PROPOSAL
Request for preliminary site plan approval for the use of an existing 1,485 square foot building as a
neighborhood coffee shop /cafe in the new Downtown Crozet District. The property, described as Tax Map
56A1, section 1, and Parcel 120 is located in the Whitehall Magisterial District on Crozet Avenue [State Route
810] approximately 200 feet from the intersection of Crozet Avenue [State Route 8101 and Three Notch'd Road
State Route 240]. The property is zoned Downtown Crozet District and EC Entrance corridor. The
Comprehensive Plan designates this property as Development Area Preserve [CT 11 in the Crozet Community.
Along with the proposed preliminary site plan, the applicant, in writing, requested a waiver from sidewalk
design requirements found in the Downtown Crozet District [Section 20B.7.(A)] Sidewalk Design, which
requires a 10 foot sidewalk along Crozet Avenue [State Route 810]. The agent denied the waiver because
the request did not demonstrate that (i) the Virginia Department of Transportation prohibits establishing
sidewalks and /or planting street trees; or (ii) existing utility easements prohibit establishing sidewalks
and /or planting street trees.
The applicant is appealing the agent's denial of the waiver from sidewalk requirements to the planning
commission per Section 20.3.I.3. The request is for a waiver from Section 20B.7.(A) Sidewalk design,
which requires a 10 foot sidewalk along Crozet Avenue [State Route 810].
COMPREHENSIVE PLAN
This property is located in the Development Area Preserve [CT 1] in the Crozet Community.
CHARACTER OF AREA
The lot has a single structure with accompanying accessory buildings, and is partially wooded with a creek in
the rear.
PLANNING AND ZONING HISTORY
No planning and Zoning History.
REASON FOR PLANNING COMMISSION REVIEW
This application is coming before the Planning Commission in accordance with section 20B.3.(I).(3). Appeal to
the commission or the board. which states that the denial of a waiver, or the approval of a waiver with
conditions objectionable to the applicant, may be appealed from the director to the commission and from the
commission to the board, as the case may be, as an appeal of a denial of the plat, as provided in section 14 -226
of the Code, or the site plan, as provided in sections 32.4.2.7 or 32.4.3.9 of this chapter, to which the waiver
pertains.
Staff analysis is provided below. Section 20B.7.(A) establishes the review process for sidewalk design and
Section 20B.7. (D) establishes the process for granting waivers from sidewalk requirements. The preceding
comments by staff address the provisions of Section 20B.7.(A). Staff has included the provisions of section

20B.7. (D) (In bold italics) below, along with staff comment on the various provisions /criteria required for a
waiver from sidewalk requirements.
REVIEW OF REQUEST FOR WAIVERS FROM SIDEWALK REQUIREMENTS:
Pursuant to Section 20B.7.(A) of the Albemarle County Code, each sidewalk on Crozet Avenue, Three Notch'd
Road and the street identified in the Crozet master plan as the new Main Street shall be at least ten (10) feet
wide.
20B.7 SIDEWALKS AND STREET TREES
For each development requiring approval of a site plan under section 32 of this chapter, sidewalks and street
trees in the DCD shall be provided as follows:
A. Sidewalk design. Each sidewalk proposed to be accepted for maintenance by the Virginia Department of
Transportation shall be designed and constructed according to Virginia Department of Transportation
standards or to the standards in the design standards manual, whichever is greater. Each sidewalk proposed to
be privately maintained shall be constructed using concrete, designed so that no concentrated water flow runs
over them, and otherwise satisfy the standards in the design standards manual. Each sidewalk on Crozet
Avenue, Three Notch'd Road and the street identified in the Crozet master plan as the new Main Street shall be
at least ten (10) feet wide. All other sidewalks shall be at least eight (8) feet wide.
Section 2013.7. (D), Waivers from sidewalk requirements states that in accordance with the procedures stated
in subsection 20B.3 (I), the agent may waive the requirements for a sidewalk and/or street trees where the
developer demonstrates that:
i) The Virginia Department of Transportation prohibits establishing sidewalks and /or planting street trees;
The applicant/developer has not demonstrated that the Virginia Department of Transportation prohibits
establishing sidewalks and /or planting street trees in this area. [VDOT] Virginia Department of Transportation
does not prohibit the establishing of sidewalks and /or planting street trees in this area.
ii) Existing utility easements prohibit establishing sidewalks and /or planting street trees.
There are no existing utility easements that prohibit establishment of a 10 foot sidewalk.
Upon reviewing the sidewalk waiver request based on the above criteria, staff denied the waiver. Staff can not
recommend approval because the applicant does not meet the criteria specified in section 20B.7.(D) for granting
waivers from sidewalk requirements. Staff recommends denial.
ADDITIONAL STAFF COMMENTS:
The applicant has cited site constraints in the attached letter of appeal (Attachment C) dated October 19` 2008
as justification why the waiver from sidewalk requirements should be approved. As stated in the letter of
appeal, based on the ordinance, staff lacks the authority to grant this waiver. The Downtown Crozet
District section of the Zoning Ordinance outlines specific criteria for granting waivers from sidewalk
requirements. Staff denied the waiver from sidewalk requirements based on the criteria outlined in the
ordinance. The Planning Commission has the discretion of approving or denying the waiver. Should the
Planning Commission choose to approve the waiver from sidewalk requirements, staff would support the
Planning Commission's decision.
Factors unfavorable to this request include:
1. Virginia Department of Transportation does not prohibit the establishing of sidewalks and /or planting
street trees in this area.
2. There are no existing utility easements that prohibit establishment of a 10 foot sidewalk.
Factors favorable to this request include
None identified.
Recommendation: Denial of the waiver from sidewalk requirements.

To Whom It May Concern:
On behalf of my client, Green House Coffee, LLC, I respectfully request the Albemarle
County Commission hear an appeal of the denial of a waiver from sidewalk
requirements rendered by the Department of Community Development on October 6,
2008 (see attached). The requested waiver from the sidewalk width requirements of the
Downtown Crozet Zoning District would allow the existing sidewalk in front of the
proposed establishment to remain its current 4' width, rather than being widened to 10'.
As shown in the attached pictures, our site is fairly narrow, so the section of sidewalk to
be widened would only be 50' long, and could not be widened along the adjacent
properties (there is a tall retaining wall on one property, and the other property is
entirely within a protected stream buffer that precludes development). Widening our
section of sidewalk would result in additional impervious surface within a watershed
stream buffer, would be aesthetically unappealing, and could present a safety issue
since half the sidewalk would terminate directly into the existing retaining wall).
During our October 9th meeting with the County, Mr. Gerald Gatobu noted that his
department supports our waiver request, but lacks the authority to grant this waiver. We
would therefore like to speak to the Planning Commission at the earliest time to discuss
this waiver request.
