APPLICANT'S PROPOSAL:
Proposal for a waiver to zoning ordinance section 32.2.2, Site Plan requirements. The request is a waiver
of the requirement for the drawing of a full-blown site plan. [Attachment C].
COMPREHENSIVE PLAN:
The Comprehensive Plan designates this property as Rural Area in Rural Area 3.
REASON FOR PLANNING COMMISSION REVIEW:
The applicant has requested a waiver of zoning ordinance requirements to allow the submittal of a site
plan that does not meet all the requirements for the drawing of a site plan. The site plan submitted meets
all of the requirements and shows all the required information except as follows:
1. 18-32.6.6(d)- Detailed construction drainage and grading plans
The use requires a site plan because it has expanded from farm winery to also include on -premise sale of
wine and wine consumption.
DISCUSSION:
Section 32.2.2 states: The foregoing notwithstanding, after notice in accordance with section
32.4.2.5, the commission may waive the drawing of a site plan in a particular case upon a
finding that the requirement of such plan would not_forward the purposes of'this chapter or
otherwise serve the public interest: provided that no such waiver shall be made until the
commission has considered the recommendation of the agent. The agent may recommend
approval, approval with conditions, or denial of such waiver. In the case of conditional
approval, the agent in his recommendation shall state the relationship of the recommended
condition to the provisions of this section. No condition shall be imposed which could not be
imposed through the application of the regulations of section 32.0.
The site review committee has reviewed this request and is able to support the use of a site plan waiver
in this case. The entrance road, parking, and building on the site are existing [Attachment A]. VDOT
has approved the entrance with the condition that the entrance be paved to the right-of-way. The area to
be used requires no grading. Staff has approved it as a gravel parking area.
An adjacent owner has expressed concern that the existing road, Newtown Road [State Route 690] is not
adequate to carry the traffic that will be generated by the proposed use of the vineyard. However, the
county can not require any off-site improvements for the by right use of the property.
The applicant has also requested a number of waivers that have been granted administratively based
upon the nature of the use and its location within the rural areas. These administrative waivers are
provided for in Section 4.12.2 (c)(2) of the Zoning Ordinance:
2. The zoning administrator may modify or waive a design requirement in section
4.12.15, 4.12.16, 4.12.17, 4.12.18, and 4.12.19 only after consultation with the county engineer,
who shall advise the zoning administrator whether the proposed waiver or modification would
equally or better serve the public health, safety or welfare.

Based on the recommendations of the site review committee and the limited work required to establish
this use, staff recommends approval of a site plan waiver.

To whom it may concern,
Please accept this as a letter of waiver for the attached list of ordinance
requirements for the Pollak Vineyards Site Plan Document. As we sited the 1 acre Farm
winery project well within the interior of our 98 acre estate many of the requirements
seem unusual and extreme to the project. It was our intention to minimize impact on our
neighboring parcels and environment by siting the building well away from any
bordering property and keeping vineyards between the building and closest neighboring
parcels. we have built the building away from any public roads for the same reason. It is
our goal to further agriculture in the region and hope to maintain the rural aspect of our
property as an integral part of our agricultural responsibility, we have shown the area
affected and surrounding acreage of the project on the plan and wish not to include
distant parcels and boundaries.
Pollak Vineyards would also ask that the site plan be pre -approved prior to
completion with the stipulation and understanding that all planning commission required
ordinance data be included on the final document by signature time. we are pushing an
opening deadline for this spring and would like to move quickly through the process by
any acceptable means. The cost of multiple additions and corrections to a document of
this size is costly both in time and financially burdensome to a company ofour size.
Please take this into consideration as we go forward.
