PROPOSAL:
Request for a waiver of zoning ordinance section 5.1.11.a. A waiver of section 51.11.a will allow
a residential lot line to be located closer than 500 feet from an existing commercial kennel. The
applicant will be subdividing the existing property by family subdivision. The family subdivision
will result in the establishment of a lot line that will be 270 feet from an existing commercial
kennel, and a proposed dwelling that will be located 320 feet from the commercial kennel

closer than five hundred (500) feet to any agricultural or residential lot line.
Section 5.1.11.a of the zoning ordinance:
Each commercial kennel, veterinary service, office or hospital, animal hospital and animal
shelter shall be subject to the following:
a. Except la'here animals are confined in soundproofed, air- conditioned buildings, no structure
or area occupied by animals shall be closer than five hundred (500) feet to any agricultural or
residential lot line. For non - soundproofed animal confinements, an external solid fence not less
than six (6) in height shall be located within fifty (50)_feet of the animal confinement and
shall be composed of concrete block, brick, or other material approved by the zoning

COMPREHENSIVE PLAN:
The Comprehensive Plan designates this property as Rural Area (RA) in Rural Area 1.
CHARACTER OF THE AREA:
There is an existing commercial kennel with associated building(s), and a single family
residential home on the parcel. The rest of the land is undeveloped, and there is a stream in the
rear of the property. The surrounding area is developed with single family residential homes i.e.
Earlysville Forest subdivision to the east. and other single family residential homes to the North
and West of the property (Attachment B).
PLANNING AND ZONING HISTORY:
SP- 1976 -036 Approved July 21 1976 for expansion of an existing commercial kennel
SUB1990833 Exempt Plat created a two acre lot (TMP31 -47A1)

STAFF COMMENT:
The applicant has requested a waiver of section 5.1.11.a. The waiver, as stated above, will allow
a residential lot line to be located closer than five hundred (500) feet from an existing
commercial kennel. The lot line will be established by family subdivision. The resulting lot line
will be two hundred and seventy (270) feet from the commercial kennel, and a proposed
dwelling will be built approximately three hundred and twenty (320) feet away from the
commercial kennel. The relationship of the kennel to other lot lines and adjacent dwellings will
not change.
An expansion to the existing commercial kennel was approved by special use permit by the
Board of Supervisors (SP- 1976 -036) on July 21 1976 with conditions (Attachment C). The
kennel has been in existence, on the property, as early as 1978. Section 5.1.11.a of the zoning
ordinance was enacted on November 15 1989 (11/15/89) which is after the commercial kennel
had been established. Regulations governing how far a structure had to be from a commercial
kennel had not been enacted when the above special use pen was approved.
A proposed family subdivision will create a lot to be owned by an immediate family member,
Mr. Andrew L. Dofflemyer. As stated in the applicant's justification (Attachment D), Mr.
Andrew L. Dofflemyer currently runs /operates the existing commercial kennel i.e. Wakefield
Kennel.
Based on the information above, staff has no objection to the waiver of section 5.1.11.a. Section
5.1.11.a is meant to protect neighboring properties' health, safety and welfare including noise
that would otherwise arise from having a commercial kennel within close proximity. In this
instance, the neighboring property will be owned by the operator of the kennel, therefore, strict
application of section 5.1.11.a will not further the health, safety, or welfare of the community. As
required by the subdivision ordinance, the applicant will submit a family subdivision application
with an affidavit ascertaining that Mr. Andrew L. Dofflemyer is a member of the immediate
family.
Recommendation:
Staff recommends approval of the waiver of section 5.1.11.a. to allow a lot line to be located
closer than five hundred 500 feet from the existing commercial kennel.

3. Dogs to be kept within the building between the specified hours at night
of 10:00 p.m. to 6:00 a.m.
