Dear Ms. Hartless:
In response to your request for a Letter of Zoning Compliance for the above referenced
Property, please be advised of the following:
• The Property is zoned Planned Development Shopping Center (PD -SC). (See
attachment) The parcel is not part of a Planned Unit Development. The property is
subject to the Entrance Corridor ("EC"), the Airport Impact Area ("AIA") and Steep Slopes
Overlay Districts. The property is adjacent to the public road to the Northwest and on all
other by properties zoned PD -SC.
• The Property is developed as part of a retail shopping center known as Fashion Square
Mall. Such use is a use permitted by -right in the PD -SC district.
• This Property is subject to the Site Development Plan, SDP1979-00007 that was
approved on October 26, 1979. The Property has been developed per the approved
plans. A site inspection was completed and revealed inconsistencies with the
landscaping approved with the 1979 site plan. Some of this landscaping no longer exists
in multiple locations throughout the entire Fashion Square Mall development. It is the
responsibility of the property owner(s) to maintain the site as approved on the noted site
plan. Changes to the site must be approved though the site plan amendment process.
County staff understands that landscaping dies and is sometimes not replaced. At this
time no complaint regarding the missing landscaping has been received by this office.
Thus, the County will not be pursuing a violation of the site plan at this time.
The Property is subject to a Variance, VA -1979-00031, approved on August 14, 1979 for
an increase in wall sign square footage.
This office has no record of any open violations for this parcel.
• Copies of any approved site plans, special use permits, and certificates of occupancy or
other documents may be obtained from this office with a request through the
department's Records Manager, Paul Bjornsen, at pbjomsen@albemarie.org

This letter is to inform you that on August 14, 1979, during
the regular meeting of the Albemarle County Board of Zoning Appeals,
Application VA-7�-31 was granted on the condition that the variance
be in accordance with the evidence presented to the board concerning
additional signs. There will be only four free-standing signs for
the entire shopping center, one free-standing pylon sign not to
exceed 49 square feet and three entrance signs.not to exceed 25
square feet each.
The variance approved for Leggett of Virginia, Inc. allows
three wall signs with a total aggregate area of 594 square feet;
a variance of 394 square feet.
