In response to your request for a Letter of Zoning Compliance for the above referenced Property, please be advised of the following: • The Property is zoned Highway Commercial (HC). (See attachment) The property is subject to the Entrance Corridor ("EC"), the Airport Impact Area ("AIA") and Steep Slopes Overlay Districts as described in Section 30 of Chapter 18 of the Albemarle County Code. • The zoning of the Property permits automobile, truck repair shops, and motor vehicle sales, service and rental as by right uses but does not limit it to such use. While these uses are permitted by right the outdoor storage, display and/or sales serving or associated with a permitted use, any portion of which would be visible from the EC street (US Route 29) requires a special use permit per the EC Overlay District. This Property is subject to multiple Site Development Plans, SDP00042, approved 0712411974; SDP1979-065, approved 04/0811981; SDP1996-047, approved 09112/1996; SDP1997-133; approved 11105/1997; and SDP1998-013, approved 01126/1998. The Property has been developed per the approved plans. • Future development of the Property is subject to applicable use regulations, site plan regulations and water protection ordinance regulations. The ability of the owner/developer of the Property is limited only by these regulations. The Property is not subject to an approved rezoning, special exception, special use permit or variance application, nor are there any of the noted applications pending review/action by the County.
