Factors Favorable: Proposal meets the Factors Unfavorable: none identified requirements of Section 5.1.40 Recommendation: Section 5.1.40 Personal Wireless Facility- Staff recommends approval of this personal wireless service facility at the proposed height of seven (7) feet above the reference tree, with the conditions outlined by the Architectural Review Board. 1 STAFF CONTACT:Megan Yaniglos; Brent Nelson PLANNING COMMISSION:February 17, 2009 AGENDA TITLE:SDP 08 -180: Piedmont College- Alltel Tier II Personal Wireless Service Facility PROPERTY OWNER:University of Virginia Foundation APPLICANT:Kimberly Selz, Alltel Communications PROPOSAL: Request for approval of a treetop personal wireless service facility [Attachment A] with a steel monopole that would be approximately 90 feet tall (7 feet AMSL above the tallest tree within 25 feet), with a small platform for the equipment cabinets at the base of the tower, within a 1600 sq foot lease area. This application is being made in accordance with Section 10.2.1 of the Zoning Ordinance, which allows for Tier II wireless facilities by right in the Rural Areas. The property, described as Tax Map 77, Parcel 25, contains 157.486 acres is located in the Scottsville Magisterial District, and is zoned RA, Rural Areas. This parcel is separated by Interstate 64, and the proposed facility is located on the northern portion of the parcel to the north of I -64. COMPREHENSIVE PLAN: The Comprehensive Plan designates this property as Institutional in Urban Area 4. CHARACTER OF THE AREA: The parcel is intersected by Interstate 64 (1 -64) with the proposed facility located on the section of the parcel north of I -64 [Attachments B and G]. The lease area is situated at the edge of the lawn surrounding an existing residential structure. The property is adjacent to the City of Charlottesville, and the surrounding area is both urban and rural in character with open agricultural fields, mixed hardwood forest, single and attached family homes, and developments that include Piedmont Virginia Community College. STAFF COMMENT: Section 3.1 provides the following definitions that are relevant to this proposal: Tier H personal wireless service facility: A personal wireless service facility that is a treetop facility not located within an avoidance area. Treetop_ facility: A personal wireless service facility consisting of a self - supporting monopole having a single shaft of wood, metal or concrete no more than ten (10) feet taller than the crown of the tallest tree within twenty -five (25) feet of the monopole, measured above sea level (ASL), and includes associated antennas, mounting structures, an equipment cabinet and other essential personal wireless service equipment. Avoidance area: An area having significant resources where the siting of personal wireless service facilities could result in adverse impacts as follows: (i) any ridge area where a personal wireless service facility would be skylighted; (ii) a parcel within an agricultural and forestal district; (iii) a parcel within a historic district; (iv) any location in which the proposed personal wireless service facility and three (3) or more existing or approved personal wireless service facilities would be within an area comprised of a circle centered anywhere on the ground having a radius of two hundred (200) feet; or (v) any location within two hundred (200) feet of any state scenic highway or by -way. Section 5.1.40(d), "Tier II facilities" states: Each Tier IIfacility may he established upon commission approval of an application satisfying the requirements of subsection 5.1.40(a) and demonstrating that the facility will be installed and operated in compliance with all applicable provisions of this chapter, criteria (1) through (8) below, and satisfying all conditions of the architectural review board. The commission shall act on each application within the time periods established in section 32.4.2.6. The commission shall approve each application, without conditions, once it determines that all of these requirements have been satisfied. If the commission denies an application, it shall identifi' which requirements were not satisfied and inform the applicant what needs to be done to satisfi' each requirement. The applicant has submitted an application that satisfies the requirements set forth in Section 5.1.40(a) and has performed a balloon test at the location of the proposed facility [Attachment D]. The Architectural Review Board reviewed this request for compliance with the County's design guidelines for the entrance corridor and recommended approval with conditions Attachment E]. Section 5.1.40(d)(1): The facility shall comply with subsection 5.1.40(b) and subsection 5.1.40(c)(2) through (9). Staff has determined that the proposed facility's location complies with all of the exemptions of Section 5.1.40(b) and the proposed equipment meets all relevant design, mounting and size criteria set forth in Section 5.1.40(c)(2) and (3). The remainder of subsection (c) provides requirements that are subject to enforcement if the facility is approved. Section 5.1.40(d)(2): The site shall provide adequate opportunities for screening and the, facility shall be sited to minimize its visibility from adjacent parcels and streets, regardless of their distance from the facility. If the facility would be visible from a state scenic river or a national park or national forest, regardless of whether the site is adjacent thereto, the facility also shall be sited to minimize its visibility from such river, park or forest. If the facility would be located on lands subject to a conservation easement or an open space easement, the facility shall be sited to so that it is not visible . from any resources specifically identified for protection in the deed of easement. The proposed facility includes a monopole that would have a height of approximately 90 feet above ground level (AGL) or 487 feet above mean sea level (AMSL). The height of the reference tree is approximately 480 feet above mean sea level (AMSL) and is located 25 feet north of the proposed monopole. A balloon test was conducted on January 9, 2009 [Attachment D]. During the site visit, in an effort to avoid tree branches directly above the proposed tower location, the balloon was launched from a location approximately 30 feet southeast of the proposed monopole location. 3 The balloon was raised to the same elevation as the proposed pole, seven (7) feet above the reference tree. Staff considers the location of the balloon launch a sufficient approximation of the pole location. The balloon was visible for a short period of time from the westbound lane of I -64 at the approach to the State Route 20 South/Monticello Avenue exit, as well as, from the section of State Route 20 South between the entrance to Piedmont Community College and the I -64 interchange. The trees did not provide a backdrop for the balloon, so when it was visible, it was above the treeline in these sections. However, at the proposed elevation, seven (7) feet above the reference tree, the proposed monopole is not expected to have an adverse impact on either the I- 64 or State Route 20 South entrance corridors due to its limited visibility. It is also anticipated that the limited visibility of the monopole will be noticeably reduced while the trees are in full foliage. In addition, the ground equipment is not expected to be visible. The density of existing tree trunks to remain, along with the "Java Brown" color of the monopole and antennas, is expected to limit views of the facility. Section 5.1.40(d)(3): The, facility shall not adversely impact resources identified in the county's open space plan. Staffs analysis of this request addresses the concern for the possible loss of aesthetic or historic resources. The proposed lease area is not delineated as a significant resource on the Open Space and Critical Resources Plan [Attachment F]. Staff believes there is no significant loss of resources related to the installation of the tower. The County's wireless service facilities policy encourages facilities with limited visibility, facilities with adequate wooded backdrop, and facilities that do not adversely impact Avoidance Areas (including Entrance Corridors and historic resources). The proposed pole is expected to be visible for a relatively short period of time when traveling on State Route 20 South and I -64 entrance corridors]. As mentioned above, the degree of visibility is not expected to have a negative impact on the Entrance Corridor based on these findings. The Architectural Review Board has approved the location with conditions [Attachment E]. Therefore, staff feels the visibility of the monopole will not adversely impact the resources of the entrance corridor or historic districts. A tree conservation plan, with measures limiting the impacts to existing trees remain will be submitted prior to application for the building permit. Section 5.1.40(d)(4): The facility shall not be located so that it and three (3) or more existing or approved personal wireless service facilities would be within an area comprised of a circle centered anywhere on the ground having a radius of two hundred (200) feet. There is no existing personal wireless service facility located within an area comprised of a circle centered anywhere on the ground having a radius of two hundred (200) feet. Section 5.1.40(d)(5): The maximum base diameter of the monopole shall be thirty (30) inches and the maximum diameter at the top of the monopole shall be eighteen (18) inches. Notes on the site plan for this facility propose a monopole diameter not to exceed 30 inches at the base or 18 inches at the top. These dimensions comply with the maximum width 4 requirements for treetop monopoles serving Tier II facilities. Section 5.1.40(d)(6): The top of the monopole, measured in elevation above mean sea level, shall not exceed the height approved by the commission. The approved height shall not be more than seven (7), feet taller than the tallest tree within twenty-five (25) feet of the monopole, and shall include any base., foundation or grading that raises the pole above the pre - existing natural ground elevation; provided that the height approved by the commission may be up to ten (10) feet taller than the tallest tree if the owner of the facility demonstrates to the satisfaction of the commission that there is not a material difference in the visibility of the monopole at the proposed height, rather than at a height seven (7) feet taller than the tallest tree; and there is not a material difference in adverse impacts to resources identified in the county's open space plan caused by the monopole at the proposed height, rather than at a height seven (7), feet taller- than the tallest tree. The applicant may appeal the commissioner's denial of a modification to the board of supervisors as provided in subsection 5.1.40(d)(12). As mentioned previously in this report, the proposed monopole would have a height of approximately 487 feet above mean sea level (AMSL). The height of the reference tree is approximately 480 feet above mean sea level (AMSL). The proposed monopole will be seven (7) feet taller than the tallest tree within twenty -five (25) feet. Section 5.1.40(d)(7): Each wood monopole shall be a dark brown natural wood color; each metal or concrete monopole shall be painted a brown wood color to blend into the surrounding trees. The antennas, supporting brackets, and all other equipment attached to the monopole shall be a color that closely matches that of the monopole. The ground equipment, the ground equipment cabinet. and the concrete pad shall also be a color that closely matches that of the monopole, provided that the ground equipment and the concrete pad need not be of such a color if they are enclosed within or behind an approved structure, .facade or, fencing that: (i) is a color that closely matches that of the monopole; (ii) is consistent with the character of the area; and iii) makes the ground equipment and concrete pad invisible at any time ofyear from any other parcel or a public or private street. The applicant is proposing the installation of a facility with a steel monopole. The proposed color for the tower and equipment cabinets is a brown paint (Java Brown) to match existing surroundings. Section 5.1.40(d)(8): Each wood monopole shall be constructed so that all cables, wiring and similar attachments that run vertically from the ground equipment to the antennas are placed on the pole to face the interior of the property and away from public view, as determined by the agent. Metal monopoles shall be constructed so that vertical cables, wiring and similar attachments are contained within the monopoles structure. A note on the site plan indicates that vertical cables, wiring and similar attachments will be located inside the monopole. Section 704(a)(7)(b)(I)(II) of The Telecommunications Act of 1996: The regulation of the placement, construction and modification ofpersonal wireless facilities by any state or local government or instrumentality thereof shall not prohibit or have the effect of prohibiting the provision ofpersonal wireless services. 5 The Telecommunications Act addresses concerns for environmental effects with the following language, "No state or local government or instrumentality thereof may regulate the placement, construction, and modification of personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with the Commissions" regulations concerning such emissions." In order to operate the proposed facility, the applicant is required to meet the FCC guidelines for radio frequency emissions. These requirements will adequately protect the public health and safety. It is staff's opinion that the denial of this application would not have the effect of prohibiting the provision of personal wireless communication services. RECOMMENDATION: Staff recommends approval of this personal wireless service facility. Based on findings presented in the staff report, staff recommends approval at the proposed seven 7) feet above the reference tree with the conditions outlined by the Architectural Review Board. TIER II PERSONAL WIRELESS SERVICE FACILITY ALLTEL COMMUNICATIONS PIEDMONT COLLEGE" — UVA FOUNDATION PROPERTY Project Description: Alltel Communications, Inc. ( "Alltel "), respectfully requests approval to allow installation of a Tier II Personal Wireless Service Facility ( "PWSF" or "facility ") on a parcel of land located at 1800 Monticello Avenue and identified as Tax Map 77 -25 & 77- 25A1 (the "Property"). The Property contains 157.49 acres located in Albemarle County. The proposed PWSF facility will be contained within a 1,600 square foot lease area on the Property. The site is located at an elevation of approximately 397.8 feet Above Mean Sea Level (AMSL). The proposed PWSF will include a metal monopole, with a top height of 90 feet above ground level that will be fitted with three (3) flush - mounted antennas, a 4 -foot lighting rod and coaxial cables that will be run vertically inside the monopole. All ground -based transmitting equipment will consist of an equipment cabinet, 4.92' x 4.12' x 5.83' (W x L x H). The monopole and antennas will be painted with Sherwin Williams Java Brown - #6090, which is a matte enamel color that has been previously approved as an appropriate color for Tier II facilities at other sites in Albemarle County. 0 Network Objectives: This facility will provide coverage for the city of Charlottesville as well and I -64, VA 20, and VA 56. Character of the Area: The property is zoned Rural Areas (RA), and each of the surrounding properties share the same zoning designation. HQwever, the propoed PWSF will not substantially impact the rural character of the area d elq the fact that th ki.te lies in a wooded area that will provide screening of the site` d a uffer from nearb %properties. Access to the proposed PWSF will - pRv off State I .oute 20 using an existing paved driveway. Alltel will extend thed!ivfway approximately 60 -ft to access the PWSF. Highway 20 is a County- designate'd,+ ance corridor and therefore the tower must be set back 200 -ft from the right of way. The PWSF is set back 314 -ft from the Highway 20 right of way and is therefore outside of the avoidance areas designated in the zoning ordinance. Attachment C Compliance with Section 5.1.40 of the Zoning Ordinance: The County's specific design criteria for Tier II Facilities, set forth in Section 5.1.40(d), are addressed as follows: 5.1.40(d)(1) — The facility shall comply with subsection 5.1.40(b) and subsections 5.1.40(c)(2) through (9) o Subsection 5.1.40(b) (1 -5): The proposed PWSF will be in compliance with the Rural Areas setback regulations and all other area and bulk regulations and the minimum yard requirements are being met with this request. Alltel has also selected a location for the proposed monopole that meets the minimum required tower setback distance, which is equal to 100% of the structure's height from all parcel lines shared with adjoining lots. Furthermore, there are no public road rights -of -way within a distance equal to the monopole's height. The attached site drawings, antenna and equipment specifications are being provided to demonstrate that the PWSF regulations and the relevant site plan requirements, set forth in Section 32 of the zoning ordinance, will also be met with this application. 0 o Subsection 5.1.40(c)(2): The proposed monopole does note require the installation of guy wires, nor will it be fitted with any whip antennas without any further County approvals, The proposed grounding rod complies with the County's size requikeinents. The facility will have only one outdoor light fixture mounted on a 3" S6040,mount pipe that will only be sued by Alltel's technical operations staff doting times when maintenance of the site is necessary. The pro posed light -i, be fixed such that it will not shine at an angle than 90•.degreesiii5 n the ground. Alltel request approval to screen tlae + shelter with a chain link security fence.j¢ 0. lF o Subsection 5.1.40(c)(3): The proposed antenna conigttration will consist of one sector with three panel antennas (Amphenol Antel Model # BXA- 80063/4CF) that measures 47.4" x 11.2" x 5 ", giving each antenna an area of approximately 531 square inches. These antennas will be installed using "pipe- mounts" that will allow for any required amount of down- tilting without exceeding the County's requirements for flush - mounts (12- inches maximum between the face of the monopole and the face of the antenna). All antennas will be painted the same color as the monopole. 0 0 o Subsection 5.1.40(c)(4 and 5): Installation of the proposed PWSF and the extension of access from the end of the existing road will require the removal of some underbrush and small trees. However, none of the trees to be removed have heights similar to the proposed monopole, nor will they be crucial in camouflaging the site from adjacent parcels and nearby roads. Alltel has already contacted Big "0" Tree & Lawn Services, Inc. to prepare a tree conservation plan for the nearest Pecan tree referenced on the site layout and compound detail. The recommended conservation plan is attached in a letter from Big "0" Tree & Lawn Services, Inc. This plan will be integrated into the construction process. o Subsection 5.1.40(c)(6): Should use of the antenna site in this location become discontinued at anytime in the future, Alltel will be required to removed the facility within 90 days. o Subsection 5.1.40(c)(7): Alltel shall submit an annual report updating the user status and equipment inventory of the facility in the required time period. o Subsection 5.1.40(c)(8): No 2:1 or greater slopes will result from the Oconstruction of this facility. o Subsection 5.1.40(c)(9): Because the proposed facility will be located in remote area, Alltel proposed the installation ofa chain link security fence instead of a screening fence. The wooded area around the site will be more adequate to screen the facility and provide a camouflaging for the proposed tower when viewed from locations off of the property. Section 5.1.40(d)(3): The proposed PWSF should not impose any adverse impacts upon open space resources. Section 5.1.40(d)(4): Once constructed, Alltel 's PWSF will be the only PWSF located on the Property, and there are no existing facilities located with 200 feet in either direction of the site. 1 0 Section 5.1.40(d)(5): The monopole will have a base diameter that is a maximum of 30 inches and a top diameter that is no more than 18 inches. Section 5.1.40(d)(6): Alitel is requesting permission to install a monopole that will be seven feet higher than the reference tree. This reference tree has been identified as a 16 " -20" dbh Pecan tree that is approximately 25 feet away from the proposed location of the monopole. The ordinance states that the tree must be within 25 feet of the monopole. Alitel has consulted a certified arborist about the recommended distance the tower should be placed. A letter is included in this submission from John Jeffers, ISA Certified Arborist that states 25 -ft is the minimum distance that the proposed tower should be placed. Section 5.1.40(d)(7): The monopole and all antennas will be paintecl Williams Java Brown #6090. This is a color that has been applied to%previously approved PWSF monopoles. The proposed equipmentbinets will alo be painted this color. Section 5.1.40(d)(8): All coaxial cables and service lines ring yertically from the transmitting equipment to the antennas will be located i cie the .monopole. Section 5.1.40(d)(9 -13): Alitel has reviewed and understands all of the remaining criteria for Tier II Personal Wireless Service Facilities and wil,„' ovide any additional information or assistance to ensure these standards demet. Conclusion: Alltel is confident that the proposed Personal Wireless Service Facility meets the design criteria for approval of a Tier II facility and does not conflict with the goals and objectives of the Comprehensive Plan.
