HomeMy WebLinkAboutZTA201600004 Resolution - Board of Supervisors 2016-04-19RESOLUTION OF INTENT WHEREAS, Albemarle County Code § 18-30.3, which is part of the Albemarle County Zoning Ordinance, establishes the flood hazard overlay district; and WHEREAS, in order to prevent the loss of life and property, the creation of health and safety hazards, the disruption of commerce and governmental services, the extraordinary and unnecessary expenditure of public funds for flood protection and relief, and the impairment of the tax base, the County regulates the uses, activities, and development within districts subject to flooding; and WHEREAS, Title 44 of the Code of Federal Regulations establishes requirements for local flood plain management regulations and requires that local flood plain management ordinances be revised and updated accordingly when flood insurance rate maps are updated; and WHEREAS, a flood insurance rate map panel is being updated in a portion of the southern part of Albemarle County along the James River and it is therefore necessary to revise the reference date of the flood insurance rate map in Albemarle County Code § 18-30.3. NOW, THEREFORE, BE IT RESOLVED THAT for purposes of public necessity, convenience, general welfare, good zoning practices and continuing participation in the federal flood insurance program, the Albemarle County Planning Commission hereby adopts a resolution of intent to consider amending Albemarle County Code § 18-30.3.2, Flood Insurance Rate Map and Flood Insurance Study, to refer to and incorporate the flood insurance rate maps and flood insurance study effective on and after May 16, 2016, and to consider amending any other sections of the Zoning Ordinance deemed to be appropriate to achieve the purposes described herein; and BE IT FURTHER RESOLVED THAT the Planning Commission shall hold a public hearing on the zoning text amendment proposed pursuant to this resolution of intent, and make its recommendations to the Board of Supervisors at the earliest possible date.
