Engineering reviewed the subject preliminary site plan. We do not recommend approval, but request the
following changes to bring the plan into compliance with County Code:
1. More information is required for stormwater management (18- 32.5.61, 17 -303, 17 -315, DSM503):
a. Please provide a BMP computation worksheet;
b. Please label the BMP type and ensure it is adequately sized. (if the removal rate is >50 %, the BMP
shown on the plan is not large enough and additional measures will be required);
c. The BMP must outlet to an adequate channel. Please provide information on the downstream system
i.e. conveyance channels; their cross section and linings, culvert under railroad track it's dimensions
and condition, etc. It appears from the provided topography an offsite drainage easement and channel
construction will be required. Please provide a letter of intent or deed of easement from the owner of
the neighboring parcel and show the necessary easement and improvements on the plan.
2. More information is required regarding the existing unnamed private road being used for access to the site:
a. Please show on the plan view drawing; the edge of pavement, horizontal curve data, center line,
drainage, neighboring parcel boundaries, necessary easements, site distances and intersection with
route 250;
b. Please provide a typical cross section and pavement type;
c. Please provide a profile including K values;
d. Please include any improvements needed to bring the road up to current standards (18- 32.7.3).
e. Please provide the road name or route number.
3. Please show the storage yard on the south east corner of the parcel.
4. The retaining wall along the south parking lot will not allow adequate over -hang for 16' parking isles. Please
provide 18' parking isles or move retaining wall to allow a minimum 4' of overhang beyond back of curb.
5. Please provide curve radii for edge of pavement and centerline of internal travel ways and parking lot.
6. Please show existing access road across the north end of the parcel. The road must be retained or replaced
and an access easement provided.
7. The plan proposes grading and development in areas of critical slope. Please re- design the plan to avoid
impacting critical slopes or file a written request for waiver of sections 18 -42 of the County Code (18- 4.2.5).

The request for a waiver to develop on areas of critical slope for grading incorporated with the new
construction proposed on TMP 59 -23G was received on 12 April 2007. They are shown on the final site
plan, rev. date 23 March 2007.
The engineering analysis of the request follows:
Description of critical slope area and proposed disturbance:
The critical slope area, within TMP 59 -23G, appears to be both natural slopes and man -made slopes. The
critical slope disturbances are in the form of site plan construction; travelways, parking spaces, drainfield,
and stormwater management facilities.

Below, each of the concerns of Zoning Ordinance section 18 -4.2 is addressed:

This site does drain into a waterway that is a public drinking water supply for Albemarle County. No
portion of this site plan is located inside the 100 -year flood plain area according to FEMA Maps, dated 04
February 2005.
Based on the above review, there are no engineering concerns which prohibit the disturbance of the critical
slopes as shown on the plans.

The applicant has requested a waiver for the new construction proposed on TMP 59 -23G. The waiver
request was received on 28 March 2007. It is being reviewed in conjunction with the final site plan, rev.
date 23 March 2007.
The engineering analysis of the requests is as follows:
Waiver of the requirement for curb and gutter:
The applicant has requested a waiver for the construction of curb and gutter for the travelway access to this
site as required per County Code Section 18.4.12.158.
The proposed access to this site is from an existing 30' wide easement from State Route 250. This
easement contains a paved travelway that was built before the County Code required curb and gutter street
design so it does not have a curb and gutter section. The applicant is requesting that this portion of the
access to the site not be required to have curb and gutter.
The applicant is showing CG -6 curbing for the proposed travelways and parking spaces shown within
TMP 59 -23G.
In accordance with County Code section 18- 4.12.15g, the County Engineer may waive or modify this
requirement if deemed necessary to accommodate SWM /BMP facility design or the existing use is located
in the Rural Areas (RA) zoning district.
The site plan is located entirely within a development area. The use of curb and gutter would assist with
the containment of the travelway drainage and direct the flow more efficiently to the proposed SWM
facility. The relief of this requirement would not accommodate the proposed SWM /BMP facility.
Engineering does not recommend approval to this waiver request.

the northwest corner of the property to catch runoff. The shown diversion dikes cannot be installed

Subject: Korean Community Church requested waiver of the curb and gutter requirement for the
access drive serving their property

This site differs from that of other sites which have sought a waiver of curb and gutter requirements in
several important respects. Most importantly the road has been in place for many years and, notably,
is in very good shape with proven adequacy. Another major difference is the fact that there is no
heavy truck traffic and no identified safety issues. Additionally, installation of curb and gutter within
the access easement would block the supplemental parking each of the adjacent properties has installed
for their uses.
Comments relative to the staff report:
Sec. 33.3.10: w'
a. The commission may modify, waive, or accept substitution for any requirement of section 32.7 in
a particular case upon f nding_that requiring such iniprov_eii-ould not, forward the purposes
of this chapter or otherwise serve the public health, s_afet_o tivefare,• or in the case of
substitution , that such alternative would satisfy the purpose of this chapter to at least an
equivalent degree as the required improvement.

Using the existing access road the adjacent properties, and the general public, may have free access to
their properties and use the existing private road unencumbered. There is no question that during
construction, installation of curb and gutter along the access road will be detrimental to the public
health, safety and welfare. Use of the road would be impaired and safety issues may arise due to
unnecessary construction activity. Also, unnecessary disturbance of a stabilized area has the
potential to result in degradation of the site and the adjacent properties.
Whenever, because of unusual size, topography, shape of the property, location of the property
or other unusual conditions, excluding the proprietary interests of the developer, strict
application of the requirements of section 32. 7 mould result in significant degradation of the site
or adjacent properties, the requirement nrav be modified or waived by the commission;
provided that such modification or titi shall not be detrimental to the public health, safely or
welfare, to the orderly development of the area, to sound engineering practices, or to adjacent
properties.
The unusual condition on this site that prevents the development from meeting the requirements of the
Ordinance is that the applicant is restricted to work within 30' access easement. Curb and gutter can
be installed within the easement, but it would effectively deny the use of the approved parking that
each of the adjacent property owners have installed for their use. For all practical purposes the
adjacent property owners would be left with a curb speed bump in the middle of their parking spaces.

The Korean Church can only do work within the easement, but has no right to install curb and gutteraroundtheparkingontheadjacentproperties. Those properties showed their reluctance to grantadditionaleasementswhentheybothrefusedeasementsforawaterline.
c. Upon finding in any case that by substituting of technique, design or materials of comparablequalitl, but differing from those required by section 32.7, a developer would achieve resultswhichsubstantiallysatisfytheoverallpurposesofthischapterinamannerequaltoorexceedingthedesiredeffectsoftherequirementinsection32.7, the commission may approvesuchsubstitutionof'technique, design or materials.
We are proposing to use the existing private road. It is stabilized, has proven to be adequate over itsmanyyearsofuseanditisingoodcondition. There will be no increase in the quantity of runoff alongtheaccessroadduetothisdevelopment. The church is providing curb and gutter in all areas wheretherewillbeanincreaseinthequantityofrunoffduetothisdevelopment, that is, throughout the siteitself.
d. A developer requesting a modification, waiver, or substitution pursuant to this section shall filewiththeagentawrittenrequestwhichshallstatereasonsandjustificationsforsuchrequesttogetherwithsuchalternativesasmaybeproposedbythedeveloper. Such request shall besubmittedpriortocommissionconsiderationofthepreliminaryorfinalplan, but no later thanthesitecommitteerevisiondeadline. No such request shall be considered by the commissionuntilthecommissionhasconsideredtherecommendationof, the agent. The agent mayrecommendapproval, approval with conditions or denial. A recommendation of approval orconditionalapprovalshallbeaccompaniedbyastatement,fr•om the agent as to the publicpurposeservedbysuchrecommendation, particularly in regard to the purpose and intent of thischapter, the subdivision ordinance, and the comprehensive plan.

Revl: The proposed retaining wall is very high. Please provide details of the wall. How will the
drainfield work in conjunction with the ground elevation in that area (elev. —642) and the elevation
Of the basement of the church (elev. —620)? Will sewage be pumped or will the drainfield be lower
than elev. 620? The configuration of the retaining wall and grading seems unnecessary.

RWSA has reviewed the plans titled Korean Community Church as prepared by Dominion
Development Resources and dated 12/20/08 and has the following comments:
1) Revise storm profiles between structures 15 to 14 and 4 to 3 to reflect the depths of cover
observed in the field during the test pits. Minimum vertical separation required is 18 ".
2) Revise the 30' sanitary sewer easement to be centered over the sewer line per our deed
of easement.
3) Ensure that no light poles, E &S facilities, or trees are located in the easement.
4) At "Point A" (11.25 bend) on the drawings, show the bend in the sewer line and revise the
plan of the FM to the west of Point A.
5) Offset storm structures 4 and 17 a minimum of 10' from the sewer line.
6) Provide the minimum distance required by regulatory agencies between the proposed
well and the sewer force main.
7) As previously discussed, provide at least a minimum of 5:1 slope on the embankment
near storm structure 17 so that we may traverse our easement with equipment. Provide a
cutout in the curb for access.
