It is recommended that the frontage along Rio Road be dedicated to public use for a distance of 10 feet behind the existing curb for the turn lane that was constructed with the entrance to Fashion Square Mall. This area should have been dedicated as part of Rio Road at the time the turn lane was built to accommodate the necessary setbacks, clear zone and pedestrian facilities and to . ensure there was adequate space to maintain the road. It is also recommended that the sidewalk be constructed along to frontage of Rio Road. ] 2. A full engineering review of the site was performed due to the completeness of the plan set. A. Final Site Plan [SDP- 2009 - 00043] 1. Not all critical slopes are shaded on the existing conditions sheet. It appears that critical slopes are disturbed with this plan. If these slopes were created with a previously approved site plan, the slope disturbance can be waived administratively by the lead planner. If a previously approved plan cannot be found showing the creation of the disturbed slope, the waiver will havq be given by the Planning Commission. Regardless, please provide a letter requesting this waiver referring to all requirements detailed in Section 18 -4.2.5 of the Zoning Ordinance. The original site plan for Fashion Square Mall is SDP -125. The final site plan for the Shoppes at Wachovia is SDP -2006- 00066. Rev. 1) The critic¢ e waiver request has been received. Engineering review has no objection-to the eqictival of this waiver. 2. A plat must be recorded before this site plan can be approved. The plat should include at least the following: drainage easement for the pipe through the property, the private sanitary sewer easement onto TMP 61 -122A, the public water easement, and a site and grading easement for the parking and travelways on TMP 61 -132 (a boundary line adjustment would also suffice). A crosswalk and pedestrian signals will also be required across the mall entrance to make the connection safe. However,. improvements have not been proposed to upgrade the mall entrance intersection so that it could be better used by pedestrians. This intersection is a significant pedestrian safety hazard and. engineering review recommends that it be addressed with this plan. Although, engineering review fully recognizes that there is nothing within state or local law that allows for the absence of these improvements on the plan to delay any county approvals or permits. 7. The Erosion and Sediment control plan needs a phase II portion showing all fmal grades, structures, and hardscapes. Rev. 1) Please show all necessary ESC measures on Phase fl portion of the plan (silt fence, safety fence, inlet protection, construction entrance, permanent seeding, etc.). 2. The concept for the ESC plan shown is not acceptable. Since roughly the entire site drains to the existing DI -3C, inlet protection shown here should be sufficient. Since the drainage area to this inlet is likely between 1.5 and 1.75 acres a variance from the program authority will be required. The program authority will approve this variation if the applicant provides a sump in front of the inlet for settling, like the sediment trap inlet protection described on page III -37, in addition to the block and.gravel protection. Rev. 1) • Comment has been addressed. The inspector will give the contractor flexibility. in the field regarding the size of the trap. 3. The silt fence in the middle of the site adjacent to the construction entrance should be removed. All technical engineering comments had been addressed, but a document between CV and Shopping Center Associates was needed to address comment #A2. I hope what you already have covers all county concerns. Brett felt confident in the Thursday meeting in June that it would. Attached is a pdf of the area of most concern. With most sites, this would require consent from the adjacent landowner, but since these are existing parcels, the existing agreements may permit this. I also had them review our building permit application and status for that permit. 1.The county wants a copy of the parking / access easement between CV Associates and Shopping Center Associates /Simon in their possession before the site plan is approved and pre- construction scheduled for permit release 2.The Service Authority will sign off on the site plan approval for the county but will not schedule the Service Authority's pre- construction meeting for utility installation until their executed easement(s) is in their possession and approved. 3.VDOT has already signed off on the site plan for the county approval. Also, I was told this week by Joel Denunzio that Hans at the county said the county is going to build the sidewalk. If there are pending legal documents between Simon and VDOT, copies are not required prior to our site development permit with the county. 4.The county said it could be another 7 - 10 days before they finish the final civil package review. They have had procedural changes that went into effect 10 /01 and 07/01, so I was told this week that we will not be required to present mylars for signature and recordation. 5.I met with building staff reference our architectural plan approval and verified the total fee we need with our application and approved site plan is $2,531.71. 6.We need two copies of the site plan showing the proposed location of the construction trailer, an application and $75.90 fee. 7.County Bond execution is required before the pre- construction appointment with the county is scheduled and site permit released. 8.They will not release the address until at least the permits are issued and maybe not until the pad corners are certified. With the preliminary plan, engineering had reviewed the Erosion and Sediment Control Plan and had granted conditional approval based on one requested technical change. The latest revision of the ESC plan addresses that remaining comment and the ESC plan is hereby approved on the condition that the final site plan is approved. The following items must be addressed before engineering review can recommend approval to the final site plan. 1. The issue regarding the parking and access for the site and any existing agreement between this parcel and TMP 61 -132 must be resolved before the site plan can be approved. 2. It was recently discovered that the sidewalk along the frontage of Rio Rd. has also been included in the construction package for the Rio Road East improvement project being implemented by the County's Office of Facilities Development. However, the applicant must still include this sidewalk in the set as proposed without the note suggested in VDOT's October 1 email. If the site is completed and a certificate of occupancy is requested for the restaurant and, for whatever reason, the sidewalk along Rio Rd. is not built, the Zoning Administrator will have the option regarding whether this improvement will need to be bonded or not. (Gary confirmed that the note VDOT suggested would not be added to the plan.) The ESC plan was issued technical approval on 19 November 2009 (final approval is contingent upon final site plan approval). Our ordinance states that ESC plan approval expires one year from the date of plan approval. If a grading permit is not given before 19 November 2010, then the applicant may be required to submit the plan so that it may be re- reviewed (at the discretion of the existing Senior Engineer).
