Fritz, AICP PLANNING COMMISSION: March 15, 2011 SDP 2008 —154 Re- Store'n Station APPLICANT'S PROPOSAL: Convenience store with gas pumps and office space. CHARACTER OF AREA: Surrounding properties include the Moose Lodge, single family residential, and various commercial uses including convenience stores with gas stations. PLANNING AND ZONING HISTORY: June 8, 2010 — Planning Commission denied a buffer waiver request and deferred action on site plan. November 3, 2010 - SP 2009 -34 approved. This special use permit allowed 1,625 gallons of water usage a day. COMPREHENSIVE PLAN: This site is located in Rural Area 3 of the Comprehensive Plan. REASON FOR PLANNING COMMISSION REVIEW: An adjacent property owner has requested Planning Commission Review of the site plan. STAFF COMMENT: This is a request for approval of a preliminary site plan. The Site Review Committee has reviewed the site plan and found the plan meets the requirements for preliminary site plan approval. Two topics have been identified which the Commission may want to consider: 1. Entrance Location 2. Building Design Entrance Location The Department of Transportation has provided the following comments: 1. Since the initial submittal of this preliminary plan, VDOT has implemented Access Management Standards that went into effect on Oct. 14th, 2009. These standards set the minimum distances that commercial entrances must be spaced at for different speeds and functional classifications of roads and can be viewed on the VDOT website at hqp: / /www. virginiadot. org / /projects /accessmgt /default.asp. 2. The functional classification of Route 250 at the proposed Re- Store'n Station is Rural Minor Arterial with a posted speed of 45 mph. The minimum spacing for full access intersections is 1050 feet. 2 3. The proposed commercial access for Re- Store'n Station does not meet the minimum spacing standards from Freetown Lane and Forest Glen Dr. The applicant should attempt to consolidate commercial entrances to meet the spacing requirements. If the applicant is not able to consolidate entrances or meet the standards for any other reason, the applicant can submit an exception request to VDOT to allow a reduced standard. This exception would be evaluated by the local VDOT office and submitted to the VDOT District Administrator for review and decision. VDOT will also require a letter from Albemarle County in support of the exception in the evaluation of the entrance. The applicant has contacted the property owners that use Free Town Lane in an effort to consolidate entrances. As of the preparation of this report, the applicant has not been successful in those attempts. The applicant will need to continue to work with the Department of Transportation to identify an acceptable entrance location and design. Chapter 18, Section 32.7.2 of the Code of Albemarle states in part "the commission or the agent in the review of a site plan may specify the number, type, location and design of access points to a public street together with such measures as may be deemed appropriate to insure adequate functioning of such access points ". Staff recommends that this provision be addressed by a condition of approval. That condition would require Virginia Department of Transportation approval and that the Planning Commission review the entrance location as part of the final site plan. Building Design SP 2009 -34 included the following condition: "The total building footprint square footage shall not exceed three thousand (3,000) square feet ". The Deputy Zoning Administrator has determined that the building shown on the site plan exceeds the size permitted by the special use permit. The applicant will have to reduce the footprint of the building. The final site plan will not be approved until all the conditions of the special use permit have been satisfied. Additional Comments The plan has been reviewed by the Deputy Zoning Administrator and found to be in general accord with the plan submitted for the special use permit. The applicant has requested a waiver to allow the disturbance of the buffer to the rear of the site. The waiver is to allow stormwater requirements to be addressed. The waiver was administratively reviewed and approved subject to the installation of fencing as shown on the plan and the preservation of trees within the buffer that are 6 inches in diameter or larger. These trees shall be shown on the final site plan. Summary The site plan before the Planning Commission is a preliminary site plan and not a final site plan. The applicant will need to make changes to the plan in order to satisfy the requirements of the ordinance, the Department of Transportation, the special use permit and the conditions of approval. While the final location and design of the entrance and the building have not been determined, it is staff's opinion that the preliminary site plan should be approved. If the site plan is denied, the commission shall set forth in writing the reasons for such denial and shall state what corrections or modifications will permit approval by the agent or commission. Staff opinion is that the necessary corrections and modifications are specified in the conditions of approval. Approval with conditions eliminates the necessity of re- reviewing the preliminary site plan and achieves the same purpose as denying the preliminary site plan with the necessary corrections and modifications noted. RECOMMENDED ACTION: Staff has reviewed this request for compliance with the provisions of the Zoning Ordinance and recommends approval of the site plan subject to the following conditions: The Current Development Division shall not accept submittal of the final site plan for signature until tentative final approvals for the following conditions have been obtained. The final site plan shall not be signed until the following conditions have been met: Current Development Planner approval to include: a. Landscape plan showing landscaping as shown on the plan December 6, 2009. Except as permitted by the conditions of SP 2009 -34. b. Landscape plan showing location of all trees of 6 inch caliper or greater and including a conservation plan. c. Notation of location and type of pump stations and nozzles as limited by SP 2009 -34. d. Reduction of building size to satisfy the conditions of SP 2009 -34. The determination of building size shall be made by the Zoning Administrator. e. Location of signage limiting overnight parking. Overnight customer parking on -site shall not be permitted between the hours of 12:30 a.m. and 4:30 a.m. 2. Current Development Engineer approval to include: a. Erosion and Sediment Control plan. b. Stormwater management plan. 3. Albemarle County Building Official approval. 4. Thomas Jefferson Health Department approval. 5. Fire and Rescue Division approval. 6. Architectural Review Board approval. 7. Virginia Department of Transportation approval of entrance location and design. 8. COMPREHENSIVE PLAN: The Comprehensive Plan designates this property as Rural Area in Rural Area 3. CHARACTER OF THE AREA: The immediate surrounding properties include commercial uses, the Crozet Moose Lodge, and single - family residential properties. REASON FOR PLANNING COMMISSION REVIEW: The applicant has requested a waiver of Sec. 18- 21.7(c) in order to allow for land disturbance in a required twenty (20) foot buffer. Additionally, an adjacent landowner has requested Planning Commission review of the Preliminary Site Plan. PLANNING AND ZONING HISTORY: SP209 -34 Re -Store 'N Station — Request to use 1,625 gallons of water per day. Heard previously at this meeting. DISCUSSION: The Planning Commission must act on the following: 1. Waiver of Section 18- 21.7(c) — request to allow land disturbance in twenty (20) foot required buffer. 2. Sec. 18- 32.4.2 —Preliminary Site Plan. Waiver of Section 18- 21.7(c) Sec. 18- 21.7(c) states: No construction activity including grading or clearing of vegetation shall occur closer than twenty (20) feet to any residential or rural areas district. Screening shall be provided as required in section 32.7.9. Sec. 18- 21.7(c)1 allows the Planning Commission to waive the above standards as follows: In a particular case where the developer or subdivider demonstrates that grading or clearing is necessary or would result in an improved site design, provided that: (i) minimum screening requirements are met and (ii) existing landscaping in excess of minimum requirements is substantially restored. 1) Minimum standards for screening are identified by the following sections: Sec. 18- 32.7.9.8(c) states: Screening shall be required in the following instances: 1. Commercial and industrial uses shall be screened from adjacent residential and rural area districts. Sec. 18- 32.7.9.8(a) provides the following applicable requirements for screening: When required, screening shall consist of a planting strip, existing vegetation, a slightly opaque wall or fence, or combination thereof, to the reasonable satisfaction of the agent. When only vegetative screening is provided, such screening strip shall not be less than twenty (2) feet in depth. Vegetative screening shall consist of a double staggered row of evergreen trees planted fifteen (15) feet on center, or a double staggered row of evergreen shrubs planted ten (10) feet on center. Alternate methods of vegetative screening may be approved by the agent. The applicant proposes to locate required screening plantings in along the southern parcel boundary within an area designated as a required twenty (20) foot undisturbed buffer. In reviewing the Landscape Plan submitted with the Preliminary Site Plan (Page 10, Attachment B), staff believes there is sufficient space in the southern portion of the site to allow for the required screening plantings to be planted outside the required twenty (20) foot undisturbed buffer. Therefore staff does not believe the developer has "demonstrate[ed] that grading or clearing is necessary, or would result in an improved site design ". Preliminary Site Plan The Preliminary Site Plan meets requirements of Sec. 18 -32.5 RECOMMENDATION Staff recommends denial of the requested Buffer Disturbance Waiver found in Sec. 18- 21.7(c). Staff recommends approval of SDP2009 -154 re -Store `n Station — Preliminary site plan with the following conditions: 1. The Final Site Plan must meet all requirements of Sec. 18 -32.6; 2. The Final Site Plan must be in compliance with SP2009 -34 Re -Store `N Station; 3. The Final Site Plan receives VDOT approval; 4. The Final Site Plan receives Virginia Department of Health approval; 5. A Certificate of Appropriateness is granted by the ARB; and, 6. My hope is that the PC will support this and also that they will REQUIRE that the buffer plantings all be leyland cypress trees which will achieve the best screen possible rather than a variety of pretty trees that grow slower and may look more natural but not be as beneficial for screening. I met with the neighbors and most didn't care to discuss specific screening features that may benefit them. (Just wanted to make the whole thing go away) There was one person in the group that asked that I do whatever possible and for that person's benefit - this is the most effective buffer than can be achieved. Please confirm you received this and advise if you need any additional information. I assume this is not a big deal and it is completely up to the PC. The disturbance is limited to grubbing the stumps and clearing the vegetation so the new trees are planted in a clean strip without competition. If the PC does not grant the waiver and make the specific trees a requirement, it will be difficult to convince the ARB that the buffer plantings are a ZONING required landscape feature that is actually intended to be a wall of trees. CHARACTER OF AREA: Surrounding properties include the Moose Lodge, single family residential, and various commercial uses including convenience stores with gas stations. PLANNING AND ZONING HISTORY: June 8, 2010 — Planning Commission denied a buffer waiver request and deferred action on site plan. November 3, 2010 - SP 2009 -34 approved. This special use permit allowed 1,625 gallons of water usage a day. COMPREHENSIVE PLAN: This site is located in Rural Area 3 of the Comprehensive Plan. REASON FOR PLANNING COMMISSION REVIEW: An adjacent property owner has requested Planning Commission Review of the site plan. STAFF COMMENT: This is a request for approval of a preliminary site plan. The Site Review Committee has reviewed the site plan and found the plan meets the requirements for preliminary site plan approval. Two topics have been identified which the Commission may want to consider: 1. Entrance Location 2. Building Design Entrance Location The Department of Transportation has provided the following comments: 1. Since the initial submittal of this preliminary plan, VDOT has implemented Access Management Standards that went into effect on Oct. 14`", 2009. These standards set the minimum distances that commercial entrances must be spaced at for different speeds and functional classifications of roads and can be viewed on the VDOT website at http : / /www.virginiadot.org/proj ects /accessmgt /default.asp 2. The functional classification of Route 250 at the proposed Re- Store'n Station is Rural Minor Arterial with a posted speed of 45 mph. The minimum spacing for full access intersections is 1050 feet. 2 3. The proposed commercial access for Re- Store'n Station does not meet the minimum spacing standards from Freetown Lane and Forest Glen Dr. The applicant should attempt to consolidate commercial entrances to meet the spacing requirements. If the applicant is not able to consolidate entrances or meet the standards for any other reason, the applicant can submit an exception request to VDOT to allow a reduced standard. This exception would be evaluated by the local VDOT office and submitted to the VDOT District Administrator for review and decision. VDOT will also require a letter from Albemarle County in support of the exception in the evaluation of the entrance. The applicant has contacted the property owners that use Free Town Lane in an effort to consolidate entrances. As of the preparation of this report, the applicant has not been successful in those attempts. The applicant will need to continue to work with the Department of Transportation to identify an acceptable entrance location and design. Chapter 18, Section 32.7.2 of the Code of Albemarle states in part "the commission or the agent in the review of a site plan may specify the number, type, location and design of access points to a public street together with such measures as may be deemed appropriate to insure adequate functioning of such access points ". Staff recommends that this provision be addressed by a condition of approval. That condition would require Virginia Department of Transportation approval and that the Planning Commission review the entrance location as part of the final site plan. Building Design SP 2009 -34 included the following condition: "The total building footprint square footage shall not exceed three thousand (3,000) square feet ". The Deputy Zoning Administrator has determined that the building shown on the site plan exceeds the size permitted by the special use permit. The applicant will have to reduce the footprint of the building. The final site plan will not be approved until all the conditions of the special use permit have been satisfied. Additional Comments The plan has been reviewed by the Deputy Zoning Administrator and found to be in general accord with the plan submitted for the special use permit. The applicant has requested a waiver to allow the disturbance of the buffer to the rear of the site. The waiver is to allow stormwater requirements to be addressed. The waiver was administratively reviewed and approved subject to the installation of fencing as shown on the plan and the preservation of trees within the buffer that are 6 inches in diameter or larger. These trees shall be shown on the final site plan. Summary The site plan before the Planning Commission is a preliminary site plan and not a final site plan. The applicant will need to make changes to the plan in order to satisfy the requirements of the ordinance, the Department of Transportation, the special use permit and the conditions of approval. While the final location and design of the entrance and the building have not been determined, it is staffs opinion that the preliminary site plan should be approved. If the site plan is denied, the commission shall set forth in writing the reasons for such denial and shall state what corrections or modifications will permit approval by the agent or commission. Staff opinion is that the necessary corrections and modifications are specified in the conditions of approval. Approval with conditions eliminates the necessity of re- reviewing the preliminary site plan and achieves the same purpose as denying the preliminary site plan with the necessary corrections and modifications noted. 3 RECOMMENDED ACTION Staff has reviewed this request for compliance with the provisions of the Zoning Ordinance and recommends approval of the site plan subject to the following conditions: The Current Development Division shall not accept submittal of the final site plan for signature until tentative final approvals for the following conditions have been obtained. The final site plan shall not be signed until the following conditions have been met: Current Development Planner approval to include: a. Landscape plan showing landscaping as shown on the plan December 6, 2009. Except as permitted by the conditions of SP 2009 -34. b. Landscape plan showing location of all trees of 6 inch caliper or greater and including a conservation plan. c. Notation of location and type of pump stations and nozzles as limited by SP 2009 -34. d. Reduction of building size to satisfy the conditions of SP 2009 -34. The determination of building size shall be made by the Zoning Administrator. e. Location of signage limiting overnight parking. Overnight customer parking on -site shall not be permitted between the hours of 12:30 a.m. and 4:30 a.m. 2. Current Development Engineer approval to include: a. Erosion and Sediment Control plan. b. Stormwater management plan. 3. Albemarle County Building Official approval. 4. Thomas Jefferson Health Department approval. 5. Fire and Rescue Division approval. 6. This special use permit was approved based on the following conditions: 1. The applicant shall install and maintain a meter on the well head to monitor water consumption. Prior to installation, the model of the meter shall be subject to approval by the Zoning Administrator in conjunction with the County Engineer. Results of daily water consumption shall be made available within forty -eight (48) hours of a request from the Zoning Administrator; 2. Water consumption from all wells on site shall not exceed one thousand six hundred twenty -five 1,625) gallons per day in the aggregate; 3. The applicant shall install and maintain a tamper - proof, flow restriction device limiting water flow to not more than one thousand six hundred twenty -five (1,625) gallons per day. Prior to installation, the model of the flow restriction device shall be subject to approval by the Zoning Administrator in conjunction with the County Engineer; 4. The total building footprint square footage shall not exceed three thousand (3,000) square feet; 5. The hours of business operation shall not exceed sixteen (16) hours per day; 6. There shall be not more than seven (7) pump stations and twelve (12) nozzle dispensers, with not more than eight (8) nozzles for four (4) pump stations for gasoline (or equivalent fuel), with not more than two (2) nozzles for one (1) pump station for diesel fuel (or equivalent fuel), with not more than one (1) nozzle for one (1) pump station for off -road diesel fuel, and with not more than one (1) nozzle for one (1) pump station for kerosene fuel ; 7. If rainwater is collected from roof tops of the pump station canopies or the building, it shall be stored in a lined underground storage tank and utilized for on -site landscaping purposes only; 8. Overnight customer parking on -site shall not be permitted between the hours of 12:30 a.m. and 4:30 a.m. The applicant shall post signs indicating no such overnight parking in such places designated by the Site Plan Agent as a condition of final site plan approval; and, 9. WAA is a volunteer organization, formed in 2007, registered as a Virginia non -stock corporation and recognized by the Internal Revenue Service as a 501(c)3 tax exempt organization. WAA has secured the registration of the Greenwood -Afton Rural Historic District ( "GARHD ") as a Virginia Historic Landmark with the Commonwealth of Virginia through the offices of the Virginia Department of Historic Resources ( "VDW ). The GARHD encompasses about 14,000 acres, ranging from Yancey Mills in the east to Rockfish Gap and Attachment E Swannanoa in the west. The district runs from the Nelson County line in the south to the boundary of national forest and Skyline Drive in the north. VDHR has forwarded the application for the GARHD to receive designation on the National Register of Historic Places ( "NRHP "), and the responsible federal officials report that the NRHP approval can be expected in 30 -45 days. The purpose of this letter is to inform and remind the Board, the Commission and the Committee of several concepts which the WAA seeks to emphasize as the county undertakes review of any zoning changes, special use permits or the like that might affect the GARHD, directly or indirectly. The WAA intends to closely monitor any county actions that we feel might be detrimental to the interests of the GARHD. First, most obviously and most importantly, the district was recognized as a rural historic district. Each submission for NRHP designation must contain a narrative of the historical significance of the proposed property. The GARHD narrative points directly to the history of the area as an important agricultural resource (especially fruit orchards in the late 19 and early 20'' century), a significant tourism and leisure resource (late 19 /early 20 c) and a repository of distinctive architecture from the Country House movement of the early 20 century. All of the historical significance, therefore, derives from an historical background which emphasizes open and unimproved land. Second, the GARHD abuts the Crozet development area, and given the historical rationale for the district, any expansion of the growth area would directly and completely contradict the designation. Similarly, the approval of any significant rezoning in or near the GARHD would severely undercut the historical meaning of the place. Thus, any further discussion of the (ill- advised) Yancy Mills light industrial project makes no sense. This land is in the district. Even a casual review of the sprawl around the Zion Crossroads interchange at 64 will show how one commercial project will set off a firestorm of adjoining development. Third, the enabling legislation for the NRHP contains a requirement that any project with federal involvement undertaken in or near a NRHP property or district must be subject to a so- called "Sec. 106" review. Such a review is mandated for both NHRP properties as well as for NB RP-eligible properties. 2 Attachment E GARHD is NHRP eligible today (as a result of the VDHR recognition), and, as noted above, will receive official NHRP designation shortly. Sec. 106 review is required in any situation where the project to be undertaken has, any federal involvement, either through permits (e.g., Army Corps of Engineers, EPA) or, importantly, any direct or indirect federal funding (e.g., matching funding from the Federal Highway Administration for any road improvement.) The materiality of the federal involvement is not dispositive; a single federal permit or a single dollar of federal funding calls the Sec. 106 review. The regulations for Sec. 106 review can be found at 36 CFR Part 800. These regulations impose the requirement for review and mandate the process, procedures and standards for the review prior to initiation of the project. Without completely recapitulating the regulations, the gist of the process is to require the federal agency to identify and to mitigate any "adverse effects" of the proposed project on the historic property. In turn, such adverse effects are broadly defined; 36 CFR 800.5(a)(1) states, in relevant part: "...an adverse effect is found when an undertaking may alter, directly or indirectly, any of the characteristics of a historic property that qualify the property for inclusion in the National Register..." (Emphasis added.) The regulations go on to cite examples of adverse effects, again sweeping broadly, to include "...(i)ntroduction of visual, atmospheric or audible elements that diminish the integrity of the property's significant historic features." (36 CFR 800.5 (a)(2)(v)) The federal agency must involve both the Advisory Council on Historic Preservation (an independent federal agency) as well as other consulting parties. Sec. 800.2 (c) would grant to WAA the status of consulting party in any Sec. 106 review of a project in or adjoining the GARUD. In addition, the same section grants a general right of consultation to the public at large. This is particularly relevant in relation to the gas station project which adjoins Freetown. Again, this parcel is within the confines of the GARHD. We understand that VDOT requires that the rights of way for the gas station and Freetown be consolidated to prevent additional traffic congestion confusion ?) at the confluence of Freetown and WAHS. Leaving aside the 3 Attachment E wisdom of approving any special use permit for a gas station that is literally next door to another (Brownsville Market) and across the street from yet another (Exxon), let us remind the Board (and the staff) than any road construction in this spot that involves any federal monies will require a Sec. 106 review. If this is the case, WAA reiterates broad definition of adverse consequences as cited above. In addition, the Board and the staff must carefully review the EPA - mandated permitting of underground storage tanks associated with any petroleum distribution facility. The Resource Conservation and Recovery Act of 1976 ( "RCRA ") (42 USC 6901 et seq.) is the enabling federal legislation that requires federal permitting of underground storage tanks. EPA has promulgated regulations at 40 CFR Part 280, 281 that require states to design and implement state permitting processes for underground storage that conform to federal regulations. The Commonwealth has such a permitting mandate. Tellingly, 9VAC 25- 580 -50, which contains the permitting requirement, cites as its statutory authority the federal EPA regulations (again, 40 CFR Parts 280 and 28 1) which derive from RCRA. Therefore, a Sec. 106 review is required for any underground storage tank in a NHRP- eligible location such as the GARHD. The state in this case acts only as an instrumentality to enforce federal permitting requirements. We would also point the Board to the very instructive Case Digests as published by the Advisory Council on Historic Preservation. There are numerous cases, including some in the Commonwealth -(see, for - example, the discussion of Bishops Run in Summer 2006) where the ACHP has in- vestigated development on parcels adjoining historic properties to establish that the indirect effects of such development may adversely affect an historic resource. This would clearly be the case if commercial development and the attending noise, traffic, light pollution, wastewater runoff was allowed next door to an important contributing resource (like Freetown) inside an historic district. In summary, WAA has worked hard to obtain appropriate recognition for the irreplaceable historic resources within the GARHD. PLANNING AND ZONING HISTORY: Lune 8, 2010 — Planning Commission denied a buffer waiver request and deferred action on site plan. November 3, 2010 - SP 2009 -34 approved. This special use permit allowed 1,625 gallons of water usage a day. COMPREHENSIVE PLAN: This site is located in Rural Area 3 of the Comprehensive Plan. REASON FOR PLANNING COMMISSION REVIEW: An adjacent property owner has requested Planning Commission Review of the site plan. STAFF COMMENT: This is a request for approval of a preliminary site plan. The Site Review Committee has reviewed the site plan and found the plan meets the requirements for preliminary site plan approval. Two topics have been identified which the Commission may want to consider: 1. Entrance Location 2. Building Design Entrance Location The Department of Transportation has provided the following comments: 1. Since the initial submittal of this preliminary plan, VDOT has implemented Access Management Standards that went into effect on Oct. 14 2009. These standards set the minimum distances that commercial entrances must be spaced at for different speeds and functional classifications of roads and can be viewed on the VDOT website at bli / /www.viri niadot.orroL cis /accessm; ,t /def ault.ast 2. The functional classification of Route 250 at the proposed Re- Store'n Station is Rural Minor Arterial with a posted speed of 45 mph. The minimum spacing for full access intersections is 1050 feet. 1) I. The proposed commercial access for Re- Store'n Station does not meet the minimum spacing standards from Freetown Lane and Forest Glen Dr. The applicant should attempt to consolidate commercial entrances to meet the spacing requirements. If the applicant is not able to consolidate entrances or meet the standards for any other reason, the applicant can submit an exception request to VDOT to allow a reduced standard. This exception would be evaluated by the local VDOT office and submitted to the VDOT District Administrator for review and decision. VDOT will also require a letter from Albemarle County in support of the exception in the evaluation of the entrance. The applicant has contacted the property owners that use Free Town Lane in an effort to consolidate entrances. As of the preparation of this report, the applicant has not been successful in those attempts. The applicant will need to continue to work with the Department of Transportation to identify an acceptable entrance location and design. Chapter 18, Section 32.7.2 of the Code of Albemarle states in part "the commission or the agent in the review of a site plan may specify the number, type, location and design of access points to a public street together with such measures as may be deemed appropriate to insure adequate functioning of such access points ". Staff reconunends that this provision be addressed by a condition of approval. That condition would require Virginia Department of Transportation approval and that the Planning Commission review the entrance location as part of the final site plan. Building Design SP 2009 -34 included the following condition: ""[The total building footprint square footage shall not exceed three thousand (3,000) square feet". The Deputy Zoning Administrator has determined that the building shown on the site plan exceeds the size permitted by the special use permit. The applicant will have to reduce the footprint of the building. The final site plan will not be approved until all the conditions of the special use permit have been satisfied. Additional Comments The plan has been reviewed by the Deputy Zoning Administrator and found to be in general accord with the plan submitted for the special use permit. The applicant has requested a waiver to allow the disturbance of the buffer to the rear of the site. The waiver is to allow stormwater requirements to be addressed. The waiver was administratively reviewed and approved subject to the installation of fencing as shown on the plan and the preservation of trees within the buffer that are 6 inches in diameter or larger. These trees shall be shown on the final site plan. Summary The site plan before the Planning Commission is a preliminary site plan and not a final site plan. The applicant will need to make changes to the plan in order to satisfy the requirements of the ordinance, the Department of "Transportation, the special use permit and the conditions of approval. While the final location and design of the entrance and the building have not been determined, it is staff s opinion that the preliminary site plan should be approved. If the site plan is denied, the commission shall set forth in writing the reasons for such denial and shall state what corrections or modifications will permit approval by the agent or commission. Staff opinion is that the necessary corrections and modifications are specified in the conditions of approval. Approval with conditions eliminates the necessity of re- reviewing the preliminary site plan and achieves the same purpose as denying the preliminary site plan with the necessary corrections and modifications noted. 3 RECOMMENDED ACTION Staff has reviewed this request for compliance with the provisions of the Zoning Ordinance and recommends approval of the site plan subject to the following conditions: The Current Development Division shall not accept submittal of the final site plan for signature until tentative final approvals for the following conditions have been obtained. This special use permit was approved based on the following conditions: 1. The applicant shall install and maintain a meter on the well head to monitor water consumption. Prior to installation, the model of the meter shall be subject to approval by the Zoning Administrator in conjunction with the County Engineer. Results of daily water consumption shall be made available within forty -eight (48) hours of a request from the Zoning Administrator; 2. Water consumption from all wells on site shall not exceed one thousand six hundred twenty -five 1,625) gallons per day in the aggregate; 3. The applicant shall install and maintain a tamper - proof, flow restriction device limiting water flow to not more than one thousand six hundred twenty -five (1,625) gallons per day. Prior to installation, the model of the flow restriction device shall be subject to approval by the Zoning Administrator in conjunction with the County Engineer; 4. The total building footprint square footage shall not exceed three thousand (3,000) square feet; 5. The hours of business operation shall not exceed sixteen (16) hours per day; 6. There shall be not more than seven (7) pump stations and twelve (12) nozzle dispensers, with not more than eight (8) nozzles for four (4) pump stations for gasoline (or equivalent fuel), with not more than two (2) nozzles for one (1) pump station for diesel fuel (or equivalent fuel), with not more than one (1) nozzle for one (1) pump station for off -road diesel fuel, and with not more than one (1) nozzle for one (1) pump station for kerosene fuel ; 7. If rainwater is collected from roof tops of the pump station canopies or the building, it shall be stored in a lined underground storage tank and utilized for on -site landscaping purposes only; 8. Overnight customer parking on -site shall not be permitted between the hours of 12:30 a.m. and 4:30 a.m. The applicant shall post signs indicating no such overnight parking in such places designated by the Site Plan Agent as a condition of final site plan approval; and, 9. Development of the site shall be in general accord with the submitted preliminary site plan dated December 6, 2009. Permitted modifications may include those required by the Architectural Review Board, those necessary to satisfy the conditions of this special use permit, and additional landscaping /screening approved by the Site Plan Agent. Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property as approved above may lawfully begin until all applicable approvals have been received and conditions have been met. My conclusions regarding compliance with two of the SP conditions are: Whether the latest site plan is in general accord with the December 9, 2009 plan: Due to the facts that: the overall character of the development is essentially the same; the main elements are still present and in the same relative areas; impervious coverage is less, and; open space is increased, from the earlier plan, 1 have concluded that the newly submitted preliminary site plan, dated December 13, 2010 is in general accord with the "submitted preliminary site plan dated December 9, 2009" as called for in the approval conditions for the special use permit for water use (attached). Whether the development as proposed meets condition 44 limiting building footprint: The latest building proposed for the Re- Store`N Station is a two storey structure with approximately 3,000 sq. ft. of interior floor space on each level and a 10 ft. deep, two - storey covered porch along just over three sides, supported by columns. Condition H4 of the SP approval states: "The total building footprint square footage shall not exceed 3,000 square feet; " The Albemarle County 'Zoning Ordinance does not define "building footprint ". However, it does define "Building " as: "Any Structure having a roof supported by columns or walls." (emphasis added) The Building Code does not define "building footprint ".
