Charlottesville, Virginia 22902 RE: SUB201500206 Dunlora V- 14 -401 Exception request Mr. Shifflett: You have submitted a request for exception from the prohibition of double frontage lots for the Dunlora V subdivision. This regulation and exception criteria are found in Chapter 14, Sections 401 & 203.1 of the Albemarle County Code. In order to approve the exception the following findings must be met (14- 203.1(B)3): The agent may approve a request for an exception from any requirement of the applicable regulation upon finding that: (i) because of an unusual situation, including but not limited to, the unusual size, topography, shape of the site or the location of the site; or (ii) when strict adherence to the requirements would result in substantial injustice or hardship by, including but not limited to, resulting in the significant degradation of the site or to adjacent properties, causing a detriment to the public health, safety or welfare, or by inhibiting the orderly development of the area or the application of sound engineering practices. As a representative of the Agent, it is my opinion that the request meets the requirements for granting the exception in accordance with 14- 203.1(B) due to the location and shape of the site. The site is located in a highly developed area of the County, is just over four acres and is bound by existing roads on three sides. The existing roads and shape of the parcel make it difficult to avoid double frontage lots while also providing sound road design for the internal road. It is my opinion that prohibiting double frontage lots would inhibit the orderly development of the property. No adverse impact on adjacent property is anticipated; therefore the exception is granted for Lots 5, 6 and 7 with the following conditions: 1. Lots 5, 6, and 7 will be screened as provided in 14 -419 and demonstrated on the approved Dunlora V Road Plans dated 2/5/16, and the Dunlora V Exception Request Exhibit dated 12/17/15. 2. When the Final Plat for Dunlora V is submitted, landscape easements will be provided for the screening as shown on the Dunlora V Exception Request Exhibit dated 12/17/15.
