Thank you for the Health Department documentation of the permit history of the parcel. I have since forwarded
these documents onto the Health Department for review in conjunction with the subdivision plat and am
pending their review/approval.
In response to the question about the Tier II study- the ordinance does not distinguish between lots below 21
acres with existing residences and lots without residences; rather, it merely requires all plats creating lots under
21 acres served by wells to have the Tier II study completed prior to approval. Below I am providing you the
applicable sections of the ordinance.
Sec.14-308.1 Groundwater assessment information.
Groundwater assessments required by section 17-402 shall be initiated by the program authority upon the submittal of the preliminary plat.The draft groundwater
management plans and acquifer testing workplans required by sections 17-403 and 17-404,as applicable,shall be submitted in conjunction with the submittal of the
preliminary plat.The requirements of sections 17-402,17-403 and 17-404 shall be satisfied prior to final plat approval.
Sec.17-1000 Applicability.
This article shall apply to the establishment of land uses that will rely on privately owned wells serving as the primary source of potable water and having not more than
two(2)connections(hereinafter,"individual wells")or central water supplies,as defined in Albemarle County Code§ 16-101.The applicable requirements of this
article are determined by the development approval sought by the owner and the land uses within the development,as follows:
Tier II-Prior to approval of a preliminary subdivision
plat creating lots of less than twenty-one acres that will
be served by individual wells
Sec.17-1002 Tier 2 assessments.
A Tier 2 assessment shall consist of the program authority reviewing and evaluating the county's well database,available hydrogeologic studies,and information from
the Virginia Department of Health and the Virginia Department of Environmental Quality,as provided in the Design Standards Manual.Based on this evaluation,the
administrator may require that the owner provide additional groundwater assessment data prior to subdivision plat or site plan approval,or may require that a Tier 3
assessment be submitted.

I don't understand the logic that requires a Tier 2 Study for existing residence(s)?

The County of Albemarle has received application to subdivide[Tax Map 115 Parcel 41A].This project requires
Health Department approval before receiving final County approval.The applicant has provided Health Department
records for the existing systems onsite,see attached.Please verify that each existing primary structure has both a
primary&reserve drainfield on the lot is serves.
Please review the proposal for suitable subsurface drainfields which comply with the provisions of Chapter 18,

As discussed over the phone just now, the Health Department (HD)has provided me a revised comment letter
(below). Thus all we need for the soil work is a reserve drainfield for the 1970's home. Once that's completed
forward it to me and I'll send it on to the HD for review/approval.
Also, the HD is ok with the single well to serve both lots, but as a condition of that they wou ike an easement
be placed over the well to assure if the lots ever sold both lots have rights to the well. Ple e revise the plat to
provide an easement for both lots to utilize the well.
Also, assure the fee for the Tier II groundwater study is provided. ./c/
Seems like we're moving forward.

As far as the septic goes,the Health Department has a permit on file showing a primary and reserve area for a
two(2) bedroom home that was built in 2004. This information was initially overlooked due to an address
issue. To state it again,we do not have documentation for a Reserve Area for the older home (upper lot). I
believe there is a requirement that primary and reserve drainfields are found for a three bedroom dwelling,
but I am not for sure. Is this a problem?
As far as the shared well goes, the well is existing and the Health Department does not regulate existing
wells. If a shared well was proposed for new residences, the Health Department could support the proposal,
but would recommend that an easement be granted for both properties. Again, this would be for a new well,
as we do not regulate existing wells. I'm guessing that an easement is good fix for the current issue in order to
prevent possible problems in the future should either property be sold, but I don't know the process in
depth....

This division isn't typical, nor has the paperwork/submittal been in a form that we usually see. It sounds from
some of the emails that everyone has known that a reserve area would be needed for the older home. I
would recommend that the applicant contact a licensed OSE to delineate a reserve area and for the surveyor
to show the area on the plat. I would then recommend that the applicant submit the OSE report and survey
plat to you to forward to us here at the Health Department. As you know, this is the same process that we use
for all other divisions. Again, they only need to show a reserve area for the upper lot and the older home. If
they would like to share the existing well,then I would recommend that an easement would be required as
well, although I'm not sure if that is enforceable.

I called you a couple times yesterday but was unable to get ahold of you. The applicant,Nick Williams, and I
spoke yesterday around 4pm and he explained you were able to locate information for the previously approved
reserve drainfield for the home built in 2004 but not the home built in the 1970s. Please confirm this statement
in a revised comment letter/email for the file.
Also,he mentioned discussion about the Health Department being ok with a single well to serve both lots
regardless of the lots being subdivided. If the Health Department is alright with a single well to serve both lots I
need you to assure that is part of your written approval. The County is ok with such a determination for this
specific case being it is two existing homes already served by a single well,but in order for this to be approved
by the County I need the Health Department to approve that aspect of the proposal in writing.
Please let me know your thoughts on this.

County regs which require each lot to have an individual well pursuant to Sections 14-310 and 14-416(provided below).
Sec.14-310 Health director approval of individual private wells and/or onsite sewage systems.
If required as a condition of final plat approval,a final plat shall not be approved if individual private wells are proposed for the subdivision until
written approval has been received from the health director by the agent.A final plat shall not be approved if onsite sewage systems are proposed for
the subdivision until written approval has been received from the health director by the agent,provided further that if the subdivision will be served
by conventional onsite sewage systems:
A.The health director shall determine the suitability of the soil of each lot of the subdivision for which conventional onsite sewage systems will be
constructed,and shall submit his opinion to the agent.
B.The health director may require as a condition of his approval of the installation of conventional onsite sewage systems that individual lots be
graded and drained so as to assure the effective removal of surface water from each lot.
C.Special lots shall not be subject to this section unless the special lot is created for a water supply or waste disposal purpose.
Sec.14-416 Individual private wells and onsite sewage systems.
A subdivision for which public water and/or public sewerage service is not reasonably available as provided in section 14-414,and for which a
central water supply and/or a central sewerage system is not authorized under section 14-415,shall be served by individual private wells or onsite
sewage systems,or both,and shall meet all requirements of the health department and be approved by the health director.

In response to your phone call I researched your question about drainfields for the home built in 2004 (address 1866),
which had a building permit application in 2003. I offer the following: The County is unable to furnish any records of the
reserve drainfield location for this property as the application predates our current records management database tool
(Countyview)and the hard copy files for CO permits dating back this far have long since been purged.Today, for new
construction a primary and reserve drainfield is required to receive approval from the Virginia Department of Health
(VDH). The CO for the proposal is saved electronically in Countyview along with the entire history of the project.
In order to subdivide each lot must receive VDU approval to assure each lot is able to stand on it's own with a primary
and reserve drainfield. The documentation provided to the County from your surveyor,Kirk Hughes, was forwarded to
VDH for review. VDH was unable to provide an approval based on that information. VDH suggests the applicant consult
with a licensed soil evaluator to confirm that a reserve is available for each of the residences and forward the soils report
to Community Development for review after which we'd transmit them to VDH for their review/approval.
Also,VDH stated that they cannot approve the division without each lot being served by its own well. It is my
understanding that two residences on a single lot can be served by a single well if approved by VDH,but when you
attempt to subdivide each residence onto their own lot they must be served by their own well. Thus a second well shall be
applied for and approved by VDH prior to final subdivision plat approval. Please contact VDH for your next steps to take
for this item as well.

Unfortunately this 2003 building permit predates County View so we don't have any records of reviews in the system. I
wasn't even working for the County back then. I would assume the second house on the parcel would be required to
have it's own drain field and also an area for a reserve in 2003.The 2 houses on one parcel would be allowed to share
one well with Health Department approval.
I wish I had more information for you. The house got a CO a long time ago so we don't have a file for it anymore.

I'm working on the above project which seeks to divide a 4 acre parcel into 2 lots, with each lot to have one of
the existing homes on it. Per Health Department review it appears that neither of the homes have a reserve
drainfield on file at the Health Department and both homes share a single well.
One of the homes was built in 1976 (#1868)—no reserve drainfield, very expected. But the other home was
built in 2004 (#1866), why wasn't this home required to have a reserve drainfield located? If it was, where
would we find such records? The Health Department does not have any record of it. Also,how was the single
well permitted to serve both homes, including a 2004 home?
The applicant has a couple questions about past approvals by the County for building permits on the home built
in 2004.
I'm trying to understand the building permit process to explain it to the applicant. Or find some documentation
on our end as to what went down with the original building permit in 2004.
This is kind of an urgent item as the applicant called me after I left yesterday and I need to get back to him
today. Any insight into this item or how to answer this would be helpful. If you're not the man for this one, who
should I talk to?

Based upon a review of the submitted documentation, I offer the following comments.
• It does not appear that a documented reserve area is on file with the Health Department for either of
the residences (1866 and 1868 Ed Jones Road).
• As depicted, Parcel A (2.0 Acres) does not appear to have a private well.
I would recommend that the applicant consult with a licensed soil evaluator to confirm that a reserve is
available for the residences indicated and forward a soil report to you for review and submittal to the Health
Department.

Unfortunately this 2003 building permit predates County View so we don't have any records of reviews in the
system. I wasn't even working for the County back then. I would assume the second house on the parcel would
be required to have it's own drain field and also an area for a reserve in 2003.The 2 houses on one parcel would
be allowed to share one well with Health Department approval.
I wish I had more information for you.The house got a CO a long time ago so we don't have a file for it anymore.

I'm working on the above project which seeks to divide a 4 acre parcel into 2 lots, with each lot to have
one of the existing homes on it. Per Health Department review it appears that neither of the homes have
a reserve drainfield on file at the Health Department and both homes share a single well.
One of the homes was built in 1976 (#1868)—no reserve drainfield, very expected. But the other home
was built in 2004 (#1866), why wasn't this home required to have a reserve drainfield located? If it was,
where would we find such records? The Health Department does not have any record of it. Also,how
was the single well permitted to serve both homes, including a 2004 home?
The applicant has a couple questions about past approvals by the County for building permits on the
home built in 2004.
I'm trying to understand the building permit process to explain it to the applicant. Or find some
documentation on our end as to what went down with the original building permit in 2004.
This is kind of an urgent item as the applicant called me after I left yesterday and I need to get back to
him today. Any insight into this item or how to answer this would be helpful. If you're not the man for
this one,who should I talk to?

Good afternoon, Chris.
Based upon a review of the submitted documentation, I offer the following comments.
• It does not appear that a documented reserve area is on file with the Health Department for
either of the residences (1866 and 1868 Ed Jones Road).
• As depicted, Parcel A (2.0 Acres) does not appear to have a private well.
I would recommend that the applicant consult with a licensed soil evaluator to confirm that a reserve is
available for the residences indicated and forward a soil report to you for review and submittal to the
Health Department.
At this point, I cannot approve the division.
