(The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated based on further review.) [Each comment is preceded by the applicable reference to the Albemarle County Code.] Please provide a plan that identifies all changes for which review and approval is required (i.e. the dumpster pad, etc). Box 6585 Charlottesville, VA22906 RE: SDP 2008 —176 American Legion Post 74 Minor Site Plan Amendment Dear Mr. Smith, Since the approval of the original site plan and 2000 amendment, on -site changes have occurred. Some of which are results of Route 22 improvements, and some of changes made by either current or previous owners. In an attempt to understand exactly what changes had been made, and provide a baseline understanding of the site, an as -built site plan was requested in association with our review of the amendment your organization submitted. Such a plan was received 011 March 19, .2009. However, after performing an on -site field visit, it is clear the received as -built plan does not accurately reflect the site's existing conditions. An exhaustive list of discrepancies cannot be provided by this office, as that requires a complete field survey. However, some easily identified features that are not accurately represented on the received as -built plan are: [Please be aware that these comments are based on a field visit and not a survey. Other features on site are also different than shown 011 the approved plan. Staff has not commented on those items as they are not impacted by the proposed development of the site and were not identified as deficiencies of the site during the approval of a letter of Zoning Compliance (LZC 2004 -05) dated June 25, 2004.] A power pole is shown in the existing entrance travelway. It is noted to be relocated. The right -of -way and travel lanes for Route22.are clearly different than shown. The shed located at the rear of site does not appear on the plan. Existing grading on the south eastern portion of the property does not match that shown on the plan. Utilities across the front of the property appear to be different than as shown on the plan. In addition to the above items the site plan must be amended to show: [References to the applicable provisions of Chapter 18 of the Albemarle County Code are provided after each comment.] Travel aisle width has been reduced from 24 to 20 feet due to the construction of a planter. This requires that the parking spaces must be 10 feet wide. This will reduce the total amount of parking on site. The site plan shows 98 spaces. I have reviewed the clearance for the uses on site. Only 85 spaces are required so it appears that adequate parking will still be available. [4.12.16c]- - - - - -- The proposed location for the storage shed may not be approvable. The building must be setback 50 feet from any residential or rural zoned property or 30 feet from any public street right of way. The commercial zoning in this area extends to the center line of the railroad. Therefore, the building must be at least 50 feet from the center of the railroad right of way. [21.7] The height of the flagpoles must be provided (this height must include any ornamentation located at the top of the pole). The flagpoles must be setback from the property line and right of way a distance equal to or greater than the height of the pole. [4.10.3.1, 32.5 and 32.6] With the submittal of a plan accurately showing the features listed in the first portion of this letter (those features that exist on site but do not appear to be shown accurately), and providing the information in the latter portion of this letter the County can complete the review of the application. At this meeting a marked up copy of the plan was presented to them. When the issues highlighted on the plan are addressed the minor amendment may be approved. Requested a new plan accurately reflecting all Existing Conditions. Spoke with Kurt again. Updated on zoning violation issues with site and requested accurate Existing Conditions.
