Intended use or Justification for request:
Plan sheets submitted contain modifications to original plans as issued in a Site Change Directive. The majority of the changes were made at the request
of the Virginia Department of Transportation (VDOT) and Albemarle County. A VDOT inspector visited the site and requested that two (2) sidewalk ramps
be added along the existing sidewalk adjacent to the new truck exit. Dewberry coordinated ramp designs with Dennis Seale of VDOT who has
approved the layout as shown on the submitted plans. Albemarle County's Zoning and Planning Departments have requested that the Pallet &
Bale areas be striped and appropriate signage installed. Dewberry has been coordinating with the County. In addition to the requests made by
local and state officials, there are a few items that have been changed during the project due to outside factors and are shown on this
amendment. A site light pole had to be relocated in the southeast section of the parking lot due to a conflict with overhead electric lines. Also,
several existing landscaping plants were damaged and removed during snow removal activities that were carried out over this past winter's snow
and ice storms. These plantings are shown on the Proposed Landscaping Plan to be replaced.

Plan) of the Albemarle County Zoning Ordinance. I understand that plans which lack information required by said sections
shall be deemed incomplete and shall be denied by the agent within ten (10) days of submittal as provided in Section 32.4.2.

.Dear Mr. Higgins:
The purpose of this submittal is to request a reduction in the minimum number of loading
spaces for the above referenced Project as required by section 4.12.13.c of the County's
Zoning Ordinance (Code). Based on this section, the Project requires a minimum of nine (9)
loading spaces; we request a reduction in this amount to five (5) spaces.
DESCRIPTION OF THE PROJECT
The Project, located in the County's Hwy. 29 Corridor District, includes a 35,190±SF
addition to the existing Wal-Mart store which represents a 30% increase in size. This
expansion will allow Wal-Mart to service its customers with a greater selection of grocery
items at this facility. The expansion also includes a new vestibule entryway with indoor cart
storage areas and three (3) additional loading bays. In addition to the building expansion,
several upgrades will be made to the existing parking lot. These site improvements include: a
pavement overlay with restriping and new directional signage, increased landscaping,
replacement and in some areas enlargement of existing curbed landscaped islands,
replacement of the existing 42 ft. high site light poles with 20 ft. high site light poles, a
designated truck exit route onto Hilton Heights Road, designated bus stop with benches in
front of the store, a new retaining wall adjacent to the building expansion, and installation of
approximately eight (8) Filterra water quality units. All existing outdoor storage trailers will
be removed and the designated outdoor sales areas per previous Special Use Permits will no
longer be utilized.
WAIVER REQUEST
According to the Code, the required number of loading spaces for the Project is one (1) space
for the first 8,000 SF of retail gross leasable area plus one (1) space per each additional •
20,000 SF of retail gross leaseable area. Based on the areas shown on the Site Plans, a total of

nine (9) loading spaces are required by Code for the Project. The enclosed Site Plan that is
being submitted as a Minor Site Plan Amendment shows a total of five (5) loading spaces
located in each of the truck dock bays. The public health, safety or welfare will be equally or
better served by this waiver, and the waiver will not be a departure from sound engineering
and design practice; and the waiver will not otherwise be contrary to the purpose and intent of
this chapter.
