Subject: SDP 08 -57: Wray Building #5 Conversion
Minor Site Plan Amendment

The Albemarle County Department of Community Development, Current Development Division has received the
application referenced above. I have reviewed the site plan amendment. The plan may be approved when the
following items have been addressed. Each comment is followed by a reference to the Albemarle County Zoning
Ordinance.
Revise plan to show the name of the development. The application form states "Wray Building #5
Conversion... ". So this title would be appropriate: Site Plan Amendment for Wray Building # 5
Conversion. (Section 32.5.6 a)
2. Revise plan to show location and dimensions of parking spaces. (Section 32.5.6 n.)
Revise plan to show a total of 4 Handicap (HC) spaces. Since buildings 4 and 5 share parking a total of
4 HC spaces is required. (you need to add one) Please show the (2) existing HC spaces to remain, as well
as the two relocated spaces. (Suggestion: the second relocated HC space could be adjacent to the space
you propose at building 5.) (Section 32.5.6 b.)
4. Revise plan to add an updated parking schedule showing the change in number of spaces (the 3/11 plan
show a net loss of 5 spaces, which is acceptable). (Section 32.5.6 b.)
5. Revise plan to show replacement landscaping in the new island. Suggest 2 four -foot Myrica certiferas
Wax myrtles) as shown on original plan or a similar size tree. (Section 32.5.6 p.)
6. Add a signature panel for County Approval. (Section 32.6.6 £)
Additional comments:
a) Suggest you delete the parking space closest to the loading dock for easier access to the dock. (Section
32.5.6 b.)
b) Description of Intended Use and Justification on the application form, states 3 `high wall; The wall
appears to be 5' to tie into the existing conditions. This is a reminder that the wall requires engineer
certification with the Building Permit application.
Please submit one revised plan set to me for final review before submitting the mylar and four copies for signature.

The plans look good and printed fine for review, except...
Just one comment for the revised site plan: The number of the left building.
The building at the left is building #4 according to the last site plan amendment .
Please change the building number to 4 (not 6) and the parking calculations work.
Let me know if it really is #6, since then I need you to add back one parking space and revise the parkingschedule.

Jeff,
By copy of this email I have granted tentative approval, to the referenced site plan amendment.
You may submit the final mylars (2 sets), two paper copies, five copies total, (most people submit 2
Mylar and 3 paper) and how ever many you want to have retuned to you.
Please state what copies you want returned to you on your transmittal.
And include a copy of this email to facilitate the process in case I am not here.
Signing of the plans will occur within one week once it is determined that the final site plan mylars
reflect all Planner comments.

You are hereby notified that it is our intent to revolve Virginia Department of Health Operation
Permit Number 2003950 issued on August 12, 2000 covering the operation of the waterworks
at Wray 5 Office Building in Albemarle County, Virginia. Revocation is in accordance with the
provisions of Code of Virginia §32.1 -174 and X12 VAC 5 -590 -320 of the Waterworks
Regulations. VDH proposes to revoke the permit because Wray 5 Office Building no longer
meets the definition of a public waterworks.
If you agree to the revocation of this permit, please sign and date the statement attached to this
letter and return it to this office. If you object to the revocation you have the right to a hearing
and may send a written request to schedule a hearing to the Office no later than 30 calendar
days from the date that you or your agent signs for this certified letter. If VDH does not hear
from you within that time frame, or if this certified letter is returned to VDH for non- receipt, we
will immediately revoke the permit and send you written confirmation of our action.
A copy of this letter is enclosed for your records.

A. The commissioner may suspend or revoke a permit in accordance with Administrative Process Act.
Reasons for revocation of permits are as follows:
1. Failure to comply with the conditions of the permit;
2. Violation of Title 32.1 of the Code of Virginia or of any of this chapter from which no variance or
exemption has been granted;
3. Change in ownership;
4. Abandonment of the waterworks and discontinuing the supplying of pure water; and
5. Any of the grounds specified in § 3z.1_ -74 of the Code of Virginia.
B. When revoking or suspending permits in accordance with the above, the commissioner shall:
1. Send a written notice of intent to suspend or revoke by certified mail to the last known address
of the waterworks owner. The notice shall state the reasons for the proposed suspension or
revocation of the permit and shall give the time and place of the hearing; and
2. Provide at least 30 days advance notice of the hearing.
C. An owner who is given notice of intent to revoke or suspend his permit has a right to a hearing as
specified in 12vac5- 590 -16o and 12vac5-590 -180

32.1 -174. Revocation of permits.
The Commissioner may revoke an) permit issued pursuant to this article whenever he determines that:
1. The waterworks can no longer be depended upon to furnish pure water;
2. The capacity of the waterworks is inadequate for the purpose of furnishing pure water;
3. The owner has failed to abide by an order issued by the Commissioner;
4. The owner has abandoned the waterworks and discontinued supplying pure water; or
5. The owner has failed to pay the waterworks operation fee required by § 12.1- 171._1.
