The setback adjacent to the RA works and the lack of setback adjacent to the "commercial uses" works too. The adjacent zoning is C -1 (and RA) per the attached map. The adjacent PUD parcels are designated for commercial use. Therefore, am I correct in saying that in the absence of any side or rear setbacks established by the PUD, there are none (as C -1 does not require setbacks unless adjacent to a public street or residential district, and none of the adjacent uses are residential...) The PUD does require an 80' front setback, so the setback adjacent to RA is met. It does not appear to me that the plan must show any setbacks other than the req'd 80' setback. I have no issues with the plan, EXCEPT that I cannot determine what the required setbacks are (other than a required 80' front setback). I have pulled all the old rezonings, and based on what I see the setbacks that were established apply to the residential areas of the development. The original site plan (created after the establishement of the PUD) shows setbacks, but I cannot figure out where they came from. The current site plan amendment honors those setbacks that are shown on the original site plan, but I do not feel comfortable signing off on the proposed plan unless I can prove to myself that those are in fact, the required setbacks. As far as the addition of a bathroom to the building plans, I have no problem with that. I will have a conversation with the owner about the uses of the building in order to determine an estimated water use in gallons per day BEFORE a septic modification permit is issued and before the County Building Permit is issued. If the Health Department cannot design a septic system which takes into account the owners wishes, then there are other routes to consider that are associated with approved alternative technologies. I will let you know if I have any problems once the applicant applies for the permit(s). Well, since that time they have decided to finish out the basement and add a net increase of 2 new offices and a bathroom, for an added 900 SF of finished area. Because there is an additional bathroom being proposed, I want to check with you to see if you need to re- review the project and if you think this additional bathroom causes any glitches in your ability to approve the project in the future. This was that catch -22 project, where we needed your ok to approve the amendment and give them building permits, but you said you couldn't give formal approval until the septic lines etc..had actually been relocated.
