It is good to hear from you.
I have reviewed/approved the engineered plan for the von Elten project and the required modifications to the
existing septic system should be happening pretty soon. One thing that I wanted to make you aware of is that,
per the engineers report, there will be -no food preparation at this facility. This was one of the conditions set
forth by the PE who submitted the plan and one that was recorded in the clerk's office. I will forward you a
copy of our approval letter once scanned for your records.
If they are going to be having food preparation at the facility, then the von Elten's would need to obtain
approval from the designing PE concerning the additional requirements from a wastewater point of view.
Given my knowledge of the property and the great length that the PE has gone to get to the point we're at now, I
don't think that this is a possibility.
As far as the water supply goes, the property in question is served by an existing well. I am unaware of the
daycare requirements for a water source and will consult with the EHS that handles most of our daycare
inspections here in the County. I hope to get you an email back regarding the well in a day or so.

It has been a while since we touched base about this project. The von Elten's have resubmitted a zoning clearance (CLE
2010-118) for 2320 Hunter's Way for "Children Come First Childcare Center," Did they finally obtain health department
approval for well/septic. Also, do they need separate approval for food service?

I hope that you guys are doing well. Just wanted to get you guys a quick note to let you know that I am still
working on a solution to the septic situation at Hunters Way after our site visit on September 28. I made a call
and spoke to a PE (Professional Engineer) and asked his opinion as to what he would do as a PE. That
conversation went well and he clued me in on a couple of possibilities that I am taking into account. I am also
still researching the property to see if I can fmd any old records that can be of assistance. I hope to have you
guys something more concrete by Thursday as to what you would be looking at doing next. I have blocked off
my afternoon on Wednesday to do some more research and to go back out there if need be. I will be in touch
and will get you an email on Thursday. I will also call because I know that Chris is off on Thursdays, so he'll
have time to talk about everything.

Good morning. I hope that you had a good vacation. Listen, I am still in the process of working with the von
Elten's and the property owner to make this work. I met them on the site but the property owner (Pat Kearns)
hadn't uncovered the septic tank and distribution box so there wasn't a whole lot to see. I told them to have it
uncovered and to give me a call back when it was done so that I can check the status of their septic system. I
hope that after inspecting these components that I can come up with a plan as far as what they need to do to be
in compliance with the Health Department. At this point, they look like they are going to have to expand the
septic system but I am going to wait until they have the tank and box are uncovered to make that determination
official.
While I was on the site, I spoke to both Chris and Kellie about the total size of the daycare and what they
wanted to do. The email below is from the von Eiten's and it summarizes what they would like to do. Moving
forward, these numbers will be used for any drainfield design. I have included it in case you needed numbers
for anything that you are working on.
I am sorry this is taking so long but situations like this are really never that easy. I guess at this point I can't
give you an official determination other than I am working with all of the parties involved to see what the
options are. I will keep you posted with anything that goes on so that you are kept in the loop.

27 children, 7 employees. There are 8 parking spaces below for employees, there are 6 above for visitors. There is a
handicapped space in each of the upper and lower spaces. There will be at least 2 drop off spaces above and 2 below.
Kellie is working with licensing.
Septic modifications are underway. There is a pretreatment unit being installed by Acres of Virginia which has been
approved and wil be signed off on by Josh at the Health Department.
We will not be preparing food. We will be providing pre-preparded and prepackaged snacks for the children.

I have received your revised zoning clearance application (CLE 2010-118). There are a few items I need to complete the
review of the clearance:
How many children do you expect to have? Last time we spoke you had said 50.
Parking is based on 1 space per 10 children in the major class/shift, plus one space per employee, and a pick up/drop off
area provided.
Approval from Social Services will need to be provided before the zoning clearance can be approved.
Approval from the Health Department for well/septic and also food service will also need to be provided. I have e-mailed
the Health Department to request their approvals directly.

Dear Chris & Kellie:
Based on your description of the ages of children that you would like to save in a day care
center (infant to 5 yrs.), the building code assigns a Group designation of 1-4 (day care for more
than five children under the age of 2-1/2 years) to the building. The referenced building is
currently classified as Group B (business offices). Due to this "I°' designation, I cannot use the
scaring mechanism, that I described yesterday, for evaluating the appropriateness of using it for a
day care facility. I must refer to the current fire -safety building code requirements.
In this instance, three improvements must be made to the building in order for it to be acceptable
for the day care use understood above.
+ The building must be fully equipped with an automatic sprinkler system, conforming to
NFPA 13.
• Manual fire alarm pull stations must be installed adjacent to the exit doors leading to the
exterior. This alarm system must be supervised at all times by an approved alarm
monitoring company.
• The stairway, connecting the first and second floors, must be fully enclosed with walls of
1 -hour firerated construction. I -hour firerated doors, with automatic closers and latches
must be installed at the top and bottom of these enclosed stairs.
The code includes an exception to the I-4 designation for infant day care. if all of the children
under the age of 2-1/2 years can be accommodated in a downstairs room that has a door leading
directly to the exterior, the designation can be changed to E (educational).
Earlier this year, on January 29, 2010, an evaluation of the referenced stricture was performed to
determine its suitability for use as a school (Group E). Gturently the building is classified as
Group B (business). The Construction Type is V -B.
This evaluation was performed in accordance with Chapter 34 of the 2005 International Building
Code. A Chapter 34 evaluation scores a building's safety attributes in three categories: Fire
Safety, Means of Egress and General Safety. A score of less than zero, in any category, indicates
that the building, as is, is unacceptable for the proposed use.
The results of the evaluation were:
Fire Safety -11
Means of Egress -14
General Safety -14
The building, as is, is not approved for use as a school.
If one alteration is made to the existing structure, the resulting scones will fall within the
acceptable limits, and the structure will be useable as a school (Group E).
The alteration is:
• Enclose the stairway, connecting the first and second floors, with wails of 1 hour
firerated construction. 1 -hour firerated doors, with automatic closers and latches must be
installed at the top and bottom of these enclosed stairs.
The information herein is intended to reflect the concerns of the Virginia Uniform Statewide
Building Code. Please retrain in contact with the Zoning Administrator to verify compliance
with the Albemarle County Zoning Ordinance.
