The engineering review for current development recommends approval of the plans as submitted. A. Site plan comments: 1. All minimum checklist items appear adequately addressed. B. Stormwater management plan comments: 2. A Stormwater Management Plan Contribution ($4200.00) must be paid for work on the Rio Basin. This satisfies the water quality requirement for this site. The detention requirements have been determined to be exempt, as the disturbed area is just below 1 acre. [ 17 -203, 17 -303, 17 -304, 18- 32.7.4] (Reminder: $4200.00 contribution will be paid at time of Water Protection bonding) C. Erosion and sediment control plan comments: 3. A narrative has been generated for this site in accordance with VESCH and attached to the E &SC plan sheets. 4. The temporary construction entrance has been lengthened in accordance with Albemarle County Design Standards Manual. 5. The E &SC portion of the Water Protection bond is $8,000.00 and will be the whole Water Protection Bond amount. Items B and C need to be completed before a grading permit can be issued for this project. The engineering review for current development cannot recommend approval of the plans until the following items have been adequately addressed. A. Site plan comments: 1. Plan does not appear to have proposed grade lines. Please clarify this issue on next submittal. Although the site is almost level, several areas appear to pond water and proposed contours may correct this concern. 2. Temporary off -site construction easements will be required from adjacent property owners for all work proposed outside property lines. 3. Please add the "General Construction Notes for Site Plans" verbatim as found in DSM CD -10, chapter 9 section 910. 4. Plan appears to require a loading space. A variance request may be submitted to Mr. Jack Kelsey for alterations to the temporary paved construction entrance design, otherwise a minimum 70' long by 12' wide entrance will be shown adjacent to or part of the existing pavement area. Currently the plan shows the temporary construction entrance 25' in length. Items B and C need to be completed before a grading permit can be issued for this project. Comment #3 - The "General Construction Notes for Site Plans" found in Chapter 9 of the Albemarle County Design Standards Manual Section CD -10 is a requirement imposed by the County Design Manual and required on all Site development plans in Albemarle County. The first item in the list is the only one that refers to work in VDOT right of Way, which does not apply to the site as you've noticed. However, the rest of the items in CD -10 are relevant to all site developments in Albemarle County. The entire boilerplate is required on all site development plans. For additional clarification as to the County Design Manual requirements. please contact the Chief of Engineering. (Mr. Jack Kelsey). Comment #4 — Section 18 - 18 of the current codebook is for Residential. R -15 developments. Section 18 - 4 is for General Regulations and is the area of the codebook I've referred. I've attached a resubmittal form for your use. 1. Water Protection fees and applications are required prior to review. Stormwater Maintenance Agreements are required after approval. The $4200.00 amount for Contribution to the Rio Basin will be paid after the approval of the plan and prior to receiving a grading permit from the County. This is the final site plan. The preliminary was approved with conditions that affect each of you. Those conditions are: C. Albemarle County Service Authority approval to include: 1. Revised construction plans for all improvements to onsite and offsite water and sewer utilities shall be submitted directly to the Service Authority for review and approval. D. The Division of Fire and Rescue approval to include: 1. Approval based upon memo dated August 03, 2005 and is subject to field inspection and verification. I believe the engineer for this project, Mr. Moretz, has sent you plans for approval. If you have not received any information please let me know so that the information can be provided to you. However, I have read all of the other emails about this so I think you may have been referring to the lighting plan. Yes, I do have the lighting plan and it notes the light is full cut -off. The lighting plan is not labeled as one of the sheets of the site plan so I recommended the solution of adding the note to the site plan sheet that has the light fixture. Alternatively, you could add the lighting plan as a page of the site plan. This would require renumbering all of the sheets because one more sheet would be in the site plan. I was recommending what I thought would be the easiest fix. Either way will work. As for the grading easement issue. I have reviewed all of the easement documents we have on file (and we have many). They discuss various easements for utilities, parking, travelways and the like. None of them discuss construction or grading easements except for the construction of utilities. Further, all of the documents refer to stormwater facilities as being underground utilities, so we cannot in good conscience call curbing part of the underground utility system. The documents do mention restoration and repair of various features. It requires whoever damages a feature to repair the feature. It is not authorization to do work, rather it is simply a requirement that if damage occurs it be fixed. It has not been stated as such, but upon reading the documents it may be appropriate to determine that the work is authorized under the access easement provisions. You have stated that you believe the documents do give you the right to do the work shown on the plan. We are accepting your interpretation. Please be aware that no action of the County in any way impacts the rights of the adjacent property owners. The action by the County does not constitute the granting of an easement by the County to do any work on any property. William D. Neither he nor I can determine what may have happened to the plan meant for the Service Authority. As of this date I have received comments from the ARB and the Building Official. The Building Official has approved the plan. By separate email I will send the most recent comments from the ARB. The Engineer and I are coordinating our comments so that we can send them to you next week. I have not heard any response from the Fire Official, James Barber. I cannot respond for anyone on their timeline for review. other than to say I anticipate getting you my comments and the comments of the engineer no later than next week. William D. The changes included on this drawing meet the final outstanding conditions of ARB approval. You may consider this letter your Certificate of Appropriateness. This approval is predicated on the fact that the design and materials, as proposed and exhibited for review, will be used. The acceptance of approval implies that the applicant has agreed to execute the design as indicated on the site plan, attachments, materials, samples, and other submittal items presented. Any change in the approved design or materials will require an amendment to the plan and must be reviewed and approved by the Architectural Review Board. This Certificate of Appropriateness does not include approval for any window signs. If window signs are proposed, review by the ARB is required.
