Box 5548 Charlottesville, Va 22905 OF ALR fmc7-,at, County of Albemarle Department of Community Development Memorandum To:David Pennock, Principal Planner From:Amelia McCulley, Zoning Administrator Division:Zoning and Current Development Date:November 7, 2007 Subject:NGIC Preliminary Site Plan (SDP 2007 -078) — Determination of Compliance with Proffers (ZMA 2007 -003) I have reviewed the revised site plan (most recent revision dated 10/10/07) to determine if it is in general accord with the Application Plan referred to by the proffers. It is my opinion that this site plan is in general accord with the applicable rezoning plan. This determination was made in consultation with the Director of Community Development, the Director of Planning and the Principal Planner for the Development Areas. This determination is made subject to several understandings and conditions which will be explained more fully in the proceeding. For the purposes of this further discussion, the rezoning plan shall be the same as the Application Plan referred to by the proffers. The rezoning plan shows the provision of stormwater management with an offsite facility. This site plan shows a stormwater management facility located in the area of the rezoning plan shown for an apartment building. The applicant's submittal refers to this being a temporary location for a stormwater facility. The site plan shows this area as "Phase III Future Location of 120 Apartment Units." The current proposal is in general accord with the rezoning plan based on the following: 1. An offsite stormwater facility is not explicitly proffered; 2. It is staffs opinion that the offsite facility was not a major element of the plan nor did it serve a general public purpose; 3. The opportunity for an offsite facility is not foreclosed by this site plan and 4. The other features and major elements of the proposed plan are consistent with the rezoning plan. Please be advised that the 20 foot vegetative buffer shown on the rezoning plan shall be maintained as shown on the site plan. The buffer may not be encroached into for grading for the installation of the stormwater facility. The landscape plan and erosion and sediment control plan must be coordinated so that significant trees at the edge of the buffer will not be damaged. Please note that this approval is subject to the following conditions: I. The Current Development Division shall not accept submittal of the final site plan for signature until tentative final approvals for the following conditions have been obtained. The final site plan shall not be signed until the following conditions have been met: A. Current Development Planner approval to include: 1. Approval of Lighting Plan, including specification sheets and photometric layouts for proposed new lights, in accordance with Section 4.17. 2. Approval of Landscaping Plan, including required screening, in accordance with Section 32.7.9. 3. Approval of Conservation Plan, in accordance with the approved Application Plan. 4. Conditions of both Special Use Permits must be included on the site plan. B. Current Development Engineer approval to include review of all applicable items as specified in the Design Standards Manual, as well as: 1.Erosion and Sediment Control Plan. 2. Stormwater Management Plan. Please provide all needed easements (or at a minimum for preliminary approval, a letter of intent) from the United States of America for grading, drainage easements, use of the pond, etc. A drainage easement will be needed from both proposed outfalls of the NGIC expansion. Drainage easements should be shown correctly over ditches and drainage structures. 4. Parking areas cannot exceed 5% grade in any direction. 5. Grading errors shown on the proposed plan must be corrected. C. Albemarle County Building Official approval. D. Fire and Rescue Division approval to include: 1. Verify adequate fire flow is available. E. Albemarle County Service Authority approval to include: 1. Dedication of offsite water and sewer is required prior to final approval. 2. Approval of final water and sewer construction drawings. F. Virginia Department of Transportation approval to include: 1. Approval of plans for all State maintained portions of the property and entrances into the site. 2. Road and drainage plans need to be provided for the extension of Boulders Road. 3. The plan needs to address the need for a right turn lane into the site. 4.The plan needs to show the proffered improvements to route 29. 5. The entrance to the site at Boulders Road needs to be designed in accordance with the Minimum Standards of Entrances to State Highways and VDOT' s Road Design Manual.
