This is to request a variation to allow a max roof height on a portion (less
than one half)of one bldg, the West Bldg, to exceed the 35ft by 4.5ft for
a max nf ft
What is th(p reason for each of the requested variations ?:A portion of the West bldg has a 3rd floor. If a straight roof is designed
on this section of the bldg, 35ftheight is adequate. In order to provide a
pitched roof that is preferred by the ARB as a more attractive element as

LUUL, the max roof height that must be noted
on the site plan needs to be increased.
As the bldg design evolved, the need to provide a pitched roof was identified
en a miner pertien of the west bldg that has a third fleer. This pertien Is
actually back from the front wall of the bldg by more than 5ft and a
section of the bldg where the majority of the 3rd floor is located is an
additional 5ft (total of 35ft) back from the front property line. Zoning has
advised that the height limit of 35ft must be
noted on the site plan unless a variation is allowed.

In accordance with § 8.5.5.3 c) of the Zoning Ordinance, in order to grant the varMtion, the Planning Director must
make positive findings under 5 criteria. Please provide information about these criteria for the Director's
consideration (may attach separate sheets).
1. Is the variation consistent with the goals and objectives of the comprehensive plan?
The rezoning was approved and a third floor was allowed. This is in the
growth area where where achieving vertical density is consistent with
the goals of objectives of the comp plan. A Goal of ARB in the EC can be met.
2. Does the variation increase the approved development density or intensity of development?
No, the same density (sf of bldg) can be accomplished with a straight roof.
3. Does the variation adversely affect the timing and phasing of development of any other development in the
zoning district?
No this variation does not affect anything else.
4. Does the variation require a special use permit?
No, this variation does not require a special use permit.
5. Is it in general accord with the purpose and intent of the approved rezoning application?
This request is in general accord with the purpose & intent.
8.5.5.3 VARIATIONS FROM APPROVED PLANS, CODES, AND STANDARDS OF DEVELOPMENT
The director of planning and community development may allow a site plan or subdivision plat for a planned
development to vary from an approved application plan, standard of development and, also, in the case of a
neighborhood model district, a general development plan or code of development, as provided herein:
a. The director is authorized to grant a variation from the following provisions of an approved plan, code or
standard:
1. Minor variations to yard requirements, maximum structure heights and minimum lot sizes;
2. Changes to the arrangement of buildings and uses shown on the plan, provided that the major elements
shown on the plan and their relationships remain the same;
3. Changes to phasing plans;
4. Minor changes to landscape or architectural standards; and
5. Minor variations to street design.
d. Any variation not expressly provided for herein may be accomplished by rezoning.
