Dear Mr. Gatobu:
This letter is to document and respond to your review comments generated by County
staff for the above referenced project. The responses are to the comments dated July 19,
2010. Our responses are as follows:

Comment: This proposal has been submitted as a final site plan prior to a
preliminary. The ordinance contemplates the approval of a preliminary site plan
prior to the submittal of a final site plan. However, by interpretation the
ordinance does allow the submittal of a final prior to approval of a preliminary.
No mechanism exists in the ordinance for the County to approve with conditions a
final site plan. Therefore, if the site plan does not have all the necessary
approvals to allow signature by the revision deadline the County will deny your
application. You may request that this project be changed from a final to a
preliminary site plan which may allow the County to approve the plan with
conditions or you may request that the County defer taking a formal action on
your application.
Response: We request the County to defer taking a formal action on the
application by the deadline of August 2 "d. We request formal review and
approval by Albemarle County and ACSA of these revised plans.
2. Comment: Gross residential density: Please add the Gross residential density
(Du/Acre) on the site plan.
Response: The gross residential density has been added to the cover sheet 1
of 15 under Site Data.

3. Comment: If a landscape plan is required, maximum amount of paved parking
and vehicular circulation areas. Please add the maximum amount of paved
parking and vehicular circulation areas to the site plan. This figure will be used
to calculate the interior landscaping required.
Response: The area of the travelways and parking areas (excluding on -lot
driveways) has been added to the cover sheet of 1 of 15 under Site Data. The
landscape plan has been adjusted accordingly.
4. Comment: Ifphasing is planned, phase lines and proposed timing of development.
Response: There will be no phasing of the plan as the size of the development
does not warrant the need to phase.
5. Comment: [32.7.2.5] The commission or the agent may require provision for
and/or construction of travel lanes or driveways to serve adjoining properties.
The pavement of vehicular travel lanes or driveways designed to permit vehicular
travel on the site and from adjacent property and parking areas shall be not less
than twenty (20) feet in width. (32.5.7, 1980; Amended 5 -1 -87) Please construct
the travel lane (Avemore Pond Road) to the property line where the property
meets Wilton County Lane.
Response: The travelway layout has been revised to align with Wilton
County Lane as requested and as discussed during our 7/29/10 meeting and
is in compliance with our 8/6/10 electronic communication of which a copy is
enclosed.
6 Comment: [32.7.8.2] Is outdoor lighting is proposed? A lighting plan is required
if outdoor lighting is proposed. Outdoor lighting shall comply with the
requirements of section 4.17 of the Zoning Ordinance.
Response: Note 5 under General Notes on cover sheet 1 of 15 denotes that
each unit is equipped with either a free standing or wall mounted fixture
with lamp less than 3000 lumens.
7. Comment: [32.5.6 a] [4.11.3] Approval is required to reduce side setbacks from
15' to 10. Please contact the Fire and Rescue department and provide evidence
that Fire and Safety has approved the reduction of the side setback to 10'.
Response: The approval of the side set back reduction from 15' to 10' by the
Fire Marshal is evidenced by the Fire Marshal's approval of SDP -2010-
00051 on 7/13/10 and as verified during the 7/22/10 SRC meeting.

8. Comment: 32.7.2.8 Provision shall be made for sidewalks and pedestrian
walkways which will enable pedestrians to walk safely and conveniently between
buildings on the site and from the site to adjacent property. Please provide
sidewalks that will enable pedestrians to walk safely and conveniently between
buildings on the site and from the site to adjacent properties.
Response: Sidewalk has been added to the front of all units and connects to
the existing sidewalk along the south side of Avemore Pond Road. The
extent of the sidewalk required by the County was determined during our
7/29/10 meeting with County staff.
9. Comment: Interior landscaping: Exclusive of the requirements of section 32.7.9.7
(a) and (c), an area equal to five (S) percent of the paved parking and vehicular
circulation area shall be landscaped with trees or shrubs. (b) This shall include
one (1) large or medium shade tree per ten (10) parking spaces or portion
thereof, if five (S) spaces or more.
Response: As agreed upon during our 7/29/10 meeting with County staff, we
have designated which trees constitute the interior landscaping (see sheet 15
of 15).
10. Comment: Please show interior landscaping calculations at S (5) percent of the
paved parking and vehicular circulation area. Additionally please indicate the
number of large or medium shade trees per ten (10) parking spaces provided.
Response: The calculation has been provided and is in accord with the
Zoning Ordinance and our discussion during the 7/29/10 meeting with
County staff (see sheet 15 of 15).
11. Comment: I could not locate one I (TI S) (White Oak)
Response: We have revised the tree count.
12. Comment: There are 17 T (13) trees (London Plane Tree)
Response: The landscaping plan has been revised and we have corrected the
tree count.
13. Comment: Please refer to Albemarle County's approved plant canopy
calculations list for the 10 year coverage totals. The 10 year coverage totals
shown in the plant list do not match what is shown on the landscape schedule on
sheet C-15. Please revise.
Response: The 10 year calculation has been revised (see sheet 15 of 15).

1. Comment: The Zoning Department has determined that the plan is consistent
with the approved application plan.
Response: This is understood.
2. Comment: The site plan cannot be approved until the WPO plan is approved. The
review of the WPO plan will be provided in a separate comment letter.
Response: The second submission of WPO 2010 -00038 is being done
concurrently with this plan.
3. Comment: In order to subdivide the townhouse lots in the future, the applicant
must request a private street from the agent at the time of the final subdivision
plat application. [14 -233, 14 -234] The current subdivision ordinance requires the
private road to be constructed to VDOT standards or "an alternative standard
deemed adequate by the agent, upon recommendation of the county engineer ".
[14 -412. B] The plan does not appear to meet any VDOT standard. Through a
detailed discussion with the Chief of Current Development, it has been
determined that Avemore Pond Road will be reviewed to the travelway standards
of the Zoning Ordinance, 18 -4.12. Please make the following corrections to
satisfy engineering review with regard to the travelway /roadway within the site:
Response: A private street request will be filed concurrently with the first
submission of the Subdivision Plat (SUB) per your instructions received
during our 7/29/10 meeting. We have added the VDOT Pavement Design
worksheet to sheet 2 of 15 and adjusted the pavement section to match.
a. The applicant must build the Wilton Farm Connection Road to the
Property Line. The horizontal and vertical alignments of the connector
road must work with the already constructed roadway from Wilton Farm.

Response: Avemore Pond Road has been extended to the property line as
requested and is in compliance with our 8/6/10 electronic communication of
which a copy is enclosed.
b. Please provide anew estimate of the ADT on Avemore Pond Road under
the assumption that the connection to Wilton Farm is worked out. The
pavement section for Avemore Pond Road must be updated based on this
new ADT. [14-412.B, 18-4.12.15a]

Response: Per our 8/6/10 e-mail transmission we will keep the traffic count at
200 ADT. We have added note 7 to the cover sheet regarding traffic if the
right to ingress/ egress is granted and a pavement thickness work sheet has
been added to sheet 2 of 15 (see attached 8/6/10 e-mail transmissions).
c. Perpendicular parking spaces must have a IOft width when a travelway of
20ft is provided. [18 -4.121
Response: The parking spaces between lots 6 -7 and 28 -29 have been
adjusted.
d. All streets within the development areas require curbing, sidewalks, and
6ftplanting strips. Since the application plan was approved without
planting strips for this phase, planting strips will not be required.
However, sidewalks must be provided or a waiver of this design standard
must be approved by the Planning Commission. [14 -410. H, 14 -422, 18-
32.7. 2.8]
Response: The sidewalk has been provided to the extent agreed upon during
the 7/29/10 meeting with County staff.
e. Please provide an autoturn exhibit showing the movement of afire engine
through Avemore Pond Road. [14 -412. B, 18- 32.5.6 s]
Response: The requested autoturn exhibit has been provided for an
AASHTO SU and WB -40 vehicles as prescribed by Mr. James Barber
of the Fire Marshal's office.
f. The dedication of the access easement to the back of curb is not practical
for long term maintenance of the roadltravelway. On the Village Green
side, please extend the easement at least one foot behind the curb. On the
outer edges, please provide a "6ft sidewalk and maintenance easement"
for the 5ft sidewalk that is necessitated by comment 3.d, or move the
easement line to Ift behind the curb. [14- 412.B]
Response: An eight foot wide pedestrian and maintenance easement has been
provided in those locations where street pavement is fronted by lots and
sidewalk (8 feet from face of curb) and 1 V 2 feet from face of curb where
street pavement is fronted by open space associated with the Village Green.
This was agreed upon during the 7/29/10 meeting with County staff.
g. Please provide no parking signs along the Village Green side of Avemore
Pond. [18-32.5.6s]

Four (4) "No Parking" signs equally spaced on both sides of the Village
Greene have been provided (see sheet 7 of 15).
4. Comment: The county engineer must approve any drainage system (proposed or
existing) that exceeds open channel flow. The request has been delivered to the
county engineer. [Design Manual]
Response: The request has been approved per the attached communication
from you dated 8/4/10.
5. Comment: In the storm drain profiles, please show all of the sanitary sewer
lateral crossings.
Response: The elevation of the storm drain from storm drain structures D3.1
to D3 is substantially above the sanitary sewer from Sanitary Sewer Manhole
3 such that the sanitary sewer lateral crossing from lots 24 -28 will not
conflict with the storm drain. We therefore respectfully request approval of
this design.
6 Comment: Private storm drainage easements are needed over all pipes outside of
the road easement.
Response: Private storm drain easement has been provided for those "pipes
outside of the road easement ". The widths shown are as agreed upon during
the 7/29/10 meeting with County staff.
7. Comment: Driveways must be no steeper than 5 %. [18-4.12.15c]
Response: Driveway slopes have been added to the plan and units adjusted
accordingly to meet this requirement.
8. Comment: All slopes steeper than 3:1 must have a low maintenance, non - grassed
groundcover specified. Examples of acceptable groundcovers can be found in
Table 3.37C of the VESCH.
Response: Those areas where slopes are steeper than 3:1 have been identified
and non - grassed ground covers have been specified. See sheet 8 of 15.

Margaret Maliszewski - ARB
Comment: This townhouse development is located behind houses on Wilton farm
Road, as viewed from the Route 20 Entrance Corridor. Site sections previously
provided by the applicant show that the proposed townhouses are 40' high and
the houses on Wilton Farm Road are 32' high. Because the townhouses are to be
located behind the houses, and because the townhouses will not exceed twice the
height of the houses, this proposal qualifies for review as a county -wide
Certificate of Appropriateness. This type of review allows staff to complete the
review and approval without review at an ARB meeting. An ARB application and
submittal are still required, and approval of that application is required prior to
final site plan approval. The applicant can contact me with questions about the

Response: An application for a Certificate of Appropriateness was filed on
8/9/10. We understand that the application will be handled at the staff level
without the need for an ARB meeting.
