Wyant 4686 Garth Road Crozet VA 22932 RE: SP200800058 Harris's Garage — Amendment Tax Map 8, Parcel 35A Dear Mr. Wyant: On June 10, 2009, the Albemarle County Board of Supervisors took action on SP 200800058 seeking amendment to previously approved SP 2001 -49 Thomas Harris Garage to allow expansion of the garage. This request is on approximately a .60 acre portion of a 3,17 acre property on Tax Map Parcel 8 -35A in the Whitehall District. This special use permit was approved based on the following conditions: 1.Development of the use shall be in accord with the conceptual plan titled "Amended Site Plan Harris' Garage ", prepared by DW Enterprises, and dated March 16, 2009 (hereinafter, the Conceptual Plan "), as determined by the Director of Planning and the Zoning Administrator. To be in accord with the plan, development shall reflect the following major elements within the development essential to the design of the development: The size, height and location of the proposed buildings (16' X 30' /maximum 24' high); The area designated for the special use (public garage); The size, height and location of the existing buildings /structures (original garage — 1,936 square feet/24 feet high /3 vehicle bays; garage expansion — 1,496 square feet/24 feet high /1 vehicle bay; enclosed compressor room; paint mixing room; one outside lift; one dumpster pad /fence enclosure; 3 parking spaces carport; 2 parking spaces carport); The number (maximuml5 spaces public garage) and location of the vehicle parking spaces, The two (2) signage locations at the entrance to the special use permit area. The signs shall state, "All vehicles beyond this point must be placed in a marked parking space" and be a maximum of four (4) square feet. The sign location at the area designated as "Parking for Private Vehicles." The sign shall state, "Parking for only personal vehicles of the Harris Family" and be a maximum of four 4) square feet; 2.Gasoline sales are prohibited; 3 The sale or rental of vehicles or other Motorized equipment is prohibited; 4.All repairing or equipping of vehicles shall take place inside the existing garage, with the exception of vehicles being repaired on the vehicle lift located adjacent to the garage; 5.The outdoor storage of parts, equipment, machinery and junk is prohibited; 6.Only personal vehicles may be parked in the area marked "parking for personal vehicles" on the Conceptual Plan. No more than fifteen (15) vehicles associated with the public garage use shall be located outside the garage. All vehicles associated with the public garage use shall be parked 1 in the spaces shown as "for garage only" or the Conceptual Plan. Any vehicles parked outside the area marked "parking for personal vehicles" shall be considered to be associated with the public garage and are counted in the fifteen (15) vehicle maximum; 7,The hours of operation shall be between 10:00 A.M. and 10:00 P.M., Monday through Saturday. These hours of operation do no: prohibit customers from dropping off vehicles outside of operating hours; 8,VVithin three (3) months following approval of the site plan or site plan waiver, the permittee shall install and thereafter maintain a minimum twenty (20) -foot deep landscape evergreen- screening buffer to shield the view of the garage and garage parking from Markwood Road. This landscape screening shall supplement existing landscape approved with SP 2001 -49 and consist of Eastern Red Cedar or other material approved by the Planning Director, a minimum four (4) feet high at planting, and planted in staggered rows with a maximum of ten (10) feet on center spacing between the landscape materials. The permittee shall also submit a landscape plan with the site plan application that will be subject to the approval of the Planning Director or the Planning Director's designee; and 9.AM outdoor lighting shall be only full cut -off fixtures and shielded to reflect light away from all abutting properties. A lighting plan (for new lighting) limiting light levels at all property lines to no greater than 0.3 foot candles shall be submitted to the Zoning Administrator or their designee for approval. Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property as approved above may lawfully begin until all applicable approvals have been received and conditions have been met. This includes: compliance with conditions of the SPECIAL USE PERMIT; approval of and compliance with a SITE PLAN amendment; and approval of a ZONING COMPLIANCE CLEARANCE. In the event that the use, structure or activity for which this special use permit is issued is not commenced within twenty -four (24) months from the date of Board approval, it shall be deemed abandoned and the permit terminated. The engineering review for current development can recommend approval to this application after the following changes: 1. As a condition of the critical slope waiver for this development, the applicant must provide mitigation planting in all areas within the stream buffer that is not currently forested. Please submit a WPO application and $85 fee for the review of a mitigation plan. Please also make the following corrections to the mitigation plan: The stream buffer is not accurately represented on this site plan. And, since the stream buffer is not shown accurately, the mitigated area and number of required seedlings are not correctly calculated. After measuring the stream buffer area in the site plan, it appears that 0.18acres can be planted and, at a density of 1210 stems an acre, the required number of seedlings is 218. Whatever the required number of seedlings within the buffer is, please provide a note stating that half of the mitigation plants must have survived after the first two growing seasons. The county will hold a bond for 5 years to assure that this minimum number of plants survives. Please specify on the plan the species and height of the seedlings to be planted for mitigation. Please provide a rough cost estimate for the purchase and labor of planting of these seedlings so that it can be bonded. 2. Please call out the swale at the southeast corner of the plan and specify the material and dimensions. 3. A low maintenance, non -grass groundcover should be provided on any portion of the slope above the new retaining wall that is steeper than 3:1. Acceptable groundcovers can be found in Table 3.37C of the VESCH. 4. Please provide a note in the area of the dumpster pad that surface runoff is not to drain into or across the dumpster pad. Response: I believe, your numbers are as accurate as we can get, so I used then and showed the area with a note on sheet 2. VDOT is ready to install the signal when the entrance is constructed and will need a 3 month advance notice of the opening of the entrance to ensure the signal construction is complete. SDP - 2009 - 00060 Martha Jefferson Hospital — Major (Summer Frederick) There is not currently a ditch along State Farm Blvd in this section and all drainage from the road and shoulder will flow over the proposed parking lot. Every engineering item has been addressed except for two aspects of the mitigation plan: 1) the Planning Commission must approve the extension of the mitigation deadline and 2) the area to be planted must be modified. Thanks, Phil 434) 296 -5832 x3072 9/10/2009 lilt@ALAt County of Albemarle Department of Community Development Memorandum To:Gerald Gatobu, Current Development Project Planner From:Phil Custer, Current Development engineering review Date:10 September 2009 Subject: Harris Garage Critical Slope Waiver (SDP -2009- 00057) The purpose of this memo is to provide engineering commentary regarding the applicant's recent request to modify a condition of a critical slope waiver approval that was given during the review of Special Use Permit (SP -2008- 00058). During their June 9 2009 meeting, the Planning Commission approved the critical slope waiver for Harris Garage with two conditions. The condition that the applicant would like to modify is written below as it appeared in the approval letter written by the County Planner. The date that the mitigation plantings were to be installed was September 9th 2009. In the applicant's letter requesting reconsideration of this condition, he stated that seedlings (an option included in pages D -6 and D -7 of the Chesapeake Bay Riparian Buffers Manual which has been provided at the end of this memo) are not available until late winter /early spring and, therefore, the deadline for mitigation installation should be extended to April 1st. Engineering review can confuni this claim regarding the availability of seedlings. The Virginia Department of Forestry is currently no longer selling seedlings on their website. Engineering review also spoke with someone at a local nursery and landscape contracting company who verified seedlings are unavailable this time of year because the success rates are extremely low when planted now. It should be noted that the buffer manual also mentions another mitigation option that is much more viable at this time of year. Rather than planting seedlings at a density of 1210 stems /acre, mitigation can be provided with more mature landscaping. In this option, approximately 1 large tree (1 -1/2" caliber), 2 understory trees (3/4" caliber), and 3 shrubs (15" height) would be needed for every 400 sf (-650 stems /acre). However, the mature planting option is considerably more expensive with the total cost being close to $10,000 compared to less than $500 for the seedling mitigation. It appears that this option was considered by the Planning Commission in their meetings because the reference to the mature planting requirements was included in the Planner's staff report. This reference was explicitly removed from the approval which seems to indicate that the seedling option was the direction preferred by all parties. Considering this, the modification to the critical slope waiver to extend the required time for the mitigation to be installed seems reasonable. In the applicant's letter requesting reconsideration of this condition, he stated that seedlings (one option included in pages D -6 and D -7 of the Chesapeake Bay Riparian Buffers Manual which has been provided at the end of this memo) are not available until late winter /early spring and, therefore, the deadline for mitigation installation should be extended to April 1st. Engineering review can confirm this claim regarding the availability of seedlings. The Virginia Department of Forestry is currently no longer selling seedlings on their website. Engineering review also spoke with someone at a:local nursery and landscape contracting company who verified seedlings are unavailable this time of year because the success rates are extremely low when planted now. However, it should be noted that the buffer manual describes another mitigation option that is much more viable at this time of year. Rather than planting seedlings at a density of 1210 stems /acre, mitigation can be provided with more mature landscaping. In this option, approximately 1 large tree (1 -1/2” caliber), 2 understory trees (3/4" caliber), and 3 shrubs (15" height) would be needed for every 400 sf ( -650 stems /acre). The mature planting option is considerably more expensive and is not preferred by the applicant. The total cost of the mature planting option being close to $10,000 compared to less than $500 for seedling mitigation. In the staff report to the Planning Commission for their June meeting, county staff had included in the critical slopes waiver conditions a sentence essentially directing the applicant to provide mitigation with the mature landscaping option. This sentence was explicitly removed when the waiver was approved which seems to indicate that the seedling option was the direction preferred by all parties: r.,. i:`, :Iti ...f1.... et.. tt. ..a r . q ,. ...e.. In this context, the modification to the critical slope waiver to extend the required time for the mitigation to be installed is reasonable and would seem to be a continuation of the county's position from the original critical slope waiver approval in June. The engineering review for current development can recommend approval to this application after the following changes: 1. As a condition of the critical slope waiver for this development, the applicant must provide mitigation planting in all areas within the stream buffer that is not currently forested. Please submit a WPO application and $85 fee for the review of a mitigation plan. Please also make the following corrections to the mitigation plan: The stream buffer is not accurately represented on this site plan. And, since the stream buffer is not shown accurately, the mitigated area and number of required seedlings are not correctly calculated. After measuring the stream buffer area in the site plan, it appears that 0.18acres can be planted and, at a density of 1210 stems an acre, the required number of seedlings is 218. Whatever the required number of seedlings within the buffer is, please provide a note stating that half of the mitigation plants must have survived after the first two growing seasons. The county will hold a bond for 5 years to assure that this minimum number of plants survives. Please specify on the plan the species and height of the seedlings to be planted for mitigation. Please provide a rough cost estimate for the purchase and labor of planting of these seedlings so that it can be bonded. Rev. 1) The applicant has filed a request to amend the condition placed on the property owner when the critical slope waiver was approved during the review of the SP. Engineering review of this request will be provided in a separate memo to the planner. The buffer is still not shown accurately. All stream buffers are IOOft on both sides of the stream, not 100ft total. The 0.18 acres I had calculated before was the area within this buffer on the property excluding the existing forested portion. If the treeline or stream is not shown accurately, the survey file should be updated to match the existing site conditions. All technical comments have been addressed and the Mitigation plan is hereby approved. However, before the site plan can be approved, the bond for the mitigation plantings must be provided. The bond has been calculated to be $300. The county will hold this bond for five years to guarantee survival of half of the planted trees, as specified on the plan. Gerald is currently following up with Zoning Department regarding the approval of the site plan. Once positive word is received from Zoning and the bond has been provided, we will ask you to submit plans for signature. When these plans are submitted, please graphically show the 100ft stream buffer (the stream buffer is a total of 200ft, 100ft on both sides of the stream). He came into the office this week and asked whether the proposed building could be expanded with an 8 foot roof overhang for lawnmower storage. This letter is to respond to that question and to address other issues. 1. Proposed Building Expansion Question The proposed expansion (8 foot roof overhang) is inconsistent with the special use permit approval which specifically states the building size as 16 x 30 ft (bullet 1 in condition #1 of SP 2008 -58 Attached). Therefore, we will not be able to approve that building permit. Another consideration for us to keep in mind is that storing personal mowers in this area is not consistent with the deliberate efforts to separate personal or private vehicles and equipment in a different area from the business vehicles and equipment. 2. Modification of the Carports for Storage of Parts, etc. Since my letter of January 27 you have spoken with Jay Schlothauer, Building Official, about ways in which the carports can be modified consistent with the Uniform Statewide Building Code. Please be advised that use of the carports for parts storage will reduce the amount of parking available for the business. Because there will be fewer parking spaces available and all business parking is limited to striped parking spaces, this parking reduction may make it difficult to comply with the County approvals. Please also be reminded that employee parking is to occur only within the business parking area and not within the personal vehicle parking area. Parking Shown on the Site Plan is Inconsistent with the Special Use Permit Approval Bullet #3 of condition #1 of Special Permit 2008 -58 approval refers to "3 parking spaces carport" and "2 parking spaces carport." Condition #1 of the Special Use Permit requires that development of the use shall be in accord with the conceptual plan titled "Amended Site Plan Harris' Garage," prepared by DW Enterprises and dated March 16, 2009. The conceptual plan shows these parking spaces (Attached); it does not show any parking directly adjacent to the garage building. The currently approved site plan shows only 4 parking spaces within these carports rather that 5; it also shows parking on the west side of the garage. Please revise the site plan to be consistent with the Special Use Permit plan by removing the parking space adjacent to the building and by showing the total of 5 parking spaces within the two carports.
