Formerly, if you had between 151-200 parking spaces, six of them had to be accessible. Now,for 151-200 parking spaces, seven of them must be accessible. My previous reviews had been based on the previous chart, but I used the current chart for my latest review. It's chart(scroll down) seems to indicate that 6 is our magic number and that's what we've been showing. Would you mind taking a moment to look at this issue again and let me know if I'm coming at it from the wrong direction? I think this is all I need...I'll discuss with David to make sure. Yes, I believe it requires a waiver no matter how small the impact. My real concern is whether or not there was neighbor concern about the disturbance for the pipe. It seems like there really wasn't...it sounds like it was acknowledged that the disturbance was likely and that the waiver would be required with the site plan. It sounds like the concern was really about how much additional disturbance might happen. I'll follow up with David and let you know if I need anything else. Thanks again! I do not remember the pipe in question being an item of major focus, but I do remember that area was discussed at some point.What I should have explained in my previous e-mail is that we always expected that they would probably have to disturb the buffer, primarily because of grading,thus any disturbance in the buffer would require a waiver. I think what I hear you saying is that this pipe is the only disturbance in the buffer and the issue is relatively small. Do they still have to do the waiver? I would say technically,yes, but maybe there are other examples where we did not make the applicant do this for such a small detail that was not heavily discussed during the rezoning. I re-read Woody Parrish's letter and I looked at several staff comments. We wanted the applicant to do the waiver request with the rezoning, but they opted to do it, if needed, during the site plan stage.The major issue had to do with disturbance for the wall and landscaping. We did not exempt the pipe from the need for a waiver due to disturbance. Does this help or should others weigh in? It sounds like this was mostly in reference to the walls around the exterior of the site and not really about the pipe that's now the focus of the waiver request. Do you know if there were any comments specifically about the pipe? Or specific concerns from others...not just comments from staff? The pipe is shown going through the buffer on the application plan,so I guess what I'm asking is if the buffer disturbance was sort of expected for the pipe while the concern in this letter was more about possible additional disturbance to build the walls? And if there was neighbor concern or if this was just in reference to staff comments that a waiver would be required? I may try to call a little later (I'm working on another project right now)...but I wanted to ask these questions first in case additional research is needed. I also reviewed the waiver request with David and I think its fine to proceed directly to the Board on the consent agenda with a recommendation of approval, if my comments below are addressed, potentially at their August 5th meeting. Keep in mind that the Board members do have the option to pull the item for discussion, so it may not stay on consent. Two items need to be addressed to move the waiver request forward with a recommendation of approval: 1) The limits of disturbance in the area near the pipe are shown differently on the site plan and the waiver exhibit; please clarify which is accurate and revise whichever plan is incorrect. Make sure the square footage of disturbance provided in the waiver request letter is accurate as well, and provide a revised letter, if necessary. 2) The waiver request letter says the disturbed area will be revegetated, but neither the site plan or waiver exhibit show any proposed planting in that area; please revise both the site plan and waiver exhibit to show the proposed fence extending all the way to the property line along the buffer line (it looks like it ends just short now)and show some evergreen plantings in the disturbed area behind the fence. This needs to be added to address items(ii) and (iii)from section 21.7(c) (shown below). 3) I will need the revised waiver exhibit(and request letter if the square footage of disturbance is different than your first letter) as soon as possible so I can try to get my staff report written by July 10th(the deadline for the August 5th BOS meeting). If timing is not an issue (it may not be given the easement plats still need to be submitted, reviewed and approved),the next available Board meetings are in early September. I realize that we have yet to provide all of the easement documentation. Tom Lincoln is crafting the plats now that all parties have agreed to the terms (ACSA/C'ville Gas/Federal Realty/Sue Albrecht). Tom's draftsperson, Laura, retired the end of May and so things are a bit slower than usual coming from his office. I understand through email copies that I received that you were wondering if there was any way we could shift the stormwater outfall pipe alignment such that it would not impact the 20' buffer. That would be an uphill battle to do that. Federal Realty was not keen on the idea of our having to demo improvements on their site to accomplish our needs. Therefore, we placed the line across a small corner of their property which is beyond the edge of their pavement. We are able to install it as shown without disturbing area outside a 20'-wide permanent easement or demolishing pavement. They agreed to this after more than a year of negotiation. We will not be going back through that time-consuming and arduous process again. I think we now have tentative approvals from all other agencies and departments. I would like to know what you think as soon as you have had time to thoroughly consider our submission. I will check my email while away. The special exception referenced in the body of the email (yes, for limited buffer disturbance) is scheduled to go to the Board on September 2"d if it gets through the review/approval process with Legal and the County Executive's Office. There were also a few little things left on the site plan itself; notes and such. The biggest item is probably submitting the easement plat and getting that approved and recorded. I'm the architect, and my work has been on hold for some time, but it looks like I may be needing to finish up the building design before long. I believe this is regarding a special exception for limited disturbance of the buffer. If this request is approved, are there other items that will still need to be resolved before the site plan can be signed?
