-acre per day for a restaurant under Section 22.2.2 of Zoning
Ordinance on TMP 057000000031 A0 in the White Hall District. The Special Use permit was approved by the
Board's adoption of the attached resolution and conditions.
Please be advised that although the Albemarle County Board of Supervisors took action on the project noted
above, no uses on the property as approved above may lawfully begin until all applicable approvals have been
received and conditions have been met. This includes:
• compliance with conditions of the SPECIAL USE PERMIT;
• approval of compliance with SITE PLAN; and
• approval of a ZONING COMPLIANCE CLEARANCE.
Before beginning uses as allowed by this special use permit or if you have questions regarding the above-noted

RESOLUTION TO APPROVE
SP 2015-12 MECHUM'S TRESTLE
WHEREAS, Mechum's Trestle LLC (the "Owner") is the owner of Tax Map and Parcel
Number 05700-00-00-031A0 (the "Property"); and
WHEREAS, the Owner filed an application for a special use permit to use more than 400
gallons of water per day on the property for a restaurant, and the application is identified as Special
Use Permit 2015-00012 Mechum's Trestle ("SP 2015-12"); and
WHEREAS, the proposed use is allowed on the Property by special use permit under
Albemarle County Code § 18-22.2.2; and
WHEREAS, on June 16, 2015, after a duly noticed public hearing, the Albemarle County
Planning Commission recommended approval of SP 2015-12 with the conditions recommended by
staff; and
WHEREAS, on August 5, 2015, the Albemarle County Board of Supervisors held a duly
noticed public hearing on SP 2015-12.
NOW, THEREFORE, BE IT RESOLVED that, upon consideration of the foregoing, the
Transmittal Report prepared for SP 2015-12 and all of its attachments, the information presented at
the public hearing, and the factors relevant to a special use permit in Albemarle County Code § 18-
33.8, the Albemarle County Board of Supervisors hereby approves SP 2015-12, subject to the
conditions attached hereto.

of daily water consumption monitoring will be made available within forty-eight (48) hours of
a request from the Zoning Administrator.

recommended approval of the above-noted petition to the Board of Supervisors.
Please note that this recommendation is subject to the following conditions:

This letter refers to my August 19. 2013 upprovul of a well site and September 4. 2014 re-inspection of the well site to
potentially serve a proposed waterworks in Albemarle County, Virginia. In accordance with §12\//\C5'500'280 of the

A yield and drawdown test must be run for at least 18 hours. We recommend the pumping rate
be controlled throughout the test to maximize the production from the well and to produce a
Yield and Drawdown"Pest stabilized pump water level for at least the last six hours of the yield test. Immediately following
Duration: the yield and drawdown test the water level recovery in the well should be recorded for no less
than 6 hours or until the well returns to its static water level, whichever occurs first. If water
will discharge into streams during pumping tests, please contact the Department of
Environmental Quality Northern Regional Office to determine if a discharge permit is required.
A series of twenty bacteriological samples must be collected from the well discharge and
submitted to a certified laboratory (DCLS or private laboratory) in order to determine the
bacteriological quality of the raw groundwater. One bacteriological sample must be collected
every 30 minutes or more during the last part of the pump test. These samples must be analyzed
by the total coliform and E. coli Most Probable Number(MPN)test method.

and Chemical Sampling: Water samples must be collected to analyze for cyanide. nitrates/nitrites, inorganic chemicals.
metals, radiological, and volatile organic chemicals. The chemical samples should be collected
near the end of the pump test,prior to the recovery period.
The wellhead area does not appear to be vulnerable to synthetic organic chemicals(SOCs). You
will not be required to take developmental samples for SOCs.

Construction Permit: Construction permit application (for completion of the well installation/waterworks).
Final construction plans and specifications prepared by a professional engineer licensed in
Virginia. including recorded plat of the well lot, and a recorded dedication document for the well
lot. The dedication document shall clearly state that the well lot will be used only for the
waterworks appurtenances as long as the lot is being used as part of the waterworks.
Upon receipt of the required documentation and after plans and specifications have been approved, a construction permit or
permits will be issued by the State Health Commissioner in accordance with § 12VAC5-590-230 of the Waterworks
Regulations. Construction of the waterworks facilities shall not be started until the construction permit has been issued.
All water well drillers are required to be licensed by the State Board for Contractors. You may contact the State Board for
Contractors,Virginia Department of Professional and Occupational Regulation, 9960 Mayland Drive,Suite 400, Richmond, VA
23233 (804/367-8511)to determine if a well driller is licensed.

1) Add a condition to monitor the water usage and for the applicant to provide a yearly report to the
County. This leaves the applicant the responsibility of self monitoring. All we have to do is verify the
monthly report at the end of the year.
2) Add a condition to provide pervious pavers. This parcel is wedged between two floodplains and
the feasible site bmp selection is limited. Also note that the Groundwater Management Plan from the
Tier 3 Groundwater Assessment report states, "the proposed development will attempt to minimize
the degradation of groundwater recharge, and groundwater surface water quality by preserving
existing vegetation where practicable and by implementing stormwater strategies to minimize offsite
runoff."
