All,
By decommissioning 1302 I mean not having a dwelling/apartment in the structure, it can remain as a garage/storage
building.
Leaving the structure as an accessory structure and not a dwelling should not cause issues with eventual site plans or
subdivisions.

Hello Mike,
It was good to finally meet you yesterday. I spoke with Francis about our conversation and concern regarding
1302 and 1304 Crozet Ave. and their nonconformity on the subject property. I have copied Francis on this e-
mail so that he can comment on anything I might miss. When we spoke, you explained that you, per the
applicant's request, would like to eventually decommission one of the two properties and your preference is to
eliminate 1304 because the structure is in poor condition and not meeting building codes. Francis
recommended the decommission of 1302 because it is the more nonconforming structure of the two properties
due to lack of meeting the setback requirement.
All of this said, from a zoning standpoint, Francis feels his recommendation is what is preferred. While we
understand your circumstance regarding the physical structure of the two units and the fact that one needs
more repair than the other, we see this rezoning request as an opportunity to correct a nonconforming
structure. You can certainly make an appeal for why you want to save the structure you have chosen. We
recommend you provide us with information that justifies your request. The following are the types of questions
you should answer in making your justification for saving 1302 instead of 1304: Do you know the history
behind 1302? For example, How long has it been there? How did it get built right on the property line? Has the
apartment always been in the building? If not when did the apartment get added in? Please add any additional
information that will help in justifying your request.
Francis, please feel free to correct or add to anything that I have said. Thinking ahead, do you foresee any
reason that approval of this rezoning request and acceptance of the already nonconforming structure would
cause issues during the site plan or subdivision process?As it is our intent to make sure that if approved, this
decision will not cause future problems.
