Reference No. 90820-1 Dear Ms. Chancellor: You have asked for a letter that provides an analysis of the zoning and other information regarding the referenced Property. This letter is based on a review of our records and inspection of the site. 1) The above referenced Property is zoned R-15, Residential Multi -family, with proffers. This property is also located in the Entrance Corridor Overlay (EC) District and is subject to the use limitations and regulations of those districts and the Albemarle County Zoning Ordinance. Multi -family apartments are permitted by right in this zoning district at a density of 15 dwelling units per acre. 2) The Property was subject to a rezoning (ZMA2000-010) from R-10 Residential to R-15 Residential, on 27+ acres, approved by the Board of Supervisors on June 20, 2001. The rezoning allowed 15 dwelling units per acre, in the aggregate, on all of the property for a total of 406 dwelling units, including the 92 dwelling units on this Property. 3) The Property is bounded by R-10 Residential to the South and West and R-15 to the North and East. 4) The Property is not subject to a Planned Unit Development. 5) The Property is the subject of a site plan, SDP200600063, which shows the development as 92 dwelling units in 1 structure on 2.936 acres and served by 119 required parking spaces, part of Phase 11 of the Avemore LLC development. Ms. Rhonda Chancellor February 10, 2016 Page 2 6) To the best of my knowledge, the Property is in compliance with all applicable zoning ordinances, rules and regulations, including parking requirements, based on the final zoning inspection(s) prior to occupancy. 7) No application for rezoning, special use permit, or variance is pending in connection with this Property. A review of our records and site inspections do not show any current zoning violations.
