Pursuant to Section 33.3 of the Albenswk County Code (the "CO(16" , the Owners, or
their duly authorized agents, hereby vohutarily proffer the conditions listed below which
shall only be applied, aocepr as specifically act forth beein to the area identified as Regional
Service Area C on the Application Plan, (defined below) comprising all or some of the above
referenced tax map parcels (the "Prvparty").
These conditions aro proffered as part of the requested zoning and it is agreed that: 1) the
rezoning itself gives rise to the need for the conditions; and 2) such conditions have a
reasonable relation to the rezoning request:
1. Development shall be in general accord with the Application Plan entitled Rezoning
Application Plans for Hollymead Town Center Regional Service Area C. (Sheets A-1, A-
2, 2, only), prepared by Rivanos Engineering & Swveyin& PLC, revised, last revised, July
7, 2003 ("Application Plan"). The standards of development and central features and
major elements within the Property essential to the deign of the development shall be in
general accord with the Block F.xht'bit, the Code of Development's Narrative, and the
Code of Development's tables and appendices act forth in the attached Application
Booklet, entitled "Hollymead Town Center, Application Booklet, ZMA-01-20 (Ara C)."
The Owners have presented, as part of their rezoning application, a number of conceptual
pleas and illustrations for various purpose, but principally to provide justification for the
rezoning actions they are seeking Unless specifically referenced in these proffers, all
plans and illustrations submitted as part of Applicant's rezoning application, other than
the Application Plan as defined above, shall be deemed illustrative only, and such plans
and illustrations shall not be deemed proffers. The Owners reserve the right to
reconfigure the internal block improvements, consisting of buildings, puling and drive
aisles and drive-through window features and as shown on the Application Plan in order
to: i) comply with conditions imposed by Special Use Permits, and ii) assum compliance
with ARB requirements iih) and provide all necessary storm water management and
BMP's as necessary.
2. The Owners of Ares C, as shown on the Application Plan (the "Owner") shall cause
completion of the following road improvements that shall be roads constructed to VDOT
standards and either be accepted by VDOT or be bonded for VDOT's acceptance a
follow:
A Construction of Timberwood Boulevard, as depicted on the Application Plan
and fhrther described as follows: i) from the intersection at US Route 29 to a new
terminus within Hoilytmesd Town Center that is shown at the atnession oftbe

foregoing, the road proffers described In proflfer 2 above shall be satisfied if the Owner
has submitted plans for all such rad improvements for review by VDOT, and although
such improvements are not fully completed by the issuance of a Certificate of Occupancy
for Area C, sufficient bond has been supplied to satisfy all aceta to complete such
improvements in accordance with plans approved by VDOT. Substantially complete for
the purpose of these ptoffn shall man approved ab -base gravel, curb and gutter,
intermediate surface and necessary storm water mamproa t improvements and
satisfactory completion of road unptovemanb requbvd for public safety, and

4. Upon request of the County, the Owner shall contribute $10,000.00 to the County or
VDOT for the purposes of Stndiug a regional tramspatnbn study fbr the Route 29
Corridor. The $10,000.00 condos shah be made within 30 days after requested by
the County after the first Seal site plan or subdivision plat is approved in Area C sod, if
rot expended for such purposes within three yeen Som the date the finds were

5. The Owner shall contribute 3200,000.00 (the "wan contribution-) to the County for the

I. PROJECT DESCRIPTION
THE PURPOSE OF THIS PROJECT IS TO PROVIDE THE CONSTRUCTION OF APPDXIMATELY 12,720 S.F. OF COMMERCIAL RETAIL
SPACE IN HOLLYMEAD TOWN CENTER, AREA C. THE SITE IS LOCATED IN ALBEMARLE COUNTY AND WILL INVOLVE DISTURBING
0.71 ACRES. THE DEVELOPMENT WILL INCLUDE A 2 -STORY BRICK BUILDING, PARKING SPACES, TRAVELWAY, RETAINING
WALL AND SUPPORT UTILITIES.
THE PROPOSED SITE IS LOCATED HOLLYMEAD TOWN CENTER. THIS SITE WAS CLEARED, GRUBBED AND GRADED AS PER THE
APPROVED MASS GRADING PLAN FOR HOLLYMEAD TOWN CENTER, AREA C. THE SITE DRAINS TOWARD SWM FACILITY #1.
III. ADJACENT PROPERTIES
THE SITE IS BOUNDED BY PROPOSED TIMBERWOOD BOULEVARD PHASE I TO THE SOUTH, BLOCKS 7 & 8 TO THE
NORTHWEST, A SELF -STORAGE FACILITY TO THE NORTHEAST AND AN UNDEVELOPED PARCEL X TO THE EAST, ALL WITHIN
HOLLYMEAD TOWN CENTER AREA C.
IV. OFF-SITE AREAS
ALL SOIL MATERIAL HAULED ONTO OR OFF-SITE WILL BE WITHIN AREAS OF HOLLYMEAD TOWN CENTER THAT HAVE A BONDED
ACTIVE EROSION AND SEDIMNT CONTROL PERMIT ISSUED BY ALBEMARLE COUNTY.
V. SOILS
A. SOILS
ACCORDING TO USDA SCS SOIL MAPPING, THE PROJECT SITE LIES ON SOIL TYPES, 27B-ELIOAK LOAM, 34D-GLENELG LOAM.
SOIL TYPE 2713-ELIOAK LOAM, SOIL TYPE 34D-GLENELG LOAM, 15 TO 25 PERCENT SLOPES, IS DEEP, MODERATELY STEEP,
WELL DRAINED SOIL THAT IS FOUND ON SIDE SLOPES ALONG DRAINAGEWAYS. SLOPES ARE SMOOTH AND ABOUT 400 TO 800
FEET LONG. AREAS OF THIS SOIL COMMONLY ARE LONG AND WINDING. THEY RANGE FROM 10 TO 40 ACRES. THIS SOIL HAS
AN ERODIBILITY FACTOR K = 0.32 AT 0-8 INCHES WITH PERMEABILITY RANGING FROM 0.6-2.0 INCHES PER HOUR. 34D

VI. CRITICAL AREAS
CARE SHALL BE TAKEN TO STABILIZE ALL SLOPES AND PREVENT EROSION. CARE SHALL ALSO BE TAKEN TO MINIMIZE THE
TRANSPORT OF SEDIMENT ONTO TIMBERWOOD BOULEVARD OR INTO THE BIOFILTER AREAS.
VII. EROSION AND SEDIMENT CONTROL MEASURES
ALL VEGETATIVE AND STRUCTURAL EROSION AND SEDIMENT CONTROL PRACTICES SHALL BE CONSTRUCTED AND MAINTAINED BY
THE CONTRACTOR IN ACCORDANCE WITH THE LATEST EDITION OF THE VIRGINIA EROSION AND SEDIMENT CONTROL HANDBOOK.
SYMBOLS, DETAILS, AND DIMENSIONS USED ARE TAKEN FROM THE HANDBOOK, AS WELL AS THE VIRGINIA DEPARTMENT OF

A. STRUCTURAL PRACTICES
1. TEMPORARY PAVED CONSTRUCTION ENTRANCE (CE) 3.02: TEMPORARY CONSTRUCTION ENTRANCES SHALL BE PAVED IN
ACCORDANCE WITH ALBEMARLE COUNTY REQUIREMENTS. A MINIMUM WATER TAP OF 1" MUST BE INSTALLED WITH A
MINIMUM 1 11BALLCOCK SHUTOFF VALVE SUPPLYING A WASH HOSE WITH A DIAMETER OF 1.5" FOR ADEQUATE
CONSTANT PRESSURE. WASH WATER MUST BE CARRIED AWAY FROM THE ENTRANCE TO AN APPROVED SETTLING AREA

STOCKPILED FOR LATER USE. STOCKPILES ARE TO BE STABILIZED WITH TEMPORARY VEGETATION AND HAVE SILT
FENCE INSTALLED ALONG THE LOWER PERIMETER. STOCKPILES SHALL BE LOCATED AS SHOWN ON THE PLANS.
2, TEMPORARY SEEDING (TS) 3.31: ALL DENUDED AREAS WHICH WILL BE LEFT DORMANT FOR EXTENDED PERIODS
OF TIME SHALL BE SEEDED WITH FAST GERMINATING TEMPORARY VEGETATION IMMEDIATELY FOLLOWING GRADING. SEED
SELECTION WILL BE DEPENDANT ON THE TIME OF YEAR IN ACCORDANCE WITH THE EROSION AND SEDIMENT CONTROL
HANDBOOK.
3. PERMANENT SEEDING (PS) 3.32: PERMANENT SEEDING SHALL BE PROVIDED ON SITE TO PROVIDESTABILIZATION FOR

POUNDS OF KENTUCKY 31 FESCUE, 2 POUNDS OF RED TOP GRASS, AND 20 POUNDS OF A SEASONAL NURSE CROP.
FOR LOW MAINTENANCE SLOPES STEEPER THAN 3:1 APPLY 128 POUNDS OF KENTUCKY 31 FESCUE, 2 POUNDS OF
RED TOP GRASS, AND 20 POUNDS OF SEASONAL NURSE CROP. THE SEASONAL NURSE CROP USED IS BASED ON THE
FOLLOWING SEEDING DATES: FROM FEBRUARY 16 THROUGH APRIL USE ANNUAL RYE; FROM MAY 1 THROUGH AUGUST
15 USE FOXTAIL MILLET; FROM AUGUST 16 THROUGH OCTOBER USE ANNUAL RYE; AND FROM NOVEMBER THROUGH

C. MINIMUM STANDARDS
MS -1. STABILIZATION OF DENUDED AREAS:
PERMANENT OR TEMPORARY SOIL STABILIZATION SHALL BE APPLIED TO DENUDED AREAS WITHIN 7 DAYS AFTER
FINAL GRADE IS REACHED ON ANY PORTION OF THE SITE. TEMPORARY SOIL STABILIZATION SHALL BE APPLIED
WITHIN 7 DAYS TO DENUDED AREAS THAT MAY NOT BE AT FINAL GRADE, BUT WILL REMAIN DORMANT OR
UNDISTURBED FOR LONGER THAN 30 DAYS. PERMANENT STABILIZATION SHALL BE APPLIED TO AREAS THAT ARE:
TO BE LEFT DORMANT FOR MORE THAN ONE YEAR.
MS -2. STABILIZATION OF SOIL STOCKPILES:
DURING CONSTRUCTION OF THE PROJECT, SOIL STOCKPIILES AND BORROW AREAS SHALL BE STABILIZED OR
PROTECTED WITH SEDIMENT TRAPPING MEASURES. THE APPLICANT IS RESPONSIBLE FOR TEMPORARY PROTECTION
AND PERMANENT STABILIZATION OF ALL STOCKPILES ON SITE AS WELL AS BORROW AREAS AND SOIL INTENTIONALLY
TRANSPORTED FROM THE PROJECT SITE.
MS -3. PERMANENT VEGETATIVE COVER:
A PERMANENT VEGETATIVE COVER SHALL BE ESTABLISHED ON DENUDED AREAS NOT OTHERWISE PERMANENTLY
STABILIZED. PERMANENT VEGETATION SHALL NOT BE CONSIDERED ESTABLISHED UNTIL A GROUND COVER IS
ACHIEVED THAT, IN THE OPINION OF THE E&S INSPECTTOR, IS UNIFORM AND MATURE ENOUGH TO SURVIVE AND
INHIBIT EROSION.
MS -4. TIMING AND STABILIZATION OF SILT TRAPPING MEAkSURES:
SEDIMENT BASINS AND TRAPS, STORM INLET PROTECTION, SILT FENCING, AND OTHER MESURES INTENDED TO TRAP
SEDIMENT SHALL BE CONSTRUCTED AS A FIRST STEP iIN ANY LAND DISTURBING ACTIVITY AND SHALL BE MADE
FUNCTIONAL BEFORE UPSLOPE LAND DISTURBANCE TAKES PLACE.
MS -5. STABILIZATION OF EARTHEN STRUCTURES: N/A
STABILIZATION MEASURES SHALL BE APPLIED TO EARTHEN STRUCTURES SUCH AS DAMS, DIKES AND DIVERSIONS
IMMEDIATELY AFTER INSTALLATION.
MS -6. SEDIMENT BASINS AND TRAPS:
SEDIMENT TRAPS AND BASINS SHALL BE CONSTRUCTED BASED UPON THE TOTAL DRAINAGE AREA TO BE SERVED.
A. THE MINIMUM CAPACITY OF A SEDIMENT TRAP SHALIL BE 134 -CUBIC YARDS PER ACRE OF DRAINAGE AREA, AND
SHALL CONTROL A DRAINAGE AREA OF LESS THAN 3 -ACRES.
B. THE MINIMUM CAPACITY OF A SEDIMENT BASIN SHALLL BE 134 -CUBIC YARDS PER ACRE OF DRAINAGE AREA,

DEPOSITED IN A SUITABLE AREA AND IN SUCH A MANNER TIHAT IT WILL NOT ERODE.

INSTALL CULVERT INLET TRAP.
2. CONSTRUCT AND INSTALL ALL EROSION AND SEDIMENT CONTROL MEASURES AS IS PRACTICABLE.
3. PERFORM GRADING TO BRING ALL AREAS TO GRADES SHOWN; INSTALL UTILITIES, CURB AND GUTTER,
PAVEMENTS AND CONSTRUCT BUILDING A.
4. PROVIDE TEMPORARY SEEDING AND OTHER EROSION CONTROL DEVICES TO MINIMIZE TRANSPORT OF
SEDIMENT.
5. PERFORM PERMANENT SEEDING, STRAW MULCHING, AND STABILIZE ALL DISTURBED AREAS. APPLY
DOUBLE SHREDDED HARDWOOD MULCH TO PLANTED AREAS.
6. CULVERT INLET PROTECTION FOR THE CULVERT TO EX ST -57A IS TO REMAIN IN PLACE UNTIL BUILDING A IS
COMPLETE, THE PARKING LOT HAS BEEN STABILIZED AND THE STORM DRAIN SYSTEM IS FUNCTIONAL.
