The County of Albemarle Division of Zoning and Current Development will grant or recommend approval of the preliminary site development plat referred to above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/ Zoning Ordinances unless otherwise specified.] 1. [32.5.6.A] Please add /show the County and State where the project is located. 2. [32.5.6.A] The present use of the adjoining parcel and the zoning classification for James Crenshaw TMP 78 -41 is shown on the same parcel as the proposed office building. Our records indicate that The County of Albemarle owns TMP 77 -41. TMP 77 -41 and not TMP 78 -41 is adjacent to the proposed office building on TMP 78 -15C8. Additionally, TMP 78 -17G4 owned by tree house properties of Charlottesville LLC is zoned PDSC and not C1. Please correct this information on the site plan. 3. Please show /delineate departing lot lines. 4. [4.12.8.e] Instrument assuring continuation of off -site parking. If stand -alone parking or off -site shared parking is to be provided, the applicant shall submit with the application for a site plan, site plan waiver or, if a site plan is not required, with an application for a zoning compliance clearance, an instrument that restricts the use of that part of the land on which parking is provided to that use, and assures that a minimum number of parking spaces as required by this section shall be established and maintained for the life of the use. The instrument shall be in a form that is suitable for recording, shall be subject to review and approval as to form and substance by the county attorney, and shall be recorded in the office of the clerk of the circuit court of the county before the site plan or site plan waiver is approved. As the parking requirements for the use or structure change, subsequent instruments may be submitted, reviewed, approved and recorded that rescind or modify the prior instrument. 5. Please contact Gerald Gatobu at the Division of Zoning and Current Development at 296 -5832 ext. 3385 for further information. 44-' I County of Albemarle Department of Community Development January 10, 2008 Scott Collins 800 East Jefferson Street Charlottesville VA 22911 RE: [SDP 2007 - 00049: Riverbend Preliminary Site Plan] Dear Mr. Collins: The Department of Planning and Community Development hereby grants administrative approval to the above - referenced preliminary site plan. The approval of the preliminary site plan is valid for (1) one year in accordance with Zoning Ordinance Section 32.4.3.1. Therefore, the preliminary approval shall expire January 10, 2009. If the preliminary site plan approval expires, a new application must be filed and processed. Please address all of the requirements and conditions listed below and submit eight (8) tentative plan copies to the Department of Planning and Community Development. This letter must be submitted with the tentative plans, as a checklist, to document that you have addressed all requirements or conditions, or the tentative plan will be denied. A submission and review schedule is attached for your information. The Erosion and Sediment Control Plan and the BMP Stormwater Management Plan, with the associated applications and fees, may also be submitted with the eight (8) tentative Plans. Failure to do so will result in a separate application to be filed at a later date. Note - some of these plans for this project may have been submitted previously). After the initial tentative plan submittal, each department/ agency will contact you to discuss any remaining conditions. After all aforementioned department /agencies have granted a tentative approval, you may submit the final mylars (1sets), two paper copies, final site plan application, final site plan fee, and a copy of all written tentative approvals to the Department of Planning and Community Development. Assuming that the final site plan mylars reflects all tentative approvals, signing of the plans will occur within one week. The final site plan will be subject to all final site plan requirements (Zoning Ordinance Section 32.6), in addition to the following conditions. The Community Development Department shall not accept submittal of the final site plan for signature until tentative approvals for the following conditions have been obtained. The final site plan shall not be signed until the following conditions are met: Zoning Et Current Development approval to include: 32.7.9.4(b)] A conservation plan checklist must be completed and incorporated into the site plan with notes to show how any individual trees and groups of trees designated to remain will be protected during the construction of this project. The locations of any tree protection fencing that coincides with the limits of clearing and other methods of protection from the checklist must be shown on the plan for clear identification during field inspections (Conservation Plan format also available from Planning Staff). Albemarle County Inspections (Building Official): Rearrange the barrier -free parking space so that it is van - accessible.
