The Planner for the Zoning & Current Development division of the Albemarle Count }' Department of
Community Development has reviewed the site plan referenced above and will recommend approval
when the following items have been satisfactorily addressed. The following comments are those that have
been identified at this time. Additional comments or condition may be added or eliminated based on
further review. Each comment is preceded by a reference to the Albemarle County Zoning Ordinance,
The Site Plan comments below are from the Current Development Planner only. Other comments will be
forth coming under separate cover.
The Site Plan under review is a site sketch and does not include the full requirements of Section 32.5.6.
The Section 32.5.6 waiver request is scheduled to be heard by the Planning Commission on June 24,
2008. There are a few items that we request be added to the site sketch so we can better understand the
project.
Please add the following items to the site sketch:
1. ( Suction 32.5.6 b). Add a note for the number of parking spaces. Include a parking schedule
showing calculations for parking to include maximum parking required for the two uses:
Farm sales (by prior approval) has 12 spaces
Tasting room (10 customers expected at 1 space per 2.5 customers) requires 4 spaces
Cidery not open to the public, no spaces required
Total Spaces required is 16;
Total provided is 16

3. (Section 32.5.6 it). Show the limits of the gravel areas for parking and driveways. hldicate by
notes and dimensions the locations, arrangement and number of 9' x 18' spaces with 24'back -up
areas or 10'x] 8' spaces with 20'backup areas. So that the total matches the parking schedule.
4. (Section 32.5.6 n).Label the new gravel area between the buildings as "service area" if that is
V / what it is. Indicate if a gate will be placed at the service drive or a sign so public knows where to
park.

The preliminary site plan for the Vintage Virginia Apples Cidery property has been reviewed. The
following comments are provided.
1. A WPO plan will not be required if the total disturbance for construction of the tasting room and
adjustment to the visitor parking lot is kept under I0,OOOsf. If disturbances pass this mark, an ESC
plan will be required.
2. In conversations with Lisa Glass, the applicants have stated their desire to keep the space between the
farm buildings a private agricultural /production area and provide public parking north of tasting room
and market. Please clearly show this on the drawing by providing signage restricting access to the
cidery operations area between the buildings.
3. Please accurately show all existing gravel areas and other important site features.
4. Please provide more spot elevations around each of the buildings and parking areas. The spot
elevations should clearly show that adequate drainage is achieved on the site.
The plan has been designed to parameters less stringent than the standards listed in the County
ordinance. A waiver of the following standards will need to be granted by the Zoning Administrator:
a. 118- 4.12.15.a1 Surface materials.
b. 118- 4.12.15.c1 Maximum grade in parking areas.
e. [18- 4.12.15.g1 Curb and gutter.
d. 118- 4.12.17.a1 Maximum grade for access aisles.
e. 118- 4.12.17.c.11 Minimum width on two -way access aisles.
f. [18- 4.12.16.1 Design requirements for parking spaces
An engineering analysis of the pending waivers is as follows:
a. 118- 4.12.15.a1 The applicant does not wish to pave the entrance drive, parking lot, and
internal operation area. In place of pavement, gravel surfacing will be used throughout the
site. The applicant cites that the rural character of the site and the low trip generation do
not justify surface paving. (It should be noted that engineering review does not consider
the rural character of the site in making its recommendation.) I estimate that between 50
and 75 cars a day will be frequenting the cidery and farmers market during the peak
season. I used this estimate of daily traffic to calculate the required thickness index
through VDOT's Pavement Design Guide Subdivisions and Secondary Roads. The
result of this calculation is a thickness index between 5 and 6 inches which is comparable
to 5 or 6 inches of gravel. The existing gravel drive is currently in stable condition but
increased traffic loads could be a concern to future stability.

b. [18- 4.12.15.c[ The existing slopes of the area to be used for parking are anywhere
between 3% and 71 , , o. A strict enforcement of the maximum parking grade requirement
would necessitate considerable excess grading. Engineering recommends approval of the
waiver of maximum grades in parking areas.
c. 11 8-4.12.15.c 1 Stormwater runoff is always more efficiently transferred with curbing.
However, if the parking lot is not surfaced, the benefit of curb and gutter is greatly
reduced. Engineering review recommends approval of the waiver of curb and gutter for
the parking area if the surface requirement is also waived.
d. [18- 4.12.17.a1 "The existing drive to reach the parking lot adjacent to the cidery tasting
room has a small section of the roadway that appears to be steeper than 10 %. The
roadway is not shown on the current site plan so a field visit was the basis of my
assessment. Engineering review recommends the waiver of the maximum grade of a
travelway be granted because the portion of the steep roadway section is short and does
not present a safety or emergency access problem.
e. [18- 4.12.17.c1 From State Route 29 to the tasting room, the width of the travelway
ranges from 12ft to 16ft. Due to the trip generation of the site, instances where vehicles
have to pass one another head -on will be infrequent. When vehicles do have to pass one
another there is room on the shoulder for most of the travelway for one vehicle to pull
over. "The most restrictive location along the travelway is the dam crossing where the
actual travelway is 14ft and the distance between both guardrails is 16.511. Engineering
review recommends approval of this waiver.
L [18- 4.12.161 The applicant has not shown any information regarding the parking
configuration on the first plan. Engineering review recommends that the parking area be
configured in accordance with all design standards listed section 18- 4.12.16 and a waiver
of this section not be granted. If surface requirements are waived for the parking area,
delineation of parking spaces should be designated by bumper blocks. The use of wooden
railroad ties as bumper blocks is acceptable if the applicant wishes to avoid the use of
concrete blocks. All parking spaces should be protected from vehicles traveling through
the lot [4.12.15.1].

This is to confirm Zoning Administrator. your approval of the wai /er with the following conditions:
1 ) the site sketch shall show that the parking spaces will fit using the correct dimensions (although not painted on
the ground):
2) the parking spaces will be delineated at the site with ,vheels: tops or bumper blocks in accord with Engineering
approval;
3) Landscaping will be required in the form of screening shrubs at the parking spaces that do not face that
buildings.
A separate waiver for Section 32 of the code will be heard by the Planning Commission on June 24, these
conditions will be included in that staff report.

Dear Ms Shelton:
I am in receipt of your application for a site plan waiver for a cidery and tasting room to be constructed at
the Vintage Virginia Apples site (SDP 08 -70). The project is considered a site plan (SDP) with a waiver
so there is a set schedule; I will have review comments from multiple reviewers on or about May 19;
there will be a site review meeting on May 22 and revisions addressing those comments are due June 2.
A staff report will be written on or about Junel 7 and the Planning Conunission meeting is scheduled for
June 24.
However, I need additional information to complete the application. The waiver of a Site Plan is
addressed in Section 32.3.10, attached. A letter clarifying what is being waived is required. It should
specifically address the site plan requirements to be waived. Section 32.5.6 lists the requirements of a site
plan. Portions of the County Code are attached to assist you: Section 32.3 for you use in justification,
and Section 32.5 so you can address each item and state if they will be on the plan. If items are not on the
plan explain why they should be waived.
Please provide an additional 12 copies of the 4/20/08 application plan to my attention by May 8. Please
provide a schedule indicating the size of the new buildings assigned by use in your letter. It would also
be helpful to have site photos from Route 29 showing your entrance, from the entrance drive looking into
the new parking area, and of the existing buildings.
Groundwater usage information may be required for this project. Josh Rubinstein will be contacting you
directly if this is necessary. Please contact me if you have questions or concerns regarding your site plan.

The Section 32.5.6 waiver request is scheduled to be heard by the Planning Commission on June 24,
2008. There are a few items that we request be added to the site sketch so we can better understand the
project.

The preliminary site plan for the Vintage Virginia Apples Cidery property has been reviewed. The
following comments are provided.
A WPO plan will not be required if the total disturbance for construction of the tasting room and
adjustment to the visitor parking lot is kept under I0,000sf. If disturbances pass this mark, an ESC
plan will be required.
2. In conversations with Lisa Glass, the applicants have stated their desire to keep the space between the
farm buildings a private agricultural /production area and provide public parking north of tasting room
and market. Please clearly show this on the drawing by providing signage restricting access to the
cidery operations area between the buildings.
3. Please accurately show all existing gravel areas and other important site features.
4. Please provide more spot elevations around each of the buildings and parking areas. The spot
elevations should clearly show that adequate drainage is achieved on the site.
5. The plan has been desigmed to parameters less stringent than the standards listed in the County
ordinance. A waiver of the following standards will need to be granted by the Zoning Administrator:
a. 118- 4.12.15.al Surface materials.
b. 118- 4.12.15.cl Maximum grade in parking areas.
c. 118- 4.12.15.gl Curb and gutter.
d. 118- 4.12.17.al Maximum grade for access aisles.
e. [18- 4.12.17.c.1] Minimum width on two -way access aisles.
C 118- 4.12.16.1 Design requirements for parking spaces
An engineering analysis of the pending waivers is as follows:
a. 118- 4.12.15.al The applicant does not wish to pave the entrance drive, parking lot, and
internal operation area. In place of pavement, gravel surfacing will be used throughout the
site. The applicant cites that the rural character of the site and the low trip generation do
not justify surface paving. (It should be noted that engineering review does not consider
the rural character of the site in making its recommendation.) I estimate that between 50
and 75 cars a day will be frequenting the cidery and farmers market during the peak
season. I used this estimate of daily traffic to calculate the required thickness index
through VDOT's Pavement Design Guide %or Subdivisions and Secondary Roads. The
result of this calculation is a thickness index between 5 and 6 inches which is comparable
to 5 or 6 inches of gravel. The existing gravel drive is currently in stable condition but
increased traffic loads could be a concern to future stability.

b. 118- 4.12.15.cl The existing slopes of the area to be used for parking are anywhere
between 3% and 7 %. A strict enforcement of the maximum parking grade requirement
would necessitate considerable excess grading. Engineering recommends approval of the
waiver of maximum grades in parking areas.
e. 118- 4.12.15.cl Stormwater runoff is always more efficiently transferred with curbing.
However, if the parking lot is not surfaced, the benefit of curb and gutter is greatly
reduced. Engineering review recommends approval of the waiver of curb and gutter for
the parking area if the surface requirement is also waived.
d. [ 18- 4.12.17.a] The existing drive to reach the parking lot adjacent to the cidery tasting
room has a small section of the roadway that appears to be steeper than 10 %. The
roadway is not shown on the current site plan so a field visit was the basis of my
assessment. Engineering review recommends the waiver of the maximum grade of a
travelway be granted because the portion of the steep roadway section is short and does
not present a safety or emergency access problem.
e. 118- 4.12.17.cl From State Route 29 to the tasting room, the width of the travelway
ranges from 1211 to 16ft. Due to the trip generation of the site, instances where vehicles
have to pass one another head -on will be infrequent. When vehicles do have to pass one
another there is room on the shoulder for most of the travelway for one vehicle to pull
over. The most restrictive location along the travelway is the dam crossing where the
actual travelway is 14ft and the distance between both guardrails is 16.5ft. Engineering
review recommends approval of this waiver.
L [18- 4.12.161 The applicant has not shown any information regarding the parking
configuration on the first plan. Engineering review recommends that the parking area be
configured in accordance with all design standards listed section 18- 4.12.16 and a waiver
of this section not be granted. If surface requirements are waived for the parking area,
delineation of parking spaces should be designated by bumper blocks. The use of wooden
railroad ties as bumper blocks is acceptable if the applicant wishes to avoid the use of
concrete blocks. All parking spaces should be protected from vehicles traveling through
the lot [4.12.15.t].

32.6 FINAL SITE PLAN CONTENT
326.1 A final site plan together with amendments thereto shall be prepared and sealed, signed and dated by an architect,
professional engineer, land surveyor, or certified landscape architect, each of whom shall be licensed to practice in the
Commonwealth of Virginia.
32.6 .2 A final site plan shall be prepared on mylar, sepia or other such transparency material which shall be tensed as the
master drawing. Two (2) clearly legible blue or black line copies of the master drawing shall be submitted to the department
of planning and community development. (Added 5 -1 -87) In addition, if review is required by the commission, one ( I )
reduced copy no larger than eleven (1 1) inches by seventeen (17) inches in size shall he submitted.
32.6.3 Two (2) copies of a landscape plan shall be submitted with the final site plan if not previously submitted.
32.6.4 When the site plan is ready for final approval, the full -sized revised master drawing and a transparency copy of the
master drawing shall be submitted for the agent's signature. Once the agent has signed the master drawing, he shall return
the master drawing to the developer and the developer shall submit tour (4) print copies of the signed master drawing to the
agent.
32.6.5 Unless otherwise approved by the agent, the final site plan shall be prepared to the scale of one ( I ) inch equals twenty
20) feet or larger or to such a scale as may be approved by the agent in a particular case; no sheet shall exceed thirty -six
36) inches by forty -two (42) inches in size The site plan may be prepared on one ( I ) or more sheets. If prepared on more
than one (1 ) sheet, match lines shall clearly indicate where the sheets join. The top of the sheet shall be approximately either
north or east.
32.6.6 The final site plan shall reflect conditions of approval of the preliminary site plan. The final site plan shall contain
the following information in addition to all the information required on the preliminary site plan:
a. Specific written schedules or notes as necessary to demonstrate that the requirements of this chapter are being
satisfied. In addition to preliminary site plan information, indicate if sale orh units; number of bedrooms per unit,
and number of units per building if multi - family; specifications for recreational facilities.
b. Proposed grading (up to twenty [20] percent slope, maximum two [2] toot contours; over twenty [20] percent slope,
maximum five [5] toot contours).
c. Detailed plans for proposed water and sanitary sewer facilities, including: all pipe sizes, types and grades; proposed
connections to existing or proposed central systems; location and dimensions of proposed casements and whether the
same are to be publicly or privately maintained; profiles and cross sections of all water and sewer lines including
clearance where lines cross; all water main locations and sizes; vales and fire hydrant locations; all sanitary sewer
appurtenances by type and numher; the station on the plan to conform to the station shown on the profile and indicate
the top and invert elevation of each structure.
d. Detailed construction drainage and grading plans:
I. Profiles of all ditches and channels whether proposed or existing, showing: existing and proposed grades, and
invert of ditches, cross pipes or utilities; typical channel cross sections for new construction; and actual cross
sections for existing channels intended to remain,
2. Profiles of all stone sewer systems showing existing and proposed grades;
3. Plan view of all drainage systems with all structures, pipes and channels numbered or lettered on the plan and
profile views. Show sufficient dimensions and bench marks to allow field stake out of all proposed work from the
boundary lines;
4. A drainage summary table for culverts, storm sewer and channels as described in the example in the ordinance
5. A legend showing all symbols and abbreviations used on the plan;
6. General notes, typical sections, and details of all items not covered by Virginia Department of Transportation
standard drawings;
7. Flood plain limits for the one hundred year storm for all watercourses with an upstream drainage area of fifty
50) acres or more provided that the county engineer may waive this requirement for drainage areas of less than
One hundred (100) acres upon determination that such information is unnecessary for review of the proposed
development.
e. Typical street sections together with specific street sections where street cut or till is five (5) feet or greater; centerline
curve data; radius of curb returns or edge of pavement; location, type and size of proposed ingress to and egress from the
site, together with culvert size; symmetrical transition of pavement at intersection with existing street; the edge of street
surface or face of curb for full length of proposed street; when proposed streets intersect with or adjoin existing streets or
travel -ways, both edges of existing pavement Or travclway together with curb and gutter indicated for a minimum of one
hundred (100) feet or the length of connection, whichever is the greaten distance.
f. Signature panel for department of planning and community development.
g. For all parking and loading areas, indicate: size, angle of stalls, width of aisles and specific number of spaces required and
provided, and method of computation. Indicate type of sm for all paved or gravel areas.
h. The final site development plan shall he dimensioned to at least the following standards for accuracy:
1. Boundary, setback and zoning lines - nearest one -one hundredth (0.01 ) of a foot;
2. Existing contours - one - half ('%Z) of the contour interval required in section 32.6.6.6 above;
3. Proposed contours - within one (I ) trot horizontally and vertically;
d. Spot elevations - within one -tenth (0.10) of a foot;
5. Existing structures, utilities and other topographic features - Nithin two (2) feet. For critical structures, accuracy
should be within one -tenth (0.10) of a fruit;
6. Proposed structures, roads, parking lots and other improvements - within one hundredth (0.01) of a tout.

Regarding Vintage Virginia apples SRC comments and resubmittal.
Ms. Shelton,
When you submit your revisions (before June 2) please include_:
A) your sketch with the revisions on it (We ask for 8 copies, but four will be enough);
and B) a revision letter explaining why you did not address items if you choose not to address them.
Think of this as a justification.
The comments to be addressed are in the SRC packet I sent you earlier,
with the addition of the parking screening that came form the Zoning Administrator when she approve the 4.12
waiver.(see attached document).
In addition to the changes you already made please be sure to make these changes or justify why not in your
letter:
1) Comments from Cur dev Planner (me)
a) please add the edge of gravel to the plan you had Thursday,
b) if you do not add screening shrubs at the front the parking area that faces the field,
Please include your revision letter justification that the existing orchard ( ? feet of length ) will screen the parking
form the neighboring parcel.
And explain day time hours only, as well as any other justification you have.
2) Comments from Cur Dev Engineer. if you do not address Phil's comment please state in your letter why you did
not address them.

3) VDOT's comments (I sent you Joel's contact information in a separate email, and suggested how you might
address them);
4) ARB. I understand this project was approved by the ARB at the 5/19 meeting. When you receive a letter form
the ARB staff please include that with your resubmittal.
Some good news:
1) The administrative waiver for section 4.12 of the code is approved, see attached document;
2) Schedule: The Cidery building can be construction with a building permit, no site plan required.
However, since the Tasting Room requires a site plan I suggest you wait to construct that building after
you receive the site plan waiver in June.

The latest revision to the preliminary site plan for the Vintage Virginia Apples Cidery property has been
reviewed. Engineering review has no objection to the approval of this preliminary site plan.
1. A WPO plan will not be required if the total disturbance for constriction of the tasting room and
adjustment to the visitor parking lot is kept under 10,000sf. If disturbances pass this mark, an ESC
plan will be required.
Rev. 1) This comment has been noted 61 the applicant. Disturbances will likely be well tinder
10, 000sf.'

The plan has been designed to parameters less stringent than the standards listed in the County
ordinance. A waiver of the following standards will need to be granted by the Zoning Administrator:
a. 1 18- 4.12.15.al Surface materials.
b. 18- 4.12.15.cl Maximum grade in parking areas.
c. 118- 4.12.15.gl Curb and gutter.
d. 118- 4.12.17.al Maximum grade for access aisles.
e. [18- 4.12.17.e.1) Minimum width on two -way access aisles.
f. 118- 4.12.16.1 Design requirements for parking spaces

L 118- 4.12.161 The applicant has not shown any information regarding the parking
configuration on the first plan. Engineering review recommends that the parking area be
configured in accordance with all design standards listed section 14- 4.12.16 and a waiver
of this section not be granted. If surface requirements are waived for the parking area,
delineation of parking spaces should be designated by bumper blocks. The use of wooden
railroad ties as bumper blocks is acceptable if the applicant wishes to avoid the use of
concrete blocks. All parking spaces should be protected from vehicles traveling through
the lot [4.12.15.1].
Rev. 1) The applicant has designed the layout of the parking .spaces to most of the
standards of'18- 4.12.16 except for 18- 4.12.16.e (Bumper blocks). The applicant has
indicated that bumper blocks mould inhibit some of the agricultural operations that
take place on site and should not be required. Engineering review has no objection to
the waiving the bumper block requirement based on this reasoning.

Onsite Sewage System for Tax Map 87, Parcel 9.
Dear Ms. Glass:
On June 16, 2008, the County of Albemarle requested the Virginia Department of Health (via the Albemarle
County Health Department) review the proposed subdivision plat identified above. This letter is to inform you
that the above referenced subdivision plat is approved for individual onsite sewage systems in accordance with
the provisions of the Code of Virginia, and the Sewage Handling and Disposal Regulations (12 VAC 5- 610 -10
et seq., the "Regulations "), (and local ordinances if the locality has authorized the local health department to
accept private evaluations for compliance with local ordinances). This request for subdivision review was
submitted pursuant to the provisions of § 32.1 -163.5 of the Code of Virginia which requires the Health
Department to accept private soil evaluations and designs from an Authorized Onsite Soil Evaluator (AOSE) or
a Professional Engineer working in consultation with an AOSE for residential development. This subdivision
was certified as being in compliance with the Board of Health's regulations by:
Stephan P. Gooch A.O.S.E. # 106, (434- 293 - 7449).
This subdivision approval is issued in reliance upon that certification.
Pursuant to § 360 of the Regulations this approval is not an assurance that Sewage Disposal System
Construction Permits will be issued for any lot in the subdivision identified above unless that lot is specifically
identified on the above referenced plat as having an approved site for an onsite sewage disposal system, and
unless all conditions and circumstances are present at the time of application for a permit as are present at the
time of this approval. This subdivision may contain lots that to do not have approved sites for onsite sewage
systems.
This subdivision approval is issued in reliance upon the certification that approved lots are suitable for
traditional systems," however actual system designs may be different at the time construction permits are
issued.
This subdivision approval does pertain to the requirements of local ordinances.
