The approval of the preliminary site plan is valid for (1) one year in accordance with Section 32.4.3.1 of Chapter 18 of the Albemarle County Code. Therefore, the preliminary approval shall expire on 08/29/2007. If the preliminary site plan approval expires, a new application must be filed and processed. Please address all of the requirements and conditions listed below and submit eight (8) tentative plan copies to the Department of Community Development. This letter must be submitted with the tentative plans, as a checklist, to document that you have addressed all requirements or conditions, or the tentative plan will be denied. Erosion and Sediment Control, BMP Stonnwater Management, and road plans with the associated applications and fees must also be submitted with the eight (8) tentative Plans. Once the tentative plan is submitted and reviewed you will receive comments from all departments /divisions /agencies that have made comment on the tentative plan. Any further responses must be made directly to each department /division/agency that has further comment. After all aforementioned departments /divisions /agencies have granted a tentative approval, you must verify with the Planner that you may submit the final mylars (2 sets), two paper copies, the final site plan application, and final site plan fee to the Department of Community Development. Signing of the plans will occur within one week once it is determined that the final site plan mylars reflect all tentative approvals. The final site plan will be subject to all final site plan requirements (Zoning Ordinance Section 32.6), in addition to the following conditions. The Department of Community Development shall not accept submittal of the final site plan for signature until tentative approvals for the following conditions have been obtained: Zoning & Current Development approval to include: COMMENT: The conservation checklist shown on sheet 4 of 10 does not provide the required signatures. Please provide a signed conservation plan checklist for the site plan. 4.12.13(c)] COMMENT: The loading space calculation should not be included in the required parking calculation for this site. [32.5.6(b)] Provide the percentage of open space, not just the acreage. 2. [32.5.6(i)] Label on the plan all 'existing and proposed streets, access easements and travelways, together with street names, state route numbers, right of way lines and widths, centerline radii, and pavement widths.' 3. [32.5.6(m)] Provide the location of existing and proposed ingress to and egress from the property, showing the distance to the centerline of the dearest existing street intersection. 4. It is difficult to distinguish the existing and adjacent landscaping from the proposed landscaping. For the existing landscaping, as well as the landscaping located on the adjacent property, either label all of the existing shrubs and trees as existing, or change the symbols used for the trees to all be the same (type, lineweight, etc). Also, screen back the existing and adjacent shrubs and trees to further distinguish existing from proposed. 8. [32.7.9.5(a)] 'Shrubs for screening shall be a minimum of eighteen (18) inches to thirty (30) inches in height when planted.' The Otto Luykens that are located near the dumpster area need to be 18 " -30" if providing screening for the dumpster area. 9. [32.7.9.9] Provide calculations for tree canopy on the landscape plan. 'Ten (10) percent tree canopy for a site to be developed with commercial, office or industrial uses.' 10. [4.17] Remove any lighting fixtures from the plan that are not within the Topeka's Steakhouse property, as well as any information pertaining to those light fixtures. 11. The Board unanimously approved the Certificate of Appropriateness for ARB - 2006 -132. Topeka's Steakhouse, pending staff administrative approval of the following conditions: 1. Revise the exterior finish schedule to indicate a single metal roofing manufacturer and color that matches the Hilton roof(Sentriclad musket gray Kvnar). Provide a darker color substitute for the "foxy' shade to better match the darker tones of the brick. Clarify the Sto color number on the drawings; provide a single STO color number. Indicate on the elevation drawings (Sheets A2 and A3 in the Exterior Finish Schedule) that all windows will be true vision windows with clear glass. 2. Substitute the illustrated dumpster door on the rear (east) elevation with a flush, hollow core metal door to match the other door on the east side. The tree protection fencing shown on the landscape plan falls within the drip line of several trees to remain along the EC. Proposed grading falls within the drip line oftrees at the southeast corner of the site. Please move the fence and the proposed grading out of the drip lines. Rectify the grading conflicts with the limits of clearing line at the northwest corner of the site. Correct the location of the limits of clearing line where it moves outside the tree protection fence line near the middle of the northern side of the site. Utility lines are proposed in the area southwest of the building. Please show these utilities on the landscape plan and coordinate them with the proposed plants. Clearly indicate the height and the color of the light poles and fixtures in the luminaire schedule. Put all cut sheets on the plan. Indicate wall light locations on the photometric plan. Include wall light levels in the photometric calculations. If no wall lights are proposed, indicate this in your response memo. A condition of .ARB approval was that the wall sign on the east elevation or the north elevation would he deleted from the proposal. The applicant agreed to this condition at the meeting. Please make the corresponding change on the elevations.
