Dear Sir:
The Planning Commnission, at its October 10, 2006 meeting, granted approval of your request for the
following waivers and the preliminary site plan. Section 4.2.3 for disturbance of critical slopes and Section
4.7 for the Appropriateness of the Open Space with the following conditions:
I . [13.4. 1 ] Prior to final approval a Conservation Plan as specified in section 32.79, must be approved by the
Zoning & Current Development Division of the Department of Community Development with a copy of
the original Conservation Plan and all subsequent revisions to be submitted to the Zoning & Current
Development Division.
2. [14 -317, 18 -4.7] Prior to final approval the applicant must submit covenants or other such instrument,
which evidences the establishment of an owners' association and provides for ownership and maintenance
of proposed open space. Such document shall be subject to County Attorney review and approval and shall
be in accordance with Section 14 -317 of the Subdivision Ordinance - Instrument evidencing maintenance
of certain improvements.
3. Zoning & Current Development Planning approval.
4. Zoning & Current Development Engineering approval.
5. Albemarle County Fire Rescue approval.
6. Albemarle County Service Authority approval.
7. Virginia Department of Transportation approval.
S. The final site plan shall show the "Potential Tree Save Areas" identified in paragraphs 2a and 2b of the
agreement between North Pantops Townhouses LLC, Southern Development, Westminster- Canterbury of
the Blue Ridge and the Westminster- Canterbury of the Blue Ridge Residents' Association dated October
3, 2006 (hereinafter, the "Agreement "). A tree conservation plan for the Potential Tree Save Areas shall
be submitted to the Zoning & Current Development Division for approval. The number of parking spaces
shall be reduced as provided in paragraph 2c of the Agreement to the extent that such reduction complies
with the minimum parking requirements of section 18 -4.12. The landscaping plan shall include all of the
planting required by paragraph 2e of the Agreement.
9. The final site plan shall return for review and approval by the Planning Commission.
The approval of the preliminary site plan is valid for (1) one year in accordance with Section 32.4.3.1 of
Chapter 18 of the Albemarle County Code. Therefore, the preliminary approval shall expire on October
20, 2007. If the preliminary site plan approval expires, a new application must be filed and processed.
Please address all of the requirements and conditions listed below and submit eight (8) tentative plan
copies to the Department of Community Development. This letter must be submitted with the tentative
plans, as a checklist, to document that you have addressed all requirements or conditions, or the tentative
plan will be denied.
Erosion and Sediment Control, BMP Stormwater Management, and road plans with the associated
applications and fees must also be submitted with the eight (8) tentative Plans.
Once the tentative plan is submitted and reviewed you will receive comments from all
departments /divisions /agencies that have made comment on the tentative plan. Any further
responses must be made directly to each department /division /agency that has further comment.
After all aforementioned departments /divisions /agencies have granted tentative approval, you must
verify with the Planner that you may submit the final mylars (1 set), paper copies (2 sets), the final
site plan application, and final site plan fee to the Department of Community Development. Signing
of the plans will occur within one week once it is determined that the final site plan mylars reflect all
tentative approvals.
The final site plan will be subject to all final site plan requirements (Zoning Ordinance Section 32.6), in
addition to the following conditions.
The Department of Community Development shall not accept submittal of the final site plan for signature
until tentative approvals for the following conditions have been obtained:

All conditions of the preliminary plan reviewed by the Planning Commission on October
10, 2006.
32.6.3] Approval of a landscape plan in compliance with Section 32.7.9. The landscape
schedule will need to show the canopy calculations; and
32.6.60)] Submit a description and photograph or diagram and show the location of each
type of outdoor luminaire that emits 3,000 or more initial lumens. Please be aware that
installation of such luminaires in the future that are not shown on this plan shall require an
amendment to this plan.
32.6.60 )] [4.17.4(b)] Submittal of a photometric plan on the site plan demonstrating that
luminaires are in compliance with 4.17.4 b.
32.6.4.1] The final plan approval is subject to the issuance of a Certificate of
Appropriateness from the Architectural Review Board.

At their October 10, 2006 meeting, the Planning Commission granted conditional approval of your preliminary
site plan for Phase 2 of the Pavilions at Pantops project. At that time, "Phase 2" included the property now
described as Phase 3. Nine conditions were attached to that approval per an October 20, 2006 approval letter
from Francis MacCall of this office. Attached, please find a copy of that letter. Please note that all nine
conditions, as well as any additional staff and agency comments, must be met prior to final site plan approval
of Phase 3.
Department of Community Development Zoning and Current Development has reviewed the final site plan
submittal (dated 8/4/08) against the conditions of the preliminary approval and applicable codes and
ordinances. Zoning and Current Development comments are as follows:

5. [32.5.6.a,c] Please provide a vicinity sketch /plan that shows this phase in relation to the other phases of
this project.
32.6.3] Approval of a landscape plan in compliance with Section 32.7.9 is required.
Please double check tree counts and canopy calculations, as I count 23 eastern arborvitae and the
plan lists 15.
If parking lot landscaping is not required, please remove chart from the plan; the current "XV
under the landscape calculations suggests this section was not completed.
Please address why Ulmus parvifolia and Juniper virginiana are included on the chart if they are
not used in the plan.
7. [32.5.6.1, n] Dimension street widths, building footprints, driveways...
8. [32.5.6.n] Limits of sidewalk are difficult to read, please consider using a hatch to delineate sidewalks.
9. [32.5.6.n] Provide details and construction information for proposed tennis court. Also, asphalt trail detail
is provided- please reference this detail on the plan.
10. [32.5.6.m] Provide distance from proposed intersection to nearest existing intersection.
11. [32.5.6.0] Address if utilities are to be dedicated for public use on the cover sheet.
12. [32.5.6.b] Because this project has been broken out into separate phases, please provide a calculations
chart to show that together the approved Phase 2 and proposed Phase 3 site plans meet the criteria and
standards approved on October 10, 2006, and if there are any residuals. A sample chart is below, although
you may adjust the table as necessary:

The plans for Pavilions at Pantops, Phase 3 submitted 5August 2008 have received Engineering
review. The following items from the Design Standards list are to be adequately addressed prior to
final approval:
1. Accurate current existing topography at the time of submittal, including all existing site
features, and any recent disturbances, all at a legible scale 118- 32.6.6, 14 -302]
2. Date and source of the topographic information: All topography should be at least visually
field verified by the designer within the last year [ 18- 32.6.6, 14 -302, Policy for date]
3. FEMA map and date references labeled for FEMA floodplain [Policy]
4. All existing easements (access, drainage, sight, sanitary easements, etc.) with deed book
references, locations and dimensions [18- 32.6.6, 14 -302]
5. Show all slopes 25% and over (critical slopes by County Zoning Ord.) are shaded 118-
32.6.6, 14- 3021Please place a statement on the plan that critical slope disturbance was
approved on the preliminary site plan for phase 2 (SDP200600042).
6. All Roads are to be designed to VDOT road standards. The minimum design speed is 25
mph with a posting of 20 mph. Please change the plans to meet these minimum standards.
7. Proposed slopes steeper than 3:1 will have low maintenance (not grass) ground cover

Stormwater management incorrectly refers to WP0200500013 (Pantops Park) as the
Water Protection plan for this site. Please indicate the correct plan and reference number

parking areas, areas where sediment -laden runoff will cross, or any construction relatedactivities. This must match any landscaping and conservation plans. The path to the
tennis court is shown crossing 2:1 slopes and will require significant grading to install.
Show the grading required to install the asphalt trail within the limits of grading. Below is
a trail cross sections detail provided by the Parks and Recreation department.

The basin and forebay will require reconstruction with this plan.
24. Please show a stockpile location, a staging and parking area, and all other construction

1, Refer to the Hyland Ridge Hydraulic Analysis for the demand calculations.
2. The locations of the fire hydrants on the layout exhibit do not match the

The Department of Community Development Zoning and Current Development has reviewed the above -
referenced final site plan (revision date 10.!31 /08) against the conditions of the preliminary approval and
applicable codes and ordinances. Please note that all nine conditions, as well as anv additional staff and
agency comments, must be met prior to final site plan approval of Phase 3. Zoning and Current
Development comments are as follows:
1. [32.5.6.a.c] Vicinity sketch /plan on C -4A is noted, however, please label the recreation area associated
with this phase of the development as Phase III.
2. [32.5.6.b] Thank you for providing a calculations chart that shows each phases site data. As you are
aware, together the approved Phase 2 and proposed Phase , site plans must meet the criteria and standards
approved with the Prelimimry Site Plan for Phase II, approved on October 10, 2006. Staff has reviewed
the chart and requests that you revise the chart as necessary so that the numbers add up appropriately and
make sense. Someone lookim at the chart should be able to determine how the total site area is broken
down in each phase, and how together the data compares to what was approved as "Phase 2 " in the
preliminary plan. The site area numbers should add up to the total site area. If you have any questions

Thank you...yes I did receive a water model from the developer that indicated 2000 GPM was achievable with a 20 PSI
residual. Once the water lines and hydrants are in place a field test should be conducted to verify the fact. No further

The side yard setback of ten feet is approved provided the applicant can ensure a minimum fire flow of 2000 GPM @
20 PSI residual pressure. This information is typically provided through the service authority or through water modeling
done by the developer. In the case of water modeling, an actual flow test must be conducted after the water lines and
hydrants are in place.

Keith on the review of Pavillions Phase 3.
In addition to regular site plan approval (for IBC /IFC issues), which I see is granted below, I need confirmation from you
that you have explicitly approved the side setback reduction to 10' on the units.
Sec. 4.11.3 of the County Code permits the applicant to reduce the side setbacks as long as the County fire official
approves it and there is adequate fire flows. I understand that the preliminary was reviewed and approved, and in that
plan reduced setbacks were shown, however in order to approve the final I do need a specific response to this issue.
The section from the ordinance is below (section A). Therefore, I am looking for an explicit statement from you regarding
your review of the reduced side setbacks.

4.11.3 REDUCTION OF BUILDING SEPARATION AND SIDE YARDS (Added 1 -1 -83, Amended
6- 11 -08)
The minimum building separation and side yards for primary structures may be reduced in
accordance with the applicable district regulations as follows:
A. Reductions for structures not within zero lot line developments; with adequate fire flows
or which are constructed in accordance with the building code. The minimum building
separation or side yards for primary structures may be reduced if the structure is not
located within a zero lot line development, but is located in an area where available fire
flows are adequate under Insurance Service Offices standards to allow the reduction.
Each primary structure for which the minimum building separation or side yard has been
reduced as provided in this subsection shall be subject to the following:
1. In the case of a side yard reduction, the Albemarle County fire official may require a
guarantee as deemed necessary to insure compliance with the provisions of this
section, and this guarantee may include, but not be limited to, appropriate deed
restrictions, disclosure, and other such instruments, which shall be of a substance and
be in a form approved by the fire official and the county attorney, and shall be
recorded in the records of the circuit court of the county;
2. No structure shall encroach within any emergency accessway required by the
Albemarle County fire official;
3. Unless constructed to a common wall, no structure shall be located closer than six (6)
feet to any lot line; and
4. No structure shall encroach on any utility, drainage or other easement, nor on any
feature required by this chapter or other applicable law.
B. Reductions for dwelling units within zero lot line developments. The minimum building
separation or side yards for detached dwelling units may be reduced to zero (0) feet on
one side for each dwelling unit located within a zero lot line development if the structure
is located in an area where available fire flows are adequate under Insurance Service
Offices standards to allow the reduction. Each zero lot line development shall be subject
to the following:
1. The subdivider shall submit with the final subdivision plat a lot development plan
showing all the lots in the zero lot line development and delineating the location of
each zero lot line dwelling unit;
2. The subdivider shall establish a perpetual wall maintenance easement on the lot
abutting the zero lot line side of the dwelling unit so that, with the exception of
fences, a minimum width of ten (10) feet between dwelling units shall be kept clear
of structures in perpetuity. This easement shall be shown on the final plat, shall be
of a substance and be in a form approved by the director of community development
and the county attorney, shall be recorded in the records of the circuit court of the
county with the approved final subdivision plat, and shall be incorporated by
reference in each deed transferring title to each lot that is a dominant and servient
estate; and .
3. Building footings may penetrate the easement on the adjacent lot to a maximum
distance of eight (8) inches.

The Department of Community Development Zoning and Current Development has reviewed the above -
referenced final site plan (revision date 10/31 /08) against the conditions of the preliminary approval and
applicable codes and ordinances. Please note that all nine conditions, as well as any additional staff and
agency comments, must be met prior to final site plan approval of Phase 3. Zoning and Current
Development comments are as follows:
32.5.6.b, c] Is the 6' asphalt trail part of Phase 3? If so, please revise all phase lines to include it, and be
sure to include it in the open space /land use calculations. If it is not to be part of Phase 3, be sure that all
open space /land use calculation do not include that area, and, that all limits of clearing /grading do not
include the trail. As drawn now, it appears the trail is not part of phase 3 (per sheet C4A), yet a
construction directions are provided in this set of plans (sheet C -9, for example). Also, please address tree
preservation hatch falls over the trail in Inset on Sheet C -9 (thus inside limits of CG).
2. [32.5.6.b] Thank you for revising the site data chart to more clearly show how Phases 2 and 3 compare to
the approved preliminary. There are still some discrepancies /issues I would like you to address:
Please provide a written explanation as to why overall, phases 2 +3 are providing 8 more units
than were approved with the preliminary.
Please confirm that the overall density is less than 6.0.
Why was the "area in parking and circulation" column removed?
Why are the impervious area calcs significantly different than on the last submittal?
The areas stating in the table for impervious area and area of open space do not match the
figures provided under Site Data notes above it.
Why are the estimated traffic generation numbers significantly less on this submittal than the
last submittal?
3. [32.5.6.p] Why was the mature tree height column removed? It is not required for approval, however it
was helpful on the last submittal.
4. [32.5.6.p] The conservation plan checklist signed and provided on the landscape plan is dated October
2008. This plan has been revised since 10 -2008 and it would be prudent to provide an updated signed
conservation checklist.
5. [32.6.6.g] Parking spaces must be a minimum of 9' wide at the narrowest point. For this reason, please
revise the dimensions (particularly the radial parking space dimensions) to read, "9' min., typ." I see where
this revision was made in some places, however please ensure that this note is provided wherever radial
parking is provided (sheet C -6, for example).
32.6.4.1 ] Final plan approval is subject to the issuance of a Certificate of Appropriateness from the
Architectural Review Board (ARB).
7. Albemarle County Service Authority (ACSA) approval is required prior to final plan approval. ACSA is
working with you directly towards tentative approval, however, also please be aware that Rivanna Water
and Sewer Authority (RWSA) is reviewing the plans and will be issuing their comments to ACSA.
8. Virginia Department of Transportation (VDOT) approval required prior to final plan approval.
9. Per our telephone conversation, you will be providing me a copy of the updated agreement between North
Pantops Townhouses LLC, Southern Development, Westminster - Canterbury of the Blue Ridge and the
Westminster - Canterbury of the Blue Ridge Residents' Association for the purposes of addressing the
changes in the plan since the original agreement was executed in October 2006.
10. The final site plan is required to return for review and approval by the Planning Commission.
Once all comments are addressed, this item will be scheduled for the Planning Commission. Please be
aware that the Commission may require justification from you addressing the relocation of the recreation
area, changing the open space recreation area to a tennis court, the re- orientation of the lots and product
change, and moving of the streets and parking changes.

I have reviewed the above plan and have the following comments:
Roads are proposed to be private. VDOT review of roads is not necessary.

The open cutting of Verona Dr. for the sanitary sewer should be avoided. When Verona Dr. is accepted
for state maintenance, this cut will require a mill and overlay of the pavement for 100 feet wither side of the cut.
The entrance dimensions and profile appear to meet the standards for a commercial entrance.
ITE trip generation numbers need to be added to the plan
Sight distance triangles must be shown at the entrance to Verona Dr. in accordance with the
requirements in the Minimum Standards of Entrances to State Highways. Any sight lines that fall outside of the
ROW on Verona must be within a sight distance easement.
Clear zone easements must be set 8 feet behind the face of curb along the entire frontage of the
property to ensure the lateral offset requirements in the VDOT Road Design Manual.

There calculations for 81 towhnhomes/ condominiums generating 537 trips according to land use code 230 are correct.
Typically a single unit house generates approximately 10 trips per day but when you go to condos, apartments and
townhomes, you see values are 6 trips per day per unit.

The traffic counts they presented in the set you reviewed and approved were significantly less than on previous
submittals (currently they are stating estimated traffic generation at 537 ADT for 81 townhouse units) I asked them to
please address the decrease, and their response was:
The traffic number previously reported was based on 10 vehicle trips per day per unit. The traffic generation
number now reported is based on the ITE 7t Edition Trip Generation (for townhouse ITE Code 230 equation Ln(T) =0.85
Ln(X)2.55). A copy is attached for your used.
I just need to verify with you that you reviewed the change and find this method acceptable.

The plan, entitled Pavilions at Pantops Phase 3 dated August 4, 2008, last revised
January 8, 2010, is hereby approved for construction. One set of the approved plan is
enclosed for your records. Any previously approved plans are voided with this approval.
This approval is for basic compliance with the General Water & Sewer Construction
Specifications of the Albemarle County Service Authority (ACSA) and does not relieve the
contractor from responsibility for his work as it relates to the plan and specifications.
The ACSA requires that a copy of the approved construction plan be on the job
site. The contractor is responsible for marking up a copy of the approved construction
plan showing as -built information and provide this data to your client at the completion of
utility installation. The final as -built plan shall be submitted in a format of one paper copy
and one myiar copy.
A preconstruction conference shall be scheduled with the project manager to
ensure coordination and answer any questions. This will be a short meeting to review the
project, materials, test methods and schedule, in order to expedite construction. Please
have the proper party call me at 977 -4511 to schedule the meeting.
This approval is valid for a period of 18 months from this date. If construction is
not in progress at the end of this time period, the approval shall be void.
The pressure for water may be less than 30 psi at some meter locations). If you
