Dear Ms. Kane—
As you'll recall, you requested an indefinite deferral for this special use permit request. That deferral request
will expire on June 1, 2016.
We want to bring to your attention Section 33.4 (r) (2) of the Zoning Ordinance, which states the following:
When application deemed withdrawn. An application shall be deemed to have been voluntarily
withdrawn if the applicant requested that further processing or formal action on the application
be indefmitely deferred and the commission or the board of supervisors is not requested by the
applicant to take action on the application within one (1) year after the date the deferral was
requested. Upon written request received by the director of planning before the one (1) year
period expires,the director may grant one extension of the deferral period for a period
determined to be reasonable,taking into consideration the size or nature of the proposed use, the
complexity of the review, and the laws in effect at the time the request for extension is made. Upon
written request received by the clerk of the board of supervisors before the extension of the deferral
period granted by the director expires, the board of supervisors may grant one additional extension of
the deferral period determined to be reasonable, taking into consideration the size or nature of the
proposed use, the complexity of the review, and the laws in effect at the time the request for extension is
made. The timely receipt by the clerk of the extension request shall toll the expiration of the extended
deferral period until the board acts on the request.
Given the resubmittal schedule and the time needed to review any resubmittal on this application, the Planning
Commission will not be able to take action before the June 1st deadline, after which the application would be
deemed withdrawn. However, upon written request received by the director of planning before the one (1) year
period expires, the director may grant one extension of the deferral period for a period determined to be
reasonable, taking into consideration the size or nature of the proposed use, the complexity of the review, and
the laws in effect at the time the request for extension is made. This is also described in bold in the previous
paragraph.
If you intend to pursue the special use permit for special events, you will need to request this extension. It is
important that your written request include your justification for requesting an extension and the timeframe you
think will be needed in order to get this request to the Planning Commission for action. If the director of
planning does not extend the deferral period before the end of the deferral, per Zoning Ordinance Section 33.4
(r) (2), the application will be deemed withdrawn.
If, on the other hand, you do not intend to pursue approval of this special use permit request,please send me a
written request to withdraw the application, so that we can have accurate information on its status.
