Ll STAFF CONTACT: Gerald Gatobu, Philip Custer PLANNING COMMISSION: June 24, 2008 AGENDA TITLE: SDP 2008-53 UVA Long Term Acute Care Hospital PROPERTY OWNER: University of Virginia Health Services and Kirtley Family Holdings LLC c/o UVA Real Estate Management APPLICANT: University of Virginia Health Services Foundation. APPLICANT'S PROPOSAL: Request for preliminary site plan approval for a three story long term acute care hospital with a building area of 29,373 square feet on 8.52 acres zoned (C1) Commercial, (LI) Light Industry and (EC) Entrance Corridor. The properties, described as Tax Map Parcels 59-23B and 59-23B1, are located in the Samuel Miller Magisterial District on Ivy Road [State Route 250] about 2000 feet from the intersection of Ivy Road [State Route 250] and Broomley Road [State Route 677]. The Comprehensive Plan designates this property as Rural Area in Rural Area 1. The above proposal will require the disturbance of critical slopes (slopes of twenty five (25) percent or greater). The applicant has filled a written request [Attachment Cl for a critical slopes waiver addressing each concern set forth in section 4.2 as per section 4.2.5.a of the Albemarle County Code. PLANNING AND ZONING HISTORY: There are several planning and zoning items related to both sites TMP59-23B and TMP 59-23B1.There have been several site plan applications, zoning clearance applications, sign permits and violations. Planning and zoning items of relevance to this proposal are as follows: A zoning determination for Tax Map 59 parcel 23BI dated October 8th 2007 made by the Zoning Administrator in consultation with the Albemarle County Attorney's office for the proposed Long Term Acute Care Hospital (LTACH). The Zoning Administrator found that as long as UVA owns and operates the building or use, the use is allowed by right as a "public use" under Albemarle County Code Section 18- 27.2.1(12). (Attachment D) The subject property, Tax Map 59 Parcel 23131, is zoned LI, Light Industry. It is located on Route 250, an Albemarle County Entrance Corridor. This property falls within Area C under the Three Party Agreement entered into between the University of Virginia, Albemarle County, and the City of Charlottesville. Paragraph 1 of the three party agreement provides that the University will "voluntarily comply with the land use plans and regulations of either the city or the county regarding the use of real estate held in area C of the three party agreement map". SDP2001-80: A major site plan amendment for a 4200 square foot, two story addition to an existing office building with additional parking for office and parking for the warehouse at the rear of the 3.5 acres parcel zoned LI, Light Industrial was approved on 05/16/2002. (Tax Map 59 parcel 23B I) SDP1986-40: Northridge Office Park Site Plan Approved by the Planning Commission on August 12, 1986. (Tax Map 59 parcel 2313) 2 COMPREHENSIVE PLAN: The Comprehensive Plan designates this property as Rural Area in Rural Area 1. REASON FOR PLANNING COMMISSION REVIEW: Approval of this application requires Planning Commission approval of a modification of Section 4.2 in order to allow disturbance of critical slopes. REVIEW OF MODIFICATION OF SECTION 4.2.3 TO ALLOW ACTIVITY ON CRITICAL SLOPES: DISCUSSION: Critical Slopes Waiver: Section 4.2.3.2 of the Zoning Ordinance restricts earth -disturbing activity on critical slopes, while Section 4.2.5.b allows the Planning Commission to waive this restriction. The applicant has submitted a request and justification for the waiver (Attachment C), and staff has analyzed this request to address the provisions of the ordinance. Description of critical slope area and proposed disturbance: The critical slope disturbance on parcels 59-23B and 59-23B1 will be needed for the placement of the building, surrounding travelways, and a loading dock. The analysis provided in this report is based on the current drawing dated 04-28-08. There are two distinct areas of critical slopes affected by this development plan. The first being a 380ft long, narrow strip on the west side of the Northridge property (TMP 59-23B). This section appears to have been construction when the Northridge parking lot was developed. This slope is adequately established and appears to be well-maintained. The second section of critical slopes exists above (south and east of) the warehouse parking lot on the Kirtley property (TMP 59-23131). After a brief site investigation, the critical slopes in this area seem to be natural. The trees on the slope appear to be mature and no scrub vegetation is present. Though, due to its location between two level building sites, it is possible the slope was created by the development of the property decades ago. TMP 59-23B (The Northridge Property) Areas Acres Total site 5.03 acres approximately Critical slopes 0.80 16% of site Critical slopes disturbed 0.32 41% of critical slopes TMP 59-23B1 The Kirtle Pro er Areas Acres Total site 3.50 acres approximately Critical slopes 0.63 18% of site Critical slopes disturbed 0.30 48% of critical slopes Exemptions to critical slopes waivers for driveways, roads and utilities without reasonable alternative locations: A portion of this disturbance, the area needed to construct the biofilter, is exempt. Although, it appears an alternative site layout or a smaller footprint would eliminate the need for a SWM facility on the critical slope. [4.2.6c] The combined area of the exempted critical slope disturbance (which has been included in the above calculations) is 0.08 acres. This area is approximately 13% of the critical slope disturbance. Compliance with Zoning Ordinance 18-4.2: "movement of soil and rock" Construction of the building and other site features will most likely require a temporary increased flow down the critical slopes during a rain event. Movement of soil can be caught with an appropriate sediment trapping measure before site runoff enters the existing stormwater system. '`excessive stormwater runoff' Stormwater runoff will be controlled on site by an underground detention facility and a biofilter. No site runoff will run across critical slopes in the post development condition. "siltation" Inspection and bonding by the County will ensure siltation control during construction. Proper stabilization and maintenance will ensure long term stability. "loss of aesthetic resource'" The critical slope on the Northridge property (TMP 59-23B) is visible from 250 and the Northridge building. The critical slope on the Kirtley property is only visible from the on-site warehouse. On both parcels, the critical slopes are covered by mature evergreen trees. "septic effluent" This site is serviced by public sewer. Based on the review above, the applicant has satisfactorily addressed the technical criteria for disturbance of critical slopes. Section 4.2.5(b): Staff has included the provisions of Section 4.2.5b here (in italics), along with staff comment on the various provisions: b. The commission may, modify or waive any requirement o f section 1.2 in a particular case upon finding that: (Amended 11-15-89) Strict application of the requirements of section 4.2 would not,forward the purposes of this chapter or otherwise serve the public health, safety or welfare, or that alternatives proposed by the developer would satisfy the purposes of section 4.2 to at least an equivalent degree; or (Added 11-15-89) Strict application of section 4.2 would make it difficult to construct the Long Term Acute Care Hospital at this location. It can be argued that the public would be missing out on Acute Care Health Facility due to strict application of section 4.2. 2. Due to its unusual size, topography, shape of the property, location of the property or other unusual conditions, excluding the proprietary interest of the developer, the requirements of section 4.2 would effectively prohibit or unreasonably restrict the use of the property or would result in significant degradation of the site or adjacent properties. Such modification or waiver shall not be detrimental to the public health, safety or welfare, to the orderly development of the area, or to adjacent properties, or be contrary to sound engineering practices; or (Added 11-15-89) The property has a dwelling/office and a warehouse building in the rear; therefore, the requirements of section 4.2 do not effectively prohibit or unreasonably restrict the use of the property. The waiver, however, shall not be detrimental to the public health, safety or welfare, to the orderly development of the area, or to adjacent properties, or be contrary to sound engineering practices; 3. Granting such modification or waiver would serve a public purpose ofgreater import than would be served by strict application of section 4.2. (Added 11-15-89) The University plans to build a long term acute care hospital on these two properties. It can be reasonably said that the construction of an acute care hospital would serve a public purpose of greater import than would be served by strict application of section 4.2. Factors favorable to this request include: • Permits the construction of a long term acute care hospital. • Addresses the requirements of section 4.2 Factors unfavorable to this request include: • Denial of the critical slopes waiver would not prohibit development on the property. RECOMMENDATION: Based on the analysis of the Open Space and Critical Resources Plan and on the review of the engineering criteria presented above, staff opinion is that this request meets the criteria for approval. Staff recommends approval of the critical slopes waiver. Discussion Interparcel Connection Should the planning commission choose to approve the critical slope waiver, staff recommends discussion on interparcel connection. Interparcel connection is required for comprehensive plan compliance and can be required per section 32.7.2.5 of the Albemarle County Code by the planning commission or the agent. Staff has attached an email from UVA staff (Attachment F) explaining the University's position and limitations to achieving the required interparcel connection. Section 32.7.2.5 of the Albemarle County Code reads "The commission or the agent may require provision for and/or construction of travel lanes or driveways to serve adjoining properties. The pavement of vehicular travel lanes or driveways designed to permit vehicular travel on the site and from adjacent property and parking areas shall be not less than twenty (20) feet in width ". This will also reduce the visual impact of a three story building by blending it into the existing topography of the development site. This development will not unnecessarily increase the amount of stormwater run-off by the use of a low -impact storm sewer design methods such as bio -filters, Filterra/storm filters and underground storage of run-off. The combination of these methods will ensure that the post -development run-off quantity does not exceed the pre -development run-off quantity. The building will be on both public water and sanitary sewer. The ramp will need to cross a ACSA/RWSA water line easement and will add an additional three to four feet of fill over the pipe. We may have trouble getting permission to do this. There is also an existing electric pole that causes problems with the design. Our current sketch depicts a 20' wide travel -way with a 14% grade. The approaches to the connector is problematic because many cars will not be able to make the transition. Additionally, we are having a difficult tune understanding the need or benefit of the inter -connective ramp. Employees will be assigned to park in the Seig lot and there is no need for them to move from one lot to the other during their work shift. Patient and visitors will continue to park in the Northridge lot as they have for the last twenty years. In conclusion, we will continue to study the connector, but at this point we cannot agree to build it. We will commit to continue to work on the design and to work with your department on a final resolution, however the design issues, the easement concerns, and the unknown cost of the work and its benefit to the project prohibit us from making a commitment today. At this time, I am giving preliminary approval to the parking projections and proposal. Prior to final site plan approval, I suggest that they conduct an additional parking analysis of vacant spaces to confirm their presumptions for actual parking occupancy during peak hours. Their study included the following: ■ Parking inventory and actual occupancy on December 5, 2007 at four different times each of which was two hours apart; ■ Examining monthly patient activity reports for December as compared to other months to determine the seasonal variation. This exercise resulted in a finding that the December data should be increased by 8.3% to account for the slightly lower than average December patient activity. ■ Use of parking generation rates published in Parking Generation by I.T.E. This is the industry standard manual which is referenced in our parking regulations for use in parking studies; ■ In addition some of the parking assumptions for comparison usage include use of County standards such as the 1 space per 4 beds for convalescent home for the LTACH facility. The proposed project involves two different site plans which are necessary to allow development of the Long Term Acute Care Hospital (LTACH). The proposed project involves moving parking for the current employees of the Northridge facility to the Sieg Warehouse property. In addition, this parking area will serve the employees of the new LTACH. Parking to serve the expansion of the Moser Radiation facility will also be provided on the Sieg Warehouse property. The proposed uses which will result from the completed projects on these properties are as follows: 1. Northridge medical office building (parcel 2313) — no change in use; 2. Kirtley realty building (parcel 23131) — no known change in use; 3. Kirtley warehouse (parcel 23131) — may potentially be used in part as a County fire station with some possible remaining warehouse use; 4. Proposed LTACH on Kirtley property (parcel 23131); 5. The subject properties are located on the north side of Route 250 West, approximately 1,500 feet east of Bromley Road. PROPOSAL: The 50 -bed hospital would provide a facility for patients who have been stabilized but require extended care in a hospital -type facility. Preliminary site plans for the LTACH, Northridge, and Sieg properties are concurrently under review. The hospital proposal includes the following: • A main entrance for LTACH would be constructed into the slope on the western edge of the Northridge medical building parking area • LTACH would have shared parking with Northridge • Northridge and LTACH staff would share parking with the adjacent warehouse building (Sieg building) to the east, to provide the additional spaces needed for LTACH • Radiation facility within LTACH would be shared with patients and the general public • Separate ambulance entrance for LTACH on an existing private road, between LTACH and the Volvo dealership; the private road would also be shared with the recently approved Korean Church, on the property located to the rear of the dealership • Existing 2 -story brick building on the LTACH property would be used for offices • Continue to use existing entrances for each site, with no vehicular inter -parcel connections. LTACH : 2975, 2983, and 2987 Ivy Road; Northridge: 2955 Ivy Road; Sieg: 2871 Ivy Road CHARACTER OF THE SITE / AREA: Although the Comprehensive Plan land use designation for these sites is Rural Areas, this area is characterized by a wide range of zoning districts that were left in place when the County zoning ordinance was adopted in 1980. The uses on the north side of Route 250 reflect this mixture of zoning districts that include a car dealership, church facilities, UVA medical facilities, auto repair, the Farmington Country Club and golf course, a nursery, and residential uses. Although the south side of Route 250 directly across from the proposed site is located in the Development Areas, the south side is more reflective of what typically characterizes the Rural Areas with a mixture of agricultural and residential uses, including a 155 -acre farm that has been divided by the Rural Areas and the Development Areas Comprehensive Plan land use designations. A map of the area's Comprehensive Plan designations is attached as reference (Attachment C). PROJECT BACKGROUND AND DISCUSSION: The University of Virginia, the City of Charlottesville and Albemarle County entered into a three -party agreement that provides each entity the ability to review proposals by the affected entity. In complying with this Agreement, the University of Virginia has submitted site plans for the County's review for the proposal's compliance with the Comprehensive Plan. A review for Compliance with the Comprehensive Plan considers whether the general location, character and extent of the proposed public facility are in substantial accord with the adopted Comprehensive Plan. It is reviewed by the Planning Commission and the Commission's findings are forwarded to the Board of Supervisors as information. No additional action is required by the Board. STAFF COMMENT: The purpose of this review is to determine if the UVA Long Term Acute Care Hospital with shared parking on two parcels is consistent with the Comprehensive Plan. In evaluating this proposal, staff reviewed the following issues: 1. Existing Zoning The proposed uses are located on properties with zoning districts that are not consistent with the Rural Areas designation of the Comprehensive Plan: LTACH — Light Industrial (LI); Northridge — Commercial (rezoned in 1994 from LI to C-1); Sieg — Light Industrial (LI). • The existing zoning allows commercial and industrial development that is not consistent with the Rural Areas designation. Most of the existing zoning was allowed to remain when the County was rezoned in 1980. This old zoning allows development that generates traffic and creates demands for services that is not consistent with Rural Areas. These zoning CCP 2008 01 LTACH PC Report—, June 24, 2008 Page 3 of 7 districts are normally found in the Development Areas, where the demand created by these uses for transportation and services can be met. A copy of map showing zoning is included as Attachment D. • The Commercial District (C-1) (Attachment E) is intended "to permit selected retail sales, service and public use establishments which are primarily oriented to central business concentrations. It is intended that C-1 districts be established only within the urban area, communities and villages in the comprehensive plan." Uses allowed without a requirement for a legislative review, by -right uses, allowed in the C-1 Districts include department stores, furniture stores, grocery stores, eating establishments, hardware stores, indoor theatres and automobile service stations • The Light Industry (L-1) District (Attachment F) is intended "to permit industries, offices and limited commercial uses which are compatible with and do not detract from surrounding districts. Uses and land previously established in industrial limited (M-1) and research and technical manufacturing (RTM) districts, where in conformity to the comprehensive plan, shall be encouraged to develop as active centers of employment on both individual sites as well as within industrial parks. It is intended that LI districts may be established in areas having all of the following characteristics: -Areas served by water and sewer facilities or if such facilities are reasonably available; -Areas served by major highway, rail or air service, or secondary road improved to standards approved by the county; and -Areas having clearly demonstrated suitability for intended uses with regard to physical characteristics and relationship to surrounding development." Uses allowed without a requirement for a legislative review, by -right uses, allowed in the L -I District include pharmaceutical manufacturing, fire and rescue stations, manufacturing processing, scientific or technical education facilities, research and development activities, assembly and fabrication of light aircraft, contractor's office and equipment storage yard, publishing and printing, public uses such as schools, office buildings, warehouse facilities and wholesale businesses. The hospital is considered a public use." 2. Comprehensive Plan The Comprehensive Plan establishes policy to help guide public and private activities related to land use and resource allocation. The following policies address the proposed hospital facility along Route 250 West. • Growth Management and Facilities Planning Policies: The existing zoning allows an intensity of development and creates a demand for services that the Comprehensive Plan Growth Management and Facilities Planning goals and policies direct to the Development Areas. • Land Use Plan: The Land Use Plan provides guidance for development that is consistent with the Growth Management goals to channel development into designated Development Areas. CCP 2008 01 LTACH PC Report2 June 24, 2008 Page 4 of 7 • Natural Resources: The site is within the South Fork Rivanna Water Supply Watershed • Utilities: The LTACH site has water and sewer service in the general area proposed for the LTACH building; the rear of the property currently containing warehouse buildings and potentially a future fire department has approval for water only; however, sewer may be approved only for the portions of the parcel which can be totally gravity fed. The site plan currently under review includes a determination of sewer availability. • Scenic Resources: Route 250 West has been designated as a Virginia Byway, as it is an "existing road with relatively significant aesthetic and cultural values." Although the Virginia Byway designation does not place restrictions on roads with this designation, it does recognize roads that further the promotion of tourism and the public appreciation of natural and historic resources. • Entrance Corridor: Route 250 West has been designated an Entrance Corridor by the Plan. Entrance Corridors are intended to "protect and enhance the County's attractiveness to tourists and other visitors." The site plan, currently under review, is subject to approval by the Architectural Review Board. • Transportation: Route 250 West has been identified as a primary road that is one of three major corridors that "present particular transportation concerns." There are no plans to widen Route 250 West and new development should not necessitate improvements that would not otherwise be warranted. The Route 250 West Task Force has reviewed the proposal and has recommended a light at the main Northridge exit (Attachment G) in order to minimize traffic impacts on Route 250. • Rural Areas: The zoning and development on this side of Route 250 is inconsistent with rural character, visions for the rural areas, and the important components for the Rural Areas identified by the Guiding Principles. While the proposed hospital is not in compliance with the Comprehensive Plan Rural Areas designation, the proposed uses are consistent with the existing zoning. 3. Issues Several concerns have emerged with the review of the proposed facility. • Compliance with the Comprehensive Plan: Although the proposed hospital is consistent with the uses allowed within the L -I and C-1 zoning of this area, it is not consistent with many policies of the Comprehensive Plan. However, the existing zoning districts would allow uses that are also not consistent with the long-range Plan and could have as much or more impact than the proposed use. • Scale: The 3 -story, 87,627 square foot hospital on a 3.5 acre parcel that also contains a 2 -story, 4,300 square foot brick office building and 23,100 square foot warehouse is at a scale that necessitates off-site parking for both staff and visitors. The scale is not consistent with the character of the Rural Areas, but, again, is permissible under the zoning. • Traffic: Cumulative impacts of the additional traffic, including traffic from emergency vehicles, and the use of separate, unsignaled entrances. Complicating the circulation / traffic situation further, although not a part of this application, the UVA Moser Radiation building adjacent to the Sieg warehouse CCP 2008 01 LTACH PC Report-. June 24, 2008 Page 5 of 7 is expanding their radiation facility and currently has a vehicular connection with the Sieg warehouse. The applicant has indicated that they will continue to study the feasibility for vehicular connections between parcels. The Virginia Department of Transportation has recommended that there be vehicular connections between all three parcels, in order to warrant one signaled entrance/exit point and avoid multiple friction points onto Route 250. The conditions created by the proposed LTACH, shared parking, and multiple entrances could cause conditions that would make widening of Route 250 West necessary for safety concerns. As stated earlier, the Comprehensive Plan does not recommend widening Route 250 in this area. Summary Factors Favorable to this proposal: 1. The proposed hospital is consistent with the existing zoning district. 2. The proposed hospital would fulfill community need for a long-term acute care facility. Factors Unfavorable to this proposal: 1. The type scale and intensity of the use is not consistent with Comprehensive Plan policies and goals for Rural Areas. 2. Traffic and separate entrances/exits would create multiple friction points on Route 250 and could create a need to widen Route 250. Although the proposed hospital is not in conformity with the Rural Areas land use designation and is not consistent with many Comprehensive Plan polices which guide Rural Areas development, the existing zoning and the uses permitted in those zoning districts allow for the development that is equally inconsistent with the Comprehensive CCP 2008 01 LTACH PC Report2 June 24, 3008 Page 6 of 7 Plan and could have as much or more impact than the proposed use. The traffic generated by this use, combined with the traffic of the existing uses, should be mitigated so as not to create pressure for the widening of Route 250 West which would be inconsistent with the Comprehensive Plan. RECOMMENDATION: Staff finds that the existing zoning allows for development that is inconsistent with the Comprehensive Plan; however, as this proposal is allowable under that zoning and would be no more intensive than other development that could take place under that zoning, staff can recommend acceptance of CCP 2008-01 subject to the following condition: 1. Inter -parcel vehicular connections between TMP 59-23B1 (LTACH), TMP 59-23B (Northridge) and TMP 59-23D, TMP 59-23F, and TMP 59-23CI (Sieg). The Task Force appreciates the opportunity to review and comment on the University of Virginia Long Term Acute Care Hospital. The Task Force is concerned that the service vehicle access, which is located to the west of the main Northridge entrance, is not safe. The Task Force believes the proposed service entrance for the ambulances may not be safe for service vehicles and employees that must use it to exit to Route 250 due to marginal site distance. This access point is particularly close to a crest west of this service entrance on Route 250. East -bound vehicles on Route 250 topping this crest may not have time to react to vehicles exiting the service vehicle entrance traveling east. Additionally, this entrance could experience additional traffic once the warehouse is fully utilized. It is the Task Force's understanding that the existing main Northridge entrance has already met the criteria for a traffic signal. The Task Force recommends that this signal be installed and operating prior to facility use. The Task Force does not support the installation of a traffic signal at the service entrance. The Task Force recommends that the applicant address this potential safety hazard. Again, the Task Force appreciates the opportunity to comment on this important community project. [mailto:Joel.Denunzio@VDOT.virginia.gov] Sent: Wednesday, June 11, 2008 4:33 PM To: Gerald Gatobu; Amelia McCulley Subject: RE: Northridge Development Parking and Traffic Analysis Update Amelia, Gerald, I have reviewed the Traffic Analysis update and have the following comments: • The Traffic Analysis Summary and Recommendations states that a signal is currently warranted at the Northridge Main Entrance. However, the study submitted in January 2008 was not a complete warrant analysis and will not be accepted to approve and install a signal at this location. Because it is an existing site, a 12 hour count will need to be conducted to properly show the warrants for a signal. Also, the initial study recommended that the 12 hour count and analysis be conducted, but the update indicates that the signal is warranted when this may not actually be the case. . I recommend that the interparcel connections be made between the three sites. The analysis indicates that left turns out of all three driveways will cause an increase in delay and as stated above, a signal is not necessarily warranted. If a new analysis shows no signal is warranted, there will be three driveways with decreased LOS for left turns that may cause unsafe operating conditions. If all three driveways are consolidated to the main entrance, it is more likely that the signal will be warranted and it will be a safer condition for all movements. . Although the Access Management Regulations for this section of Route 250 will not be implemented until sometime in 2009, these three driveways do not meet the spacing standards the will be in place when the regulations go into effect.
