Dear Mr. Sanders:
The Albemarle County Board of Supervisors, at its meeting on May 15, 2002, approved the above -noted
request. Please note that this approval is subject to the following conditions:
1. All requirements of the Architectural Review Board shall be met, including the site plan indicating the
existing tree line and specific trees of six (6) inches or greater and retaining significant trees.
2 The church's improvements and the scale and location of the improvements shall be developed in
substantial compliance with the master plan entitled Albemarle Baptist Church, prepared by Dex A.
Sanders, and dated 11/28/01.
3. The area of assembly shall be limited to a maximum four - hundred - thirty -five (435) -seat sanctuary.
4. Health Department approval of well and septic systems prior to final site plan approval.
5. Commercial setback standards, as set forth in Chapter 18, § 21.7.2 of the Albemarle County Zoning
Ordinance, shall be maintained adjacent to residential uses or residentially zoned properties.
6 Any number of parking spaces in excess of the required minimum shall not be paved.
7. There shall be no day care center or private school on -site without approval of a separate special use
permit.
8. Construction of Phase 1 [six- thousand (6,800) sq. ft. sanctuary] shall commence within forty -eight
48) months or this special use permit shall expire.
9. All requirements of VDOT shall be met prior to final site plan approval, including approval of one
entrance from Roselyn Ridge Road, with a one - hundred (100) -foot right -turn lane and one - hundred
100) -foot taper lane.
In the event that the use, structure or activity for which this special use permit is issued shall not be
commenced within twenty -four (24) months after the issuance of such permit, the same shall be deemed
abandoned and the authority granted thereunder shall thereupon terminate. For purposes of this section,
the term "commenced" shall be construed to include the commencement of construction of any structure
necessary to the use of such permit within two (2) years from the date of the issuance

Dear Sirs:
The purpose of this letter is twofold: 1) to provide an official determination regarding the
validation of this special use permit and 2) to provide notice of the zoning violation relating to
tree removal. With regards to item #2, this letter also includes notice that a certificate of
occupancy for the new construction will be withheld until the violation has been abated.
1) Special Use Permit
The Albemarle Baptist Church received approval of SP- 2001 -047 on May 15, 2002. A condition
of that permit states:

On January 3, 2005 a building permit application was made for construction of the sanctuary. It
was reviewed and approved for issuance by a zoning reviewer on January 28, 2005. However,
other departments and agencies did not sign off on the building permit application until as late as
May and July of 2006. When a preliminary zoning was scheduled in October 2006, it was
discovered that the special use permit had expired and therefore, the building permit could not be
issued. In the ensuing discussions between the church's representatives and the County, it
became known that the well may have been constructed during the time the special use permit
was valid.

The following is a relevant excerpt from the Albemarle County Zoning Ordinance, Section 31.
31.2.4.4 REVOCATION
Any special use permit issued pursuant to this chapter may be revoked by the board of supervisors, after
notice and hearing pursuant to Virginia Code § 15.2 -2204, for willful noncompliance with this chapter or
any conditions imposed under the authority of section 31.2.4.3. If the use, structure or activity for which a
special use permit is issued is not commenced within twenty-four (24) months after the permit is issued,
the permit shall be deemed abandoned and the authority granted thereunder shall thereupon terminate. For
purposes of this section, if the use authorized by the permit requires the construction of one or more
structures, the term "commenced" means starting the lawful physical construction of any structure
necessary to the use authorized by the permit within twenty-four (24) months after the permit is issued.
The board of supervisors may, as a condition of approval, impose an alternative period in which to
commence the use, structure or activity as may be reasonable in a particular case. A determination that a
permittee has commenced a use, structure or activity under this section is not a determination that the
permittee has acquired a vested right under Virginia Code § 15.2 -2307. (Amended 10 -3 -01)
This section states specifically that starting the lawful physical construction of any structure
necessary to the use qualifies as "commencing construction." A well is a structure. A well sized
and designed to serve a church is specifically necessary for this use. It therefore carries the force
of vesting the special use permit. The Board of Supervisors' approval granted this church 48
months to commence construction rather than the 24 months quoted in this section, thereby
giving them until May 15, 2006.
A copy of the well completion report was presented to this office stating that a well was
constructed for the church and completed on August 23, 2002. This construction of a well meets
the zoning ordinance test which requires the "lawful physical construction of any structure
necessary to the use" within the four years granted under SP 2001 -047. With this knowledge, the
special use permit remains valid and did not expire. The County Attorney's office has been
consulted and agrees with this determination. (While the vesting analysis is used, it is not
legally a "vesting" under Virginia Code § 15.2- 2307.)
2) Zoning Violation
Although the SP has now been determined to be valid, during the Preliminary Zoning inspection
related to building permit 2005- 028NI, it was discovered that the site is technically in violation
of the conditions of SP 2001 -047, SDP 2004 -030 and the Architectural Review Board's
requirements regarding tree retention and the limits of clearing on the parcel. The issues are tree
protection and the limits of clearing including fencing. The following are the first two
conditions of the SP:
1. All requirements of the Architectural Review Board shail be met, including the site plan indicating the
exrsting tree tine and specific trees of six (8) inches or greater and retainina significant trees.

The site plan shows tree protective fencing around the entire limits of clearing and "tree armor"

around individual trees. Neither the fencing nor the armor was installed or erected prior to
clearing. The limits of clearing were expanded beyond the approved plan and several trees
intended to be protected were removed. The County has issued the building permit for this
church, however, no certificate of occupancy will be issued unless and until all of the
following are amended and any new conditions are met: the special use permit (SP2001-
047), the site plan (SDP - 2004 -030) and the Architectural Review Board's certificates of
appropriateness (ARB- 2003 -183 and 2004 -019). In conclusion, Albemarle Baptist Church
may not legally occupy the new structure until and unless the site is in compliance with
conditions of the special use permit, site plan and ARB approval. Please begin this
amendment approval process as soon as possible because it is a somewhat lengthy process.
If you are aggrieved by this determination, you have a right to appeal it within thirty (30) days of
the date notice of this determination is given, in accordance with Section 15.2 -2311 of the Code
of Virginia. If you do not file a timely appeal, this determination shall be final and unappealable.
An appeal shall be taken only by filing with the Zoning Administrator and the Board of Zoning
Appeals a notice of appeal which specifies the grounds for the appeal. An appeal application
must be completed and filed along with the fee of $120. The date notice of this determination
was given is the same as the date of this letter.

Dear Mr. Sanders:
I have reviewed your recent submittal for the above referenced project consisting of the following sheets:
Sheet 00.0 1, latest revision date 11-29-06

The purpose of this amendment is to address the fact that certain trees designated in the approved site plan
as being preserved, were, in fact, removed during the site grading process. I met with you on March 21,
2007 to discuss how the site plan would have to be amended to address this situation. As a follow up, I
would like to outline what was agreed would mitigate the impacts created by that tree removal. Required
revisions to the landscape plan are shown in italics after each tree removal violation. Also, the limits of
grading and clearing shown on the landscape plan will need to be revised, as per our phone conversation of
March 28, 2007, to reflect the existing and approved limits.
1. As indicated on Sheet 1-1.01, two 12" Oaks and one 13" Poplar, located approximately 70'
southeast of the proposed phase 1 sanctuary and designated on the approved site plan as
remaining, were in fact removed.
Revise the landscape Plan to show three proposed Willow or Pin Oak trees, 3'/ " caliper
mininnun, planted 20' on center in the scene general location.
As indicated on Sheet L1.01, one 15 ", 14 ", 13 ", 11", two 10" Oaks, and one 12" Cedar, adjacent
to the southeast end of the phase 2 sanctuary and designated on the approved site plan as
remaining, were in fact removed.
Revise the landscape plan to show fbur proposed Willow or Pin Oak trees, 2 % "caliper mininu nt,
planted 20' on center in the area adjacent to the southeast end of the phase 2 sanctuary.
As indicated on Sheet L1.01, one 20" Oak, 11" Poplar, and 12" Cedar, located approximately 70'
west of the main entrance to the phase 2 sanctuary and designated on the approved site plan as
remaining, were in fact removed.

information will facilitate the review of your submittal.
3. The attached "Revised Application Submittal" form. This form must be returned with your revisions to ensure
proper tracking and distribution.
When staffs review of this information indicates that all conditions of approval have been met, a Certificate of

Due to schedule, the contractor is going to proceed with the wall per the sketch we sent. We will submit a revised plan

Brent,
We have recently re -filed Sheet L1.01 reflecting revised landscaping.
Yesterday, at the on -site meeting, we discovered a need to change the (3) retaining walls shown on the site plan of record
to (1) wall that is not as tall or long as the (3) original walls.
I have attached an 8.5x11 sketch showing the proposed (1) new wall location and elevations. No change is proposed in
material or color. No change is proposed in the landscaping.
The maximum elevation of the approved wall was 79.57. The new wall maximum elevation is 77.0
The maximum length of the approved wall was 56 feet. The proposed wall is 38 feet long with an average elevation of
74.33
For reference, the height of the earthen berm required by the ARB to screen the lower basement mass of the building
from the EC remains at 76.0.
Please let me know if we can include this change with the current minor amendment. Project completion is scheduled for
September.

Concern: noncompliance with two conditions of the special use permit approval (see
attached Jan Sprinkle's letter of November, 2006). By this letter, Jan determined that
this site is in violation of these two SUP conditions. They did not appeal. It is our
opinion that we cannot administratively allow them to amend the site plan and have
them still comply with these two conditions of SUP. (Greg see the pdf with all
conditions of the SP).
We informed them over 6 months ago that they need to amend the SP, amend the site
plan and amend the ARB approval. They have not yet submitted an amendment to the
SP. I've left multiple messages for Dex Sanders to inform him that Monday is a
deadline for SP submittals and they need to submit to get this handled asap.
Greg — I need to know asap if you are going to take a different position on this. I think
it's pretty clear and we've been very clear with the applicant since last week at least.

Dear Sirs:
This letter serves to revise and reverse the official determination letter from Jan
Sprinkle dated November 29, 2006 with regards to compliance with the above -
referenced special use permit. With her letter, Ms. Sprinkle found that clearing and tree
removal beyond the approved limits necessitate an amendment to the first two
conditions of SP 2001 -047 Albemarle Baptist Church. By her letter, Ms. Sprinkle
informed you that this special use permit amendment was required prior to our issuance
of your certificate of occupancy for the new building.
In formulating this revised determination, the County Attorney and I reviewed the file
which includes the conditions of approval, the staff report and the plan referred to in the
conditions. The wording of the special use permit conditions does not clearly require
compliance with a specific limit of clearing. The referenced plan with the special use
permit also does not provide clear limits of clearing and tree preservation. We also did
not find discussion within either the special use permit or the ARB staff report about
these items. With that said, we recognize that there was an intention to preserve some
larger trees. We understand that remediation for the removal of those trees has been
part of the ARB revised plan review.
Therefore, it is my conclusion that once the revised site plan has been approved by the
ARB and Current Development, the site can be in compliance with the first two (subject)
conditions of special use permit approval. You will note that I say "can" because any

plantings or other non - safety improvements which are not yet complete will need to be
bonded. Please be advised that the revised plan must be approved and the site must

issuance of a certificate of occupancy. Please remember to call for final zoning
inspections no later than two (2) weeks prior to your desired date for occupancy.
This is to give sufficient time for our inspection and bond calculation and your posting of
any necessary bonds.
If you are aggrieved by this determination, you have a right to appeal it within thirty (30)
days of the date notice of this determination is given, in accordance with Section 15.2-
2311 of the Code of Virginia. If you do not file a timely appeal, this determination shall
be final and unappealable. An appeal shall be taken only by filing with the Zoning
Administrator and the Board of Zoning Appeals a notice of appeal which specifies the
grounds for the appeal. An appeal application must be completed and filed along with
the fee of $120. The date notice of this determination was given is the same as the
date of this letter.

Dear Mr. Sanders:
Beth Robinson, of Hightech Signs, has submitted a revised sign design that has been approved. The
revised design, however, necessitates a revision to my previous Action Letter of September 19, 2007
concerning the landscaping. In that letter, I requested that the Liriope (ground cover), previously shown
on each side of the sign, be replaced with a low evergreen shrub. Beth's new sign panel however is
lower to the ground; therefore, the requested shrubbery would block views of the sign text. I have
directed Mark Harris to have you revise the site plan amendment to show what ever ground cover
liriope, grass, etc) would fit that situation. Please coordinate with Mark Harris and resubmit
accordingly. As per my previous Action Letter of September 19, 2007, the sign wall will need to be
removed from the site plan amendment.

Dear Mr. Sanders:
I have reviewed your recent submittal for the above - referenced project consisting of the following:
Sheet L1.01, Landscaping Plan — Phase 1, latest revision date 9/14/07, received 9/26/07.
The revisions included in this submission address all outstanding conditions of approval. An ARB
Certificate of Appropriateness, previously issued on August 2, 2007 for the Minor Amendment, will
remain in effect. Proposed changes in the above referenced drawing involve substitutions to approved
trees species, and the location of the monument sign. These changes do not represent a substantial change
to that Minor Amendment and meet all the guidelines observed in the original approval. As a result, the
Certificate of Appropriateness, issued on August 2, 2007, will remain in effect.
This approval is predicated on the fact that the design and materials, as proposed and exhibited for
review, will be used. The acceptance of approval implies that the applicant has agreed to execute the
design as indicated on the site plan, attachments, materials, samples, and other submittal items presented.
Any change in the approved design or materials will require an amendment to the plan and must be
resubmitted, reviewed and approved.
