Dear Mr. Hopkins:
In response to your additional request concerning the above referenced parcel's
compliance with applicable codes, regulations and ordinances, please be advised as
follows:
The property is zoned Highway Commercial (HC) under the zoning ordinance
of the County of Albemarle. The HC district permits intensive retail uses to
include food and grocery stores and banks by right. The property is located in
the Entrance Corridor Overlay District (EC) and is subject to the rules and
regulations regarding this district.
As of this date, this parcel is not the subject of any zoning amendments and is
not subject to such proffers that would have been imposed on the property.
The parcel is the subject of an approved site plan, SDP1996 -133, amended
March 5, 2004, May 7, 2008, March 16, 2009, March 20, 2009 and June 12,
2009 which allowed the development of a 56,033 sq.ft. shopping center
served by 249 parking spaces and the addition of a bank with 11 parking
spaces for a total parking requirement of 260 on -site spaces. A special use
permit was approved February 11, 2009 for the drive -thru windows /lanes at
the bank.

The Property actually contains 254 parking spaces, which is 6 short of the
stated requirement. The notations on the approved site plan do not
coincide with the actual number of spaces shown on the site plan sheet SP2
or with those actually on the site. Upon inspection on March 18, 2011 the 254
spaces on -site was confirmed. A parking modification request was made on
April 5, 2011 and approved on April 15, 2011 to permit the 254 spaces to
meet the requirement for the site.
The Property is in compliance with all applicable zoning ordinances, rules and
regulations, including parking requirements, based on the final zoning
inspection(s) and the above referenced modification.
This letter may be relied upon by the addressee(s) listed above and by any assignee
or successor in interest of the addressee(s) listed above, and by any other person
who has a current or future interest in the property whether as owner or mortgagee.
I am authorized and empowered to execute this Zoning Compliance Letter on behalf
of the County of Albemarle. If you have any questions or concerns, please do not

Dear Mr. Shank:
This is in response to your April 5, 2011 letter requesting a parking determination that
would modify the total parking required for the Blue Ridge Shopping Center from 260
spaces to 254 spaces. Your request is supported by an analysis of another shopping
center owned by Great Eastern Management and the use pattern of the existing, built -
out, Blue Ridge Shopping Center. After reviewing this information in addition to the
Albemarle County Zoning Ordinance, it is my determination that Blue Ridge Shopping
Center at 540 -550 Radford Lane along Route 250, Rockfish Gap Turnpike can operate
with a total of 254 spaces as outlined in your letter.
This determination is based on the following:
1. The parking analysis provides some evidence that the ratio of parking spaces to
gross square footage is more in line with the larger center owned by the
applicants which used 4.5 spaces per thousand square feet of building but still
does not occupy much more than 70% of the spaces provided.
2. The existence of a restaurant, open during nighttime hours when other stores are
not, provides a reasonable balance between daytime and nighttime uses and the
ability to share spaces without conflict in peak needs. The isolation of the
shopping center site also confines the parking impacts to the site.
I am closing this letter with our standard appeal language so that this determination can
be considered final if not appealed. If you have any further questions, please do not
hesitate to contact me.

If you are aggrieved by this determination, you have a right to appeal it within thirty
30) days of this notice, in accordance with Virginia Code § 15.2 -2311. If you do not
file a timely appeal, this determination shall be final and unappealable.
An appeal may be taken only by filing an appeal application with the Zoning
Administrator and the Board of Zoning Appeals, in accordance with § 34.3 of the Zoning
Ordinance, along with a fee of $240 plus the actual cost of advertising the appeal for
public hearing.
Applications for Appeal of the Zoning Administrator's Determination are available at the
Department of Community Development located at 401 McIntire Road, Charlottesville,
Virginia 22902 or online at www.albemarle.org /cdapps. This form applies to the appeal
of a decision of the zoning administrator or any other administrative officer pertaining to
the Zoning Ordinance.

It must be noted that the Property currently contains 254 parking spaces,
which is actually 6 short of the requirement. It appears that the notations on
the site plan sheet SP1 do not coincide with the actual number of spaces
shown on sheet SP2 (or those actually on site). Upon inspection of the site
on March 18, 2011 the 254 spaces on -site was confirmed. However it does
appear that not all parking is being routinely used. This discrepancy could be
resolved by applying for a parking modification for approval of the 254
spaces.
The Property is in compliance with all other applicable zoning ordinances,
rules and regulations, based on final zoning inspection(s).
This letter may be relied upon by the addressee(s) listed above and by any assignee
or successor in interest of the addressee(s) listed above, and by any other person
who has a current or future interest in the property whether as owner or mortgagee.
