Moretz 104 North Dilling Street Kings Mountain, NC 28086 November 18, 2005 Re: SDP 05 -053 Speedee Oil Change Preliminary Site Plan Dear Mr. Moretz: The Department of Community Development hereby grants administrative approval of the above - referenced site plan. In accordance with Zoning Ordinance Section 32.4.3.1, approval of the preliminary site plan is valid for one 1) year. Therefore, this approval shall expire November 18, 2005. If the preliminary site plan approval expires before all final tentative approvals have been granted, a new application must be filed and processed. Please address all of the requirements and conditions listed below and submit eight (8) copies of the tentative plan to the Department of Community Development Division with the attached sheet entitled Revised Application Submittal. This letter must also be submitted with the tentative plans, as a checklist, to document that you have addressed all requirements and conditions, or the tentative plan will be denied. The Erosion and Sediment Control Plan and the BMP Stormwater Management Plan, with the associated applications and fees, may also be submitted with the eight (8) tentative plan copies. Failure to do so will result in a separate application to be filed at a later date. After the initial tentative plan submittal, each department /agency will contact you to discuss any remaining conditions. After all aforementioned departments /agencies have granted tentative approval, you may submit the final mylars (2 sets), one blueprint or paper copy, the final site plan application along with the final site plan fee 410), and a copy of all written tentative approvals to the Department of Community Development by 5:00 p.m. on any week day. Assuming that the site plan mylars reflect the required conditions of all final tentative approvals, signing of the plans will occur within one week. The final site plan will be subject to all final site plan requirements (Zoning Ordinance Section 32.6), in addition to the following conditions. The Planning Department shall not accept submittal of the final site plan for signature until tentative approvals for the following conditions have been obtained. Speedee Oil Change November 18, 2005 Page 2 The final site plan shall not be signed until the following conditions are met: A. Current Development planning review approval to include: 1. [32.5.6(b)] Provide a revised parking schedule with the information provided in the letter from Jan Sprinkle, entitled "Official Determination of Parking for The Gardens Shopping Center ", and dated November 14, 2005. Please also include a note that references this letter on the site plan. Q' 2. [32.6 66)] Each type of outdoor luminaire that emits 3,000 or more initial lumens shall be installed in accordance with the full cut -off in accordance with Section 4.17.4. 3. [32.7.9] Approval of a final landscape plan depicting the species types, number and location of all proposed planting materials. [32.7.9.7(b)] Interior landscaping equal to five (5) percent of the paved parking and circulation area shall be provided. Please note that this shall be a calculation of the total ground area dedicated to those interior plantings as opposed to the sum of the canopy to be provided by those items at ten (10) years maturity. V 4. [32. 7.9.4(b)] A tree conservation plan checklist must be completed and incorporated into the site plan with notes to show how any individual trees and /or groups of trees designated to remain are to be protected during the construction of this project. The locations of any tree protection fencing that coinciding with the limits of clearing and other methods of protection from the checklist must be shown on the plan for clear identification during field inspections. V 5. Architectural Review Board approval and issuance of a Certificate of Appropriateness. B. Current Development engineering approval to include: 1. Submittal of a tentative final site plan that complies with all applicable items as specified in the Design Standards Manual, section 902. 2. Submittal and approval of the erosion and sediment control, and stormwater management plans with the related fees. C. Albemarle County Service Authority approval to include: 1. Revised construction plans for all improvements to onsite and offsite water and sewer utilities shall be submitted directly to the Service Authority for review and approval. D. Th ivision of Fire and Rescue approval to include: 1. Approval based upon memo dated August 03, 2005 and is subject to field inspection and verification.
