Dear Mr. McGinty,
This letter is to approve as a Letter of Revision the removal of part of the path near the
stormwater management facility in the northern end of the development. The portion of the 8
foot asphalt path that extends north of the check dam will be removed and the area reseeded.
South of the check dam the path will be retained. No bridge will be constructed over the check
dam. The original plan showed the path to be 10 feet wide and gravel. An 8 foot asphalt path
was constructed. An 8 foot asphalt path is approved with this letter. The path north of the
Carmike connection will be barricaded to prevent pedestrian access as shown on the approved
plans. This is the I" Letter of Revision for this site. A total of three (3) Letters of Revision are
allowed before all changes to the plan are required to be submitted in the form of a site plan
amendment.

Bill -
It has been brought to my attention that the section of the
Arden Place trail north of the Carmike Cinema vehicular
connection has been built according to the originally approved
2009 site plan, but fails to comply with the site plan as
amended in April of 2010. The amended site plan calls for the
trail to terminate at the Carmike connection, with only a 10'
gravel storm water service path approved for construction north
of Carmike connection. As constructed presently, an 8' asphalt
path extends north of the Carmike connection towards the lagoon,
as was specified in the 2009 site plan.
To correct the deviation, I propose to remove all asphalt from
the section of path north of the storm water pond using the
check dam as a point of demarcation. I request that we be
allowed to keep the 8' asphalt section of path south of the
check dam in lieu of the 10' gravel path called for in the
amended site plan - this is a betterment that will facilitate
maintenance of the pond in the future. The storm water access
road will be barricaded to prevent pedestrian access, and no
bridge will be constructed over the check dam. I believe these
adjustment will bring us into compliance with the amended site
plan. Please let me know if you agree, and if a more formal
submission is necessary to document this, or we can just allow
this email to suffice.
Our plan is to complete this work in the very near future, well
before the schedule called for in the Phasing plan.
It should be noted that nearly all of the path north of the
Carmike was constructed over a RSWA easement, and that all of
this land had already been cleared of large caliber trees when
the waterline was installed. Only saplings and scrub brush were
removed with its paving and the land was already rough graded
for the trail. The Arden development's commitment to tree
preservation has been real from the beginning, and the
construction of this trail doesn't diminish that fact. Finally,
this section of forest had become a fairly well worn path before
Arden came along, as I expect it will continue to be in the
future, with or without the asphalt. Indeed, the trail was
routed to follow a path that already existed. That said, we
will bring the project into compliance with the amended site
plan, with your approval of my minor change requests stated
above.
