SDP 2008 - 00178 Ntelos CV842 - West Ivy (Dickerson) - Final (Elizabeth Marrota) Sight lines need to be shown at the existing modified entrance. A Land Use Permit will be required for any proposed work within the Prescriptive Easement on Dry Bridge Road for the widening of the entrance. Although the existing Dry Bridge Road is a 30 foot prescriptive easement and the proposed bollard is outside of the easement, it should be placed at a minimum of 10 feet outside of the existing edge of the road to maintain a clear zone for the road. Please request the applicants provide a written description of revisions with re- submissions. You may or may not know that I have been cited for violation of the zoning ordinance and fines are accruing. As I understand it, the ARB portion of the site plan waiver request is the last piece that must be approved to put an end to the violation. The easements may take a few weeks to get in place — they will require a survey, plat, attorneys,etc. Based on the letters that you have received — one from Brian Smith saying that VDOT has given a verbal OK, and the other from Real Property about the meeting of the Clover Lawn HOA on 5/20 — is full completion of the easements necessary to complete the ARB portion of the site plan waiver request? Or, if the letters are adequate evidence that the processes are going forward, can the approval be communicated to Zoning as soon as possible, and can Zoning acknowledge the approval so that further fines can be avoided. He has sent it to Charles Baber at VDOT to get their approval. I understand that VDOT requires a deeded right of way for the storm drains. Mr. Baber has asked for one revision. Brian Smith has a copy of the plan, and we will be recording the deed as soon Mr. Baber gives the OK on the revision. We will submit our plat to the County next. Tucker , Griffin, Barnes is working on the legal aspects of the sale (title search, etc) and they expect to have their work completed next week. We hope to have everything wrapped up in the next 10 -14 days. Can you please speak to Amelia and see if they intend to proceed with the Court date on the 28 It is my understanding that once we complete all of the steps of the transaction, then our site plan waiver can be approved, and we are no longer in violation.
