Dear Ms. Baumgartner:
In response to your request for a Letter of Zoning Compliance for the above referenced
Property, please be advised of the following:
• The Property is zoned Highway Commercial (HC). (See attachment) The property is
subject to the Entrance Corridor ("EC"), the Airport Impact Area ("AIA") and Steep Slopes
Overlay Districts as described in Section 30 of Chapter 18 of the Albemarle County
Code.
• The zoning of the Property permits automobile, truck repair shops, and motor vehicle
sales, service and rental as by right uses but does not limit it to such use. While these
uses are permitted by right the outdoor storage, display and/or sales serving or
associated with a permitted use, any portion of which would be visible from the EC street
(US Route 29) requires a special use permit per the EC Overlay District.
• This Property is subject to multiple Site Development Plans, SDP00042, approved
07/24/1974; SDP1979-065, approved 04/08/1981; SDP1996-047, approved 09/12/1996;
SDP1997-133; approved 11/05/1997; and SDP1998-013, approved 01/26/1998. The
Property has been developed per the approved plans.
• Future development of the Property is subject to applicable use regulations, site plan
regulations and water protection ordinance regulations. The ability of the
owner/developer of the Property is limited only by these regulations.
• The Property is not subject to an approved rezoning, special exception, or special use
permit application, nor are there any of the noted applications pending review/action by
the County.
• The Property is subject to two variances, one for setback and one for wall sign size.
VA1986-019 was for a building setback reduction from an adjacent property that was
zoned residential, approved on 07/08/1986. A public road now separates the
residentially zoned property from this HC zoned Property. This variance is no longer
applicable since the structure now meets the appropriate setback from the public road.
VAI 992-004 is for an increase in wall signage, approved on 04/14/1992. (See
attachment)

Dear Mr. Wassenaar:
This letter is to inform you that on April 14, 1992, during the
meeting of -the Albemarle County Board of Zoning Appeals, the Board
(4:0) (Kennedy abstained) ruled to approve your request for
VA -92-04 as requested subject to the color of the sign being
approved by the Design Planner.
This variance approval allows relief from Section 30.6.5.2(c) to
increase the area of wall signs from 35 to 92 square feet.
