Box 645 Charlottesville, VA 22902 jess@reddirtdev.com RE: ZMA201600006 Glenmore K2C Proffer Amendment Dear Mr. Achenbach: Staff has reviewed your submittal to reduce the cash proffer amount previously approved with ZMA200600016. Planning Comments As you may know, two similar requests have been made for cash proffer reductions, which the Planning Commission has not recommended for approval. The Fiscal Impact Advisory Committee (FIAC) recommended a lower amount for cash proffers in 2015 (staff report) and the applicants for reduced cash proffers requested reductions to the FIAC recommended amounts (report for Spring Hill Village; report for Out of Bounds). The cash proffer amounts recommended by FIAC provide a reasonable benchmark for a maximum cash proffer per residential unit under the current CIP and CNA. However, that does not mean that the per unit amount proffered by the applicant and accepted by the Board when the property was originally rezoned was inconsistent with the cash proffer policy or was anything other than a reasonable condition intended to address the impacts from the rezoning. Staff will be bringing a comprehensive plan amendment recommendation to the Planning Commission in May and to the Board of Supervisors in June to repeal the cash proffer policy in light of the most recent State Code changes that will be in effect on July 1, 2016. If approved, staff will be evaluating and establishing a new approach to calculating the impacts of development for Planning Commission and Board consideration. At this juncture, you may wish to wait until after the Board acts on Spring Hill Village and Out of Bounds or wait until the Board completes its new approach to calculating the impacts of development before you ask for a public hearing with the Planning Commission. Alternatively, you may request that your project move to a public hearing with the Commission at its earliest date. Currently, the earliest possible meeting date available is June 215t Notification and Advertisement Fees Payment of the following fees is needed by May 27, 2016 in order for this item to be advertised for the June 2Pt Planning Commission meeting. $131.75 Cost for newspaper advertisement (PC) $215.00 Cost for notification of adjoining owners $346.75 Total amount due prior to Planning Commission public hearing Prior to the Board of Supervisor's public hearing, payment of the newspaper advertisement for the Board hearing is needed. $131.75 Additional amount due prior to Board of Supervisors public hearing $478.5 Total amount for all notifications Fees may be paid in advance.
