The Planning division recommends approval of the final site plan upon the resolution of the following comments. Please show and label cross drain locations with VDOT designations (CD -1,2) at every major cut and till transition or sag curve on the street profile sheets. Drainage areas for removal rate calculations should not include offsite drainage areas. The removal rate calculations should be as follows: Ipre = 20 %, Ipost = 31% (1.4 of 4.5 acres), RR = 30 %. Revd: The removal rate provided should read "50 %, " not "15 %, " in Table 12 of the SWM plans. 32. Per the application plan, a biofilter is required. Along with providing adequate stormwater detention, it must treat the first half inch of runoff for stonnwater quality (sized for 2.5% of all impervious area draining to the facility). Revl: Please provide adequate biofilter cross - section details, including all required items from the Design Manual Checklist. For example, cross section of dam, biofilter media, underdrain /gravel, etc. 35. Sediment forebays shall be provided for all biofilter at all inlets. Revd: No plantings /underdrains /media should be located in the sediment forebay. Riprap can be installed at the same elevation as the forebay floor so that no ponding occurs. 36. Please show the vehicle access road to the SWM facility. The road should be located in a SWM easement. Revd: Please specify the location of the access to the riser structure and forebay. 37. Additional comments may be needed upon resubmittal. Revd: Please show the compliance for the 2 year storm in Table 14 of the SWM plans. Please specify the barrel slope of the SWM facility and specify the clean out locations in the biofilter: 38. A SWM bond amount will be computed by the County once the plans have been approved. E. Erosion Control Plan (WPO200700103) 39. Per Proffer #3: "The Owner shall, to the maximum extent practicable as determined by the County's Program Authority, provide additional erosion and sediment controls to achieve a sediment removal rate of eighty percent (80 %) the Property." Please provide additional E &S measures to comply with this proffer. Please include a narrative describing what types of measures you intend to provide in order to achieve a sediment removal detainment ?) rate of 80% (can be included in the E &S narrative). At the end of the comment letter is an attached County Engineer's Commentary discussing Extra Erosion and Sediment Control. Revl: We have provided the following comments on above and beyond measures: Third Party Inspections — This is acceptable. Please provide additional information about these inspections. Please provide how often inspections will take place and how to report the inspections to the County. Correcting downstream impacts resulting from failure — This is not above and beyond. This is a requirement. Reinforced Silt Fence — This is one of the minimum standards, not above and beyond. Engineering recommends using Super Silt Fence (reinforced chain link fence with steel posts) as an acceptable above and beyond measure. Extra storage in trap — Engineering recommends using Super Silt Fence around the northwest perimeter of the site as the E &S measure in lieu of the proposed trap. VDOT's policy is that any feature of a public road that is to be maintained by VDOT shall have no less than 1 foot of Right of Way behind the outermost feature that will be maintained. I understand that the first phase of this development aligns the back of the sidewalk and the ROW but this is incorrect. If the developer chooses to keep the design this way they run the risk of VDOT not being able to maintain the sidewalk and it would be the responsibility of the homeowners to repair it. I recommend that they consider adjusting the typical on phase II and consider putting easement behind the sidewalk for the previous phase if possible. If you have any questions, please contact me. Background: This question has arisen during recent rezoning, special use permit, and waiver applications before the Planning Commission and the Board of Supervisors. Erosion control has become a public concern over large, highly visible, and prolonged disturbances for projects such as Hollymead Town Center on Rt. 29, Luxor on Rt. 250 at Pantops, and White Gables, Kenridge, and Old Trail on Rt. 250 in Ivy and Crozet. As a result, recent approvals for Northtown Center, North Point, Hollymead Town Center Area A, Biscuit Run, and others have proffered to provide erosion control above and beyond ordinance requirements. In each case, consultants and developers have come to the county wondering what this means, and asking for solutions. Commentary: It is generally acknowledged that the best erosion control protection for a site is a sediment basin at the perimeter. It requires the least maintenance and inspection, and captures the most sediment. Yet, the Virginia Erosion and Sediment Control Handbook (Green Book) warns that they are, "at best, 60% effective ". This is not very good, and we know it is worse when the rules are not followed and measures are missing or incorrectly installed. There are also many measures allowed by the state handbook, which we know have a very high failure rate. Silt fence for example, which many designers rely solely on, almost always fails and needs repair. Checks dams and inlet protection measures are other examples. We know from frequent inspection that these measures have a miserable success rate, yet by state mandate they are the standards. It is also not a secret that the county does not have the personnel to monitor every construction site, and often relies on local contractors and the public to point out violations. The state mandate is to visit each site every two weeks, and each site within 48 hours after a rainfall. The county has 4 inspectors, each of whom can cover an average of about three construction sites on a given day, provided there are not too many meetings, complaints, stop work violations, or compliance issues. This covers about half of the current active sites in two weeks, not including hundreds of single family residential building permits. Lastely, one of the weakest areas of the existing state program is in the amount of time land can remain denuded and open to erosion. State minimum standards (4VAC50- 30 -40) generally say areas must be seeded within 7 days of finishing, or if the site is to remain dormant Albemarle C unty Community Development Engineering Review Comments Page 5 of 5 for longer than 30 days. The result is a game contractor's sometimes play. At least every 29 days or so, someone runs the dozers around and restarts the calendar. The county has had huge sites like I-Iollymead and Pantops remain disturbed for many years. Considering these week areas in the existing state of erosion control, there is plenty of room for providing erosion control measures above and beyond regulatory requirements. Here are a few suggestions; commit to a small maximum area exposed at one time. (from Basic Principles, p.II- 13, Green Book) commit to a short maximum time of exposure (from Basic Principles, p.II -13, Green Book) commit to finishing, stabilizing and closing out the permit by a given date commit to daily stabilization and inspections, with reporting to the county provide independent third party professional inspections and documentation provide on -line video monitoring commit to measuring and meeting downstream thresholds commit to correcting downstream impacts off-site use reinforced silt fencing (or a similar standard like super silt fence) provide additional wet storage in traps and basins provide additional dry storage in traps and basins (for the 50yr storm for example) use tackifiers in seeding or soil stabilization applications apply erosion control matting to all slopes apply redundancy in design (backup measures in case the first line of measures fails) use easily installed pre - manufactured silt control devices (as inlet protection for example) hire an independent contractor to install, monitor and maintain erosion control measures separate conservation and buffer areas by barriers or chain link fence provide slope benching and slope drains I will try to add to this list as new ideas emerge. The extension of the street is required by Chapter 14, Section 409 of the Albemarle County Code. A waiver of the extension requirement may be administratively approved subject to subsection D. I will address each provision of that section. D. Waiver by agent of extension requirement. The requirements of subsection (B) may be waived by the agent as provided in section 14- 224.1. A request for a waiver may be made prior to or with submittal of a preliminary plat or with an application to rezone the land, as follows: 1. Information to be submitted. If such a request is made, it shall include: (i) a justification for the request; (ii) a vicinity map showing a larger street network at a scale no smaller than one (1) inch equals six hundred (600) feet; iii) a conceptual plan at a scale no smaller than one (1) inch equals two hundred (200) feet showing surveyed boundaries of the property; (iv) topography of the property at five (5) foot intervals for the property being subdivided and on abutting lands to a distance of five hundred (500) feet from the boundary line or a lesser distance determined to be sufficient by the agent; (v) the locations of streams, stream buffers, steep slopes, floodplains, known wetlands; (vi) the proposed layout of streets and lots, unit types, uses, and location of parking, as applicable; and (vii) identification of the location of the nearest development and rural area boundaries and the maximum number of lots proposed in the subdivision. In reviewing a waiver request, the agent shall consider whether: (i) extending the street to the abutting property line would require offsite easements; (ii) the need for the extension outweighs the impacts on environmental resources such as streams, stream buffers, steep slopes, and floodplain; (iii) alternative connections to the abutting lands from a different location would provide a better connection; (iv) the subdivider would contribute to the cost to complete the extension to the abutting property line when the adjoining lands are developed, and how; and (v) the street would be extended into the rural areas. In approving a waiver, the agent shall find that requiring extension would not forward the purposes of this chapter or otherwise serve the public interest; and granting the waiver would not be detrimental to the public health, safety or welfare, to the orderly development of the area, to sound engineering practices, and to the land adjacent thereto. Extending the street would require an offsite easement. The Avon Park development will be connected to adjacent development to the north. The developer will reserve the necessary right of way for dedication. The proposal extends the street to within 20 feet of the property line. 3. Requirements if ivaiver granted. If the agent grants the waiver: (i) the public street shall be constructed past the point at which the primary structures on the lots abutting the street would rely on the finished grade for landscaping and other improvements, but in no case less than thirty (30) feet beyond the curb line or ditch line on those lots; (ii) the subdivider shall dedicate the required right of way to the abutting property line, along with all easements required to allow the street connection to be constructed in the fut; (iii) the required easements shall prohibit any improvements being established therein; (iv) the subdivider shall provide a surety guarantee or an escrow of funds for its share of the cost to complete the extension if determined by the agent to be necessary; the type of surety guarantee or the escrow shall be acceptable to the county engineer and be approved by the county attorney; and (v) the agent may require that the subdivider install and maintain a sign at the end of the constructed portion of the street stating that the street is a future through street, and that the sign is maintained until the county grants final approval of extending the street to the abutting property. The street is to be constructed past all proposed structures. This modification request is being made during the review of the site plan and no subdivision plat has been submitted. VDOT's policy is that any feature of a public road that is to be maintained by VDOT shall have no less than 1 foot of Right of Way behind the outermost feature that will be maintained. I understand that the first phase of this development aligns the back of the sidewalk and the ROW but this is incorrect. If the developer chooses to keep the design this way they run the risk of VDOT not being able to maintain the sidewalk and it would be the responsibility of the homeowners to repair it. The ARB took the following actions: It was the consensus of the ARB that the approved colors are: Quill DCR102 Salt Marsh Bermuda Stone Hurricane Blue DCR056 Cherokee Rose Yellow (cannot be used on end units) Regarding the two white colors, it was the consensus of the ARB that: The Charleston White DCR100 paint needs to be revised to a creamier white, which can be administratively approved, and The Simply White Duron 2143 -70 stain was approved. Regarding the picnic shelter, it was the consensus of the ARB that the applicant could choose either of the designs submitted. Regarding the side elevations, it was the consensus of the ARB that the elevations were approved with the condition that either the board and batten or the shake siding be used (but not both) at the upper gable ends. Following the meeting, you submitted trim samples painted with Duron DCR101 "Aunt Betty's China ". This is an acceptable revision to the Charleston White and is approved. These work session items were the last outstanding ARB issues for this project. You may consider this letter your Certificate of Appropriateness. This approval is predicated on the fact that the design and materials, as proposed and exhibited for review, will be used. The acceptance of approval implies that the applicant has agreed to execute the design as indicated on the site plan, attachments, materials, samples, and other submittal items presented. Any change in the approved design or materials will require an amendment to the plan and must be reviewed and approved by the Architectural Review Board. Please note the following: 1. This application is approved with the condition that mechanical equipment shall not be visible from the Entrance Corridor. 2. Changes made to the site or architectural plans after issuance of a Certificate of Appropriateness can delay the signing of mylars and the approval of building permits.
