[14-302(A)(10)] Right of further division of proposed lots. Remove the note regarding development rights as they only apply in the Rural Areas and these parcels are zoned R-1. V2. [14-302(B)(8)] Yards. The setback and yard requirements have changed in R-1 zoned districts;please either remove the setback note (it isn't required on a boundary line adjustment plat) or revise the note to reflect the /' new regulations as presented in section 4.19. ✓3. [14-303(D)] Acreage of lots.The total acreage of Old Trail Creekside III Phase IIID is noted as 5.10 acres, but the residue of this boundary line adjustment (which should match phase IIID) is noted as 5.257 acres; please clarify. Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is kept up to date by the County Attorney's office.The Code may found on the County Attorney's website which may be found under"Departments and Services”at Albemarle.org. In accord with the provisions of Section 14-229(B) of Chapter 14 of the Code if the developer fails to submit a revised final plat to address all of the requirements within six(6) months after the date of this letter the application shall be deemed to have been voluntarily withdrawn by the developer.
