RE: ARB 2007 - 29: Van Dine Plaza — Rio Road (Phase I) - Final Review of a Site
Development Plan (Tax Map 45, Parcels 100, 101, and 1O1B)
Dear Mr. May:
The Albemarle County Architectural Review Board reviewed the above noted item at its meeting
on Monday, May 7, 2007. The Board unanimously approved the request, pending staff
administrative approval of the following conditions:
1. Provide photographs of existing buildings using Nitterhouse, A -41 "Beige" concrete
block.
2. Revise sheets C2 Demo /Existing Conditions Plan, C4 Grading and Utility Plan, and C5
Landscape Plan to show the entire panhandle of the site, with existing trees to remain,
and the location of all tree protection fencing.
3. Revise drawings to show cut and fill slopes along the northern boundary rounded
minimum 10' radius) to meet existing conditions. Revise drawings to show all proposed
grading at least 5' off of the property line or provide evidence of a grading easement with
the adjoining owner.
4. Revise Sheet C4 Grading and Utility Plan to show the existing 12" Pine, 15" Poplar, and
15" Maple, north of Building B, designated as to remain. Label the tree protection
symbol in the panhandle on Sheet C2 Deano /Existing Conditions and Sheet C5 Landscape
Plan. Provide an Erosion and Sediment Control Plan with the next submission.
5. Revise drawings to show additional shrubs in the 2 new planting areas adjacent to Rio
Road, created by the elimination of 2 parking spaces.
6. Revise the monument sign drawings by removing the columns at each end of the
structure as shown on drawings submitted on May 7, 2007 or modify the sign elevation to
reduce the height of the columns at each end, reduce the length of the monument to 8' —
10', and remove the pediment as shown in Ms. Smith's drawing.
7. Provide complete information on the hanging metal signs to establish the comprehensive
sign criteria for the building.
8. Revise building elevations to reflect a hip roof for the main roof.
9. Revise the landscape plan to show the Otto Luyken laurels, currently shown in planting
area adjacent to Rio Road right -of -way, a minimum of 6' from the face of curb.
10. Revise the building elevations to show a mortar color that will match the primary color of
the Nitterhouse, A -41, beige block.
11. Provide a detail for the circular opening in block pediment.
Please provide:
1. Two full sets of revised drawings addressing each of these conditions. Include updated
ARB revision dates on each drawing.
2. A memo including detailed responses indicating how each condition has been satisfied. If
changes other than those requested have been made, identify those changes in the memo
also. Highlighting the changes in the drawing with "clouding" or by other means will
facilitate review and approval.
3. The attached "Revised Application Submittal" form. This form must be returned with
your revisions to ensure proper tracking and distribution.
When staffs review of this information indicates that all conditions of approval have been met, a
Certificate of Appropriateness may be issued.

Dear Sir:
Pursuant to Section 32.4.2.4 of the Code of Albemarle approval of the above referenced site plan has been
denied. This action has been taken because the site plan has not been revised to include required revisions of
the Site Review Committee. Those items that have not been addressed are:
From Planning:
1. 32.5.6 (b)] You have not provided "data as necessary to demonstrate that the site can accommodate the
proposed use, i.e. the entrance design remains unsuitable for the proposed use.
7C 2. [32.5.6 (q)] You have not provided "where deemed appropriate by the agent due to the intensity of
development, estimated traffic generation, figures for the site based upon current Virginia Department of
Transportation rates. Indicate the estimated vehicles per day and direction oftravelfor all connections to a
public road. In addition to showing that there is sufficient sight distance for the proposed grade at the
entrance.
3. [32.5.6 (s)] ” The agent or the commission may require additional information to be shown on the
preliminary site plan as deemed necessary in order to provide sufficient information for the agent or the
commission to adequately review et the preliminary site plan. You must provide either construction
easements or letters of intent from the adjoining property owner for required grading.
From Engineering:
1. Please provide additional layout information of the adjacent property which shares the entrance to show whether or
not it is feasible to upgrade the entrance to a more suitable grade. An easement (or at a minimum, a letter of intent
for preliminary approval) will be needed from this property owner for construction within the adjacent property.

Revl: If a 4% entrance landing for 40 feet is not feasible, provide a shorter (20 to 30 feet long) 4% entrance
landing.
2. Please provide construction easements or letters of intent from the adjacent property owners for grading which is
within 5 feet of the property line, or keep all grading 5 feet off the property line. (This is to ensure there will be
adequate room for E &S measures, etc.) [DSM1102]

You may resubmit the plan, containing all required revisions, within 15 days the mailing of this notice of
denial along with a fee of $65. If a revised plan and fee are not received within 15 days the preliminary site plan
shall be deemed to be denied and a new application and fee shall be required for submittal of the preliminary
site plan.
In accord with Section 32.4.2.7 of the Albemarle County Code, this decision may be appealed to the Board of
Supervisors by filing a written request with the Director of Planning and Community Development within ten
calendar days of the decision,

The revisions included in this latest submission address all outstanding conditions of ARB approval. You may

This approval is predicated on the fact that the design and materials, as proposed and exhibited for review, will be
used. This application is approved with the condition that mechanical equipment shall not be visible from the
Entrance Corridor. The acceptance of approval implies that the applicant has agreed to execute the design as
indicated on the site plan, attachments, materials, samples, and other submittal items presented. Any change in the
approved design or materials will require an amendment to the plan and must be reviewed and approved by the
Architectural Review Board.

Dear Mr. Wright:
The plan, entitled Van Dine Plaza dated March 19, 2009, last revised August 4,
2009, is hereby approved for construction. One set of the approved plan is enclosed for
your records. Any previously approved plans are voided with this approval. This approval
is for basic compliance with the General Water & Sewer Construction Specifications of
the Albemarle County Service Authority (ACSA) and does not relieve the contractor from
responsibility for his work as it relates to the plan and specifications.
The ACSA requires that a copy of the approved construction plan be on the job
site. The contractor is responsible for marking up a copy of the approved construction
plan showing as -built information and provide this data to your client at the completion of
utility installation. The final as -built plan shall be submitted in a format of one paper copy
and one mylar copy.
A preconstruction conference shall be scheduled with the project manager to
ensure coordination and answer any questions. This will be a short meeting to review the
project, materials, test methods and schedule, in order to expedite construction. Please
have the proper party call me at 977 -4511 to schedule the meeting.
This approval is valid for a period of 18 months from this date. If construction is
not in progress at the end of this time period, the approval shall be void. If you have any
questions, or if we can be of assistance, please give us a call at (434) 977 -4511.
