Pat,
Good question. We are not yet finalized on either parcel. We were waiting to finalize the plats
before finalizing the Deeds. I understand that there's agreement on the terms of the Deeds, and that Mr.
Wood is required to sign them under the terms of the parties' Agreement for Transfer of Real Estate.
He's also represented in the closing by an attorney who has responded fairly promptly in the past. I'm
hoping that once we have the final signed plat, the rest of the pieces of this puzzle will fall into place
fairly quickly. Let me know if you have further questions or would like to discuss. Thanks.

I understand that the easement piece has an issue. Is everything squared away on the 5.05 acre fee simple
dedication parcel? I realize they are both part of the same proffer but was wondering if we could we finalize and
record the fee simple dedication?

Summer Frederick met with me this morning about River Heights, and we
discussed the Plat Showing Greenway Easement Located on T.M.P. 45-68D. She
noted that the only items missing were:
(a)The owner's signature, and
(b) A signature block for the County
I was just about to return the original Plat to the owner's attorney to
address both of these when I noted their prior message below indicating that the
County generated this Plat. Is/was Residential Surveying Services the County's
surveyor? Should we be the ones sending this directly to RSS for them to add a
County signature block? Let me know what you know. Thanks.

After the County signs the plat, we usually take back to Roger Ray and they make the
copies then Roger signs and seals so they are in proper form to record. The Greenway
Easement plat was generated by the County but we have reviewed a copy and are OK
with it. Wendell can sign most any time.

When we were looking through the SUB 2007-319 file together, it seemed as though your file version of
the River Heights greenway plat was missing the most recent revisions, which Summer had requested.
Attached is what I understand to be the most recent version of the plat, complete with the requested changes.
Have you received this revised version of the River Heights greenway plat in approvable form yet? If
not, shall I request that the signature line for the "Director of Planning" be replaced with some other language
first?
Let me know where we are with the River Heights greenway plat. Thanks for your help.

plat. Those modifications appear to have been made to the attached. My only question was whether we should

Thanks for the offer. I'm hoping we can locate the original signatures, as just getting the agreed
documents signed seems to have been a major hurdle in this case. The fewer documents that need signatures
the better.
Also, I'm interested in Rebecca's take on whether the plat signed in October 2008 is still valid, or will
need to be re-executed. Again, I'm hoping that we have an original document that's both fully signed and still
valid, but we'll do what we need to do to get final recordable documents. Thanks.

Andy-
I wanted to confirm with you the steps needed to get this proffer satisfied before contacting the property owner. I've
gone through what files we have again and tried to summarize the status of the two plats. Also, I'd like clarification on
what the owner is responsible for and what the County must do/pay for.
I found that the plat associated with SUB 2007-312 (dedication of the 5.05 acre parcel) was signed by the owners and
County.This application was being handled by Roger Ray &Associates as the applicant and preparer of the plat.The plat
has not expired and is still valid because of Section 15.2-2209.1. I believe the transfer agreement specifies the owner
pay the cost of recording but the County would pay the and the deed will need to be signed. Is the only outstanding
matter with this dedication the deed?
The plat associated with SUB 2007-319 is suspended and this application was being handled by Dan in Parks& Rec with
Residental Surveying Services preparing the plat. From the chain of e-mails below, it appears Dan had worked to get the
final changes made to the plat but that is not reflected in the County's file for this SUB.The last correspondence in the
files and in County View are from October 2007. Dan if you have copies of the revised plats or any records, we can start
the review again on the plat and get the approval process going again with the County. The deed is also an outstanding
item with wrapping up this transaction.
Once the greenway plat is finalized, then we can move forward with getting the deeds signed by the owner and then
everything recorded? Do I have that right?

We're trying to address Ellie's comments on the attached greenway easement plat, but are having trouble
determining who prepared it. Any ideas on where and with whom this plat originated? Ms. Harrell indicated that
she contacted Brian Ray,but this plat was prepared by Roger W. Coleman,Jr. of Residential Surveying Services.
Are they one and the same? Would the County have asked either of them to prepare this plat? Any insights
would be appreciated.

who commissioned the surveyor who prepared the plat? If River Heights Associates, LP did,please pass along
these comments to the surveyor, and request these modifications. If not, let me know and we'll contact the

SUB201300007 is ready to be signed by the owner and submitted for county signature. It has been since October, but
the plat hasn't come back to us for signature.
Yes, the deed of easement is the only remaining item for SUB200700319. This has been the case since April of 2013.
Technically, both of these applications should be withdrawn due to inactivity, but I guess we're going to just move
forward in hopes of actually getting them completed.
