Dear Claudette,
As per your letter from yesterday, we have revised the table in Section IV of the Code of Development(Sheet 5 of 8)
and removed the accessory apartments as an allowed use in Block 5. This was erroneously missed in earlier
revisions. Please find attached 10 sets of the above referenced plan for the Planning Commission packets. We will
submit an electronic set of the plans to your e-mail account today.

Responses to May 1, 2015 Community Development Comments
Dear Ms. Grant,
In response to recommendations from County Staff as articulated in your May 1, 2015 letter; please
review the attached documents for presentation to the Planning Commission as they relate to the requested
zoning amendment. Included for your review, please find: eight(8) sets of the revised Application Plan with a
current revision date of May 18, 2015 and revised proffers for the development.
As we mentioned in our meeting with you last week, our original intention in requesting the zoning change
was two-fold: (1) to allow carriage house units as an additional option for the required affordable units, and
(2)to allow affordable units within Block 5 of the development.
It is evident from Staff comments and from meeting with you that the carriage house units will not be a
practical addition to the approved development(which is under construction) and our revised documents
have removed this requested addition. We are currently requesting only the change to the current NMD
zoning to allow affordable units within Block 5 of the District. Please consider the following responses to
comments provided by County and VDOT Staff:
COMPREHENSIVE PLAN:
• Neighborhood Density Residential—No changes are proposed...no comments to address.
• Greenspace- No changes are proposed...no comments to address.
• Neighborhood Model—"The Neighborhood Model District remains consistent with both
plans...The general proposed intent of this rezoning amendment request is not substantially
different than the approved rezoning..." no comments to address.
PLANNING:
• Community Meeting Requirement—As you mentioned, the next regular meeting of the
Pantops Advisory Council is June 22, and it is our intent to go before the Planning
Commission on July 14. Justin will contact you to coordinate our request as an agenda item
for the June 22 PAC meeting.
• Density—No changes are proposed for the density of the site. This was confusing because
the Applicant was requesting to provide detached Carriage House Units in Block 2 above the
garage. Since these accessory units would count toward the overall density of the site, the
Applicant is no longer proposing to provide Carriage House Units and the Application Plan
has been revised accordingly.
• Carriage House Units(access and parking)—Fire-Rescue and Zoning have expressed
concerns with the ability to access the Carriage House units and to provide adequate
parking for the same. The Applicant has acknowledged these concerns and is no longer
requesting to allow Carriage house units for the development and the Application Plan has
been revised accordingly.
• Sheet 6/Table VI—Should include affordable units by type for Block 5. This change has
been made to allow multi-family housing type in Block 6 as Affordable Units.
• Authorized Signature—Documentation will be provided to permit Chris Henry as an
authorized signature on the application.
ZONING:
• Affordable Housing Exhibit—The exhibit is difficult to read. The Exhibit showed additional
locations for affordable units within the Carriage House units in Block 2 and within the
multi-family units in Block 5. Because of reasons mentioned above, the request is now
amended to only include additional location for affordable units within the multi-family
units of Block 5.
• Density—Carriage houses count as a unit towards density. The application plan has been
amended and Carriage house units are no longer proposed.
• Accessory Apartments (COD)—Accessory apartments are subject to Section 5.1.34 of the
Zoning Ordinance. Note 2, accompanying Table IV on Sheet 5 of the Application Plan has
been added to acknowledge that accessory apartments are subject to Section 5.1.34.

• Additional Off-street Parking—There may not be adequate parking in Block 2 for carriage
houses or accessory apartments. Carriage houses are no longer proposed with this plan and
accommodations to the site plan will be provided if additional parking is needed in Block 2.
• Sheet 6/Table VI—Should include affordable units by type for Block 5. This change has
been made to allow affordable units in Block 5 as a multi-family housing type.
ENGINEERING AND WATER RESOURCES:
• No Comments Received
ENTRANCE CORRIDOR:
• No Impact is anticipated—No comments to address.
VDOT:
• No Objection to Proposed Amendment— No comments to address.
ACSA:
• No Comments Provided— No comments to address.
RWSA:
• No Comments Provided—No comments to address.
FIRE/RESCUE:
• 20' Unobstructed Access Required for Carriage House Units—The carriage house units are
no longer proposed for the development.

PROFFERS:
• Concerns with Park Dedication/Design/Trail Construction—No changes are requested that
affect the Park dedication, design, or trail construction. As a separate item from this
application,the Applicant will contact Parks and Recreation to discuss and resolve their
concerns.

207-8086 and we can discuss in further detail. As we discussed, It is our wish to proceed to a public hearing
on July 14 and please let us know if any concerns arise that might prevent you from offering a
recommendation of approval at that hearing.

My recollection is that issues 1 and 3 identified by Dan below were also raised when the Riverside Village ZMA was
under review, but we should raise them again particularly given that they have a ZMA pending anyway and the
applicant's desire may have changed. I found a 2011 email related to Dan's third comment regarding trail design being
subject to RV-HOA approval, and the reply was that the trails were to meet the design standards in the RV Code of
Development.

Based on a conversation Dan and I had earlier this week, it is my understanding that Parks and Recreation would like to
see a few revisions relating to the park and trail system proffers that are not currently stated in the proffers. I do believe
the proffers would need to be amended to make the changes Dan is suggesting.As I mentioned to Dan, if this is what
Parks and Recreation would like and the applicant is agreeable to this, then now is a good time to amend those proffers,
since we have another proffer amendment currently under review. I hope this helps to clarify.Thanks

Attached is the proposed deed to convey the park land within the Riverside Village development along the Rivanna River
near the intersection of Routes 20 and 250.The park dedication was proffered as part of the rezoning(see proffer 1 of
the attached). Ellie Ray will be sending you a copy of the plat.
