The approval of the preliminary site plan is valid for (1) one year in accordance with Section 32.4.3.1 of Chapter 18 of the Albemarle County Code. Therefore, the preliminary approval shall expire on December 16, 2009. If the preliminary site plan approval expires, a new application must be filed and processed. Please address all of the requirements and conditions listed below and submit eight (8) tentative plan copies to the Department of Community Development. This letter must be submitted with the tentative plans, as a checklist, to document that you have addressed all requirements or conditions, or the tentative plan will be denied. Erosion and Sediment Control, BMP Stormwater Management, and road plans with the associated applications and fees must also be submitted with the eight (8) tentative Plans. Once the tentative plan is submitted and reviewed you will receive comments from all departments /divisions /agencies that have made comment on the tentative plan. Any further responses must be made directly to each department/division /agency that has further comment. After all aforementioned departments /divisions /agencies have granted a tentative approval, you must verify with the Planner that you may submit the final mylars (2 sets), two paper copies, the final site plan application, and final site plan fee to the Department of Community Development. Signing of the plans will occur within one week once it is determined that the final site plan mylars reflect all tentative approvals. The final site plan will be subject to all final site plan requirements (Zoning Ordinance Section 32.6), in addition to the following conditions. The Department of Community Development shall not accept submittal of the final site plan for signature until tentative approvals for the following conditions have been obtained: 1 Zoninq & Current Development approval to include: 1. [32.6.3] Approval of a landscape plan in compliance with Section 32.7.9. The landscape schedule will need to show the canopy calculations. 2. [32.6.6] Submission and approval of an outdoor lighting plan. 3. All tentative approvals from reviewing agencies. Please refer to the Design Manual minimum checklist for additional items required for final approval before resubmittal. 2. Water protection review is not a part of preliminary review and will be sent in accordance with The Virginia Erosion and Sediment Control Law. Young 19 Wildwood Drive Palmyra, Va 22963 RE: SP2007 -00034 First Church of the Nazarene — Church (Signs # 9, 14, 41) Tax Map 79, Parcel 10 Dear Mr. Young: On December 12, 2007, the Albemarle County Board of Supervisors took action on SP 2007- 00034 to allow a church with seating for 374 persons, on a 7.32 -acre portion of an 865.167 -acre parcel located on Tax Map 79, Parcel 10 in the Rivanna District. This special use permit was approved based on the following conditions: 1)The church's improvements and the scale and location of the improvements shall be developed in general accord with the conceptual plan entitled Charlottesville First Church of the Nazarene ", prepared by The McKnight Group, and dated November 20, 2007, provided that: a Entrance improvements shall be approved by VDOT prior to final site plan J approval, and shall include a right -turn lane at the entrance; b)All parking setbacks and undisturbed buffers required by Zoning Ordinance § 21.7, Minimum Yard Requirements, shall apply; and The number of parking spaces shall not exceed one hundred fifty (150) without 4, amendment of this special use permit. Relegated parking should be used to the greatest extent possible. 1K The area of assembly shall be limited to a maximum three hundred seventy -four (374) - seat sanctuary; 3)Facilities on the site shall be used for church activities and shall not be rented or used for separate commercial uses available to the public. A daycare facility shall require approval of an additional special use permit for that use; 4)All outdoor lighting shall be arranged or shielded to reflect Tight away from the abutting properties. A lighting plan reasonably limiting the amount of adverse outdoor Tight pollution shall be submitted to the Zoning Administrator for approval as a condition of preliminary site plan approval; Virginia Department of Health approval of well and septic systems before final site plan approval; 6)If the use, structure, or activity for which this special use permit is issued is not commenced within the meaning of Zoning Ordinance § 31.2.4.4 by December 12, 2012, the permit shall be deemed abandoned and the authority granted thereunder shall thereupon terminate; and 40 The plans shall be in general accord with the architectural rende._js presented by the applicant at this meeting (December 12, 2007), subject to modification by the Architectural Review Board. Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property as approved above may lawfully begin until all applicable approvals have been received and conditions have been met. This includes: compliance with conditions of the SPECIAL USE PERMIT; approval of and compliance with a SITE PLAN; and approval of a ZONING COMPLIANCE CLEARANCE. In the event that the use, structure or activity for which this special use permit is issued is not commenced within sixty (60) months from the date of Board approval, it shall be deemed abandoned and the permit terminated. The term "commenced" means "construction of any structure necessary to the use of the permit."
